IMPORTANT NOTICE REQUIRED BY LAW

THE RULES SET FORTH BELOW GOVERN THE TERMS OF YOUR RENTAL AGREEMENT WITH THIS MOBILE HOME PARK. THE LAW REQUIRES ALL RULES AND REGULATIONS OF THIS PARK BE REASONABLE. NO RULE OR REGULATION MAY BE CHANGED WITHOUT YOUR CONSENT UNLESS THIS PARK GIVES YOU 90 DAYS NOTICE OF THE CHANGE.

SUBJECT TO THE TERMS OF ANY WRITTEN LEASE AGREEMENT, YOU MAY CONTINUE TO STAY IN THIS PARK AS LONG AS YOU PAY YOUR RENT AND ANY OTHER LAWFUL CHARGES, FOLLOW THE RULES AND REGULATIONS OF THE PARK AND APPLICABLE LOCAL, STATE AND FEDERAL LAW, DO NOT DAMAGE PARK PROPERTY AND DO NOT REPEATEDLY BOTHER OTHER TENANTS IN THE PARK. YOU MAY BE EVICTED FOR NONPAYMENT OF RENT, BUT ONLY IF YOU FAIL TO PAY ALL RENT DUE WITHIN THIRTY DAYS AFTER YOU RECEIVE WRITTEN NOTICE THAT YOU ARE BEHIND IN YOUR RENT.

YOU MAY BE EVICTED FOR NOT FOLLOWING THE RULES AND REGULATIONS OF THIS PARK BUT ONLY IF THE RULES AND REGULATIONS ARE REASONABLE, YOU HAVE BEEN GIVEN WRITTEN NOTICE OF YOUR FAILURE TO FOLLOW THE RULES AND YOU THEN CONTINUE TO BREAK THE RULES. YOU MAY NOT BE EVICTED FOR JOINING A TENANTS ORGANIZATION.

IF THIS PARK WISHES TO EVICT YOU IT MUST GIVE YOU A 60 DAYS ADVANCE NOTICE, EXCEPT IF YOU ARE BEHIND IN YOUR RENT IN WHICH CASE ONLY 30 DAYS NOTICE IS REQUIRED. THE EVICTION NOTICE MUST GIVE YOU THE REASON FOR THE PROPOSED EVICTION.

YOU HAVE THE RIGHT TO SELL YOUR HOME IN PLACE TO ANY ONE AS LONG AS THE BUYER AND HIS HOUSEHOLD MEETS THE RULES OF THIS PARK. YOU MUST NOTIFY THE PARK IF YOU INTEND TO SELL YOUR HOME. FAILURE TO DO SO MAY MEAN THAT THE BUYER WILL BE REQUIRED TO MOVE THE HOME FROM THE PARK.

COPIES OF THE LAW UNDER WHICH THIS NOTICE IS REQUIRED, RSA 205-a, MAY BE OBTAINED FROM THE CONSUMER PROTECTION DIVISION OF THE ATTORNEY GENERAL’S OFFICE, 33 CAPITOL STREET, CONCORD, NEW HAMPSHIRE 03301 OR MAY BE ACCESSED FROM THE GENERAL COURT WEBSITE FOR THE STATE OF NEW HAMPSHIRE.

RULES AND REGULATIONS and PARK STANDARDS

Definitions:

“Resident” or “Household” shall mean persons approved on the original Park Application or any person approved by Park Application thereafter.

“Guest” shall mean any unapproved person visiting any Resident in the park.

“Person” shall mean any natural person, corporation, partnership, or sole

proprietorship.

“Park” shall mean the same as management.

“Residence” shall mean a home located within Merrymeeting River Mobile Home Park.

“Home Owner” shall mean the Resident(s) who owns a home in Merrymeeting River Mobile Home Park by recorded deed at the Belknap County Registry of Deeds, either by name or by Trustee of Trust.

“Merrymeeting” shall mean Merrymeeting River Mobile Home Park.

“Family Unit” shall be a primary social group of parents and their children.

“Park Approval” is the process of being accepted as a Resident/Household of Merrymeeting through the current residency application process.

Residency and Guests

1. This is a Family Community, with each Household consisting of only one Family Unit. Only those persons approved on the original park application are permitted to reside in the park. Any new person(s) added to the home/residence must complete the residency application process and secure Park Approval.

2. The owner(s) of the home shall also be a Resident(s) of Merrymeeting.

3. No home shall be owned or occupied by more than one Family Unit.

4. The maximum occupancy shall be two persons in the master bedroom and one person per bedroom thereafter. Maximum occupancy varies by site and is dependent upon the septic design and approvals for each site.

5. The addition of a Resident over the occupancy limit of the site shall be reason for eviction. Also, the addition of any person without “Park Approval” shall be reason for eviction.

6. The Home Owner(s) is completely and entirely responsible for any and all action(s) of their Household, Guest(s), dependent(s), person(s), or pet(s), including but not limited to, conduct, damages, and violations of the Park Rules. The same consequences apply to the Home Owner as if the Home Owner had committed the action or violation him/herself. The consequences may be as severe as, but not limited to, eviction, as per the Park Rules.

7. Guests are not allowed unless the Resident is present. However, as a Family Community, we welcome Grandparents, Parents, Children, and Grandchildren of the Home Owner with prior Park permission.

8. Residents having a Guest(s) for more than two nights must notify the office prior to their stay in the park.

9. Any Guest visiting a Resident’s home for a period of more than thirty days must notify the management and secure Park permission prior to the stay. The Park does not encourage visits longer than 30 days and permission may be withheld. Management reserves the right to limit the number of Guests and/or their usage of community facilities and amenities. Any Guest wishing to become a Resident must secure Park Approval to stay beyond 30 days.

10. Management reserves the right to ask any Guest to leave at any time for any reason, including violations of the park rules, regulations, and standards.

Rents, Fees, and Charges

1. Monthly rents are due and payable in advance on the first day of the month. Rents received in the office by 5:30 pm on the 7th day of the month due will earn a discount. Rents received after the 15th day of the month will be assessed a service fee, and will be subject to eviction. The rent discount may not be taken if there are any outstanding bills over 30 days due to the Park. (See current rent letter for rents, fees, and discounts).

2. Rents may be paid at the office during office hours, or mailed to:

3. There will be a fee for each check that is returned, and the discount will not be allowed. A returned check shall then be replaced by cash or money order.

4. A Home Owner and their Household may be evicted for non-payment of rent and/or for other violation(s) of the park rules, regulations, and standards.

5. There is a non-refundable fee for processing the Residency Application. (See the current Residency Application package.)

6. The Park may require the Resident to pay a security deposit of one month’s rent upon acceptance into the park for residency.

Sale, Transfer, or Removal of Homes

1. A Home Owner may sell his/her home while it is situated in the park at a price of their choosing. The Home Owner may place no more than two “For Sale” signs on or in his/her home not to exceed 1’ by 2’.

2. The Park reserves the right to approve the prospective new Home Owner, assignee or equivalent, and their Household as a Resident in the park by the Park Approval process.

3. The purchaser will not be approved as a Resident unless the current owner(s) informs the park of his/her intent to sell. Prior to the closing of the sale, the prospective Home Owner(s) and their Household shall secure Park Approval, which includes, but is not limited to, interview, income verification, credit report, criminal report, and eviction search. There is a non-refundable fee for the Residency Application to be processed.

4. The Park requires a pre-sale inspection of the home. The Park shall provide, within 14 days of receiving written notification from the Home Owner that he or she is going to attempt to sell his or her home in place, a written list of the repairs and improvements required in order to approve the sale. This list is valid for 90 days. If a sale has not been completed, the Park may require additional improvements or repairs, along with the original needed repairs, if there are any other defective conditions which may have arisen since the Park’s initial response. If the pre-sale inspection determines the existence of a structure or fixture which was added to the home by the seller without the permission of the Park, the Park shall require park compliance.

5. The prospective Home Owner(s) and their Household must agree to abide by the park rules, regulations, and standards prior to acceptance for residency in the park.

6. A Home Owner shall not remove a home unless and until the Park receives written notice of the intent to move 30 days prior to the date of removal. The Home Owner must also provide written proof of town taxes paid and rent paid through date of removal. The Park may require additional rent to be paid if a 30 day written notice is not received.

7. Any Home Owner wishing to add another owner to the deed, including a family member, shall make arrangements for a Residency Application to be processed and approved before the deed can be changed. New Hampshire Law requires a recorded deed on the sale of all mobile/manufactured homes, which includes written approval of the sale by the Park Owner.

8. The current Home Owner shall inform the real estate agent and the prospective purchaser of any work that is needed on the home or its structures to meet current park rules, regulations, and standards. If current standards are not met by the current owner prior to sale, the responsibility may, at the Park’s discretion, transfer to the new Home Owner. Park Approval will then be contingent on a written agreement with the Park for the prospective Home Owner to complete all needed work within 30 days of the closing.

9. Should the Home Owner die, and there is an heir wishing to inherit the home at its present location, the decedent grants to the Park the right to approve the heir as Home Owner.

10. Should the Home Owner die and there be no heirs, or should death occur and heirs receive no cash from the estate from which to pay rent, or heirs refuse or otherwise do not pay rent when due, or should the rent otherwise remain unpaid for 45 days from the date of death, the Home Owner grants to the Park any or all or the following:

* the right to purchase the decedent’s home at fair market value minus any and all outstanding debts owed to the Park and any recorded liens against the decedents home,

* the right to remove the home from the park and place it on a sales lot,

* the right to remove the home from the park and place it in a storage area,

* the right to demolish the home.

11. Any and all costs to the Park in dealing with the decedent’s home shall become debts to the estate of the said decedent and due and payable to the Park upon settlement of the decedent’s estate. This obligation of the Home Owner shall bind the heirs, executors, administrators, or assigns. The heirs shall be responsible for any attorney’s fees or other fees necessary to settle this matter.

Park Standards

In order to maintain the general attractiveness of the park, the safety and welfare of all Residents, and reasonable aesthetic values that Residents have been led to expect, the following standards shall apply to all homes.

1. In order to maintain an attractive atmosphere and a sense of quality throughout the park, every home to be placed in the park shall be newly manufactured and conform to park regulations at the Park’s discretion.

2. Any home damaged by fire, vehicle, wind, trees, snow, or by any other means, in a manner whereby it becomes uninhabitable or it appears unsightly shall be removed from the park by the Home Owner at their expense within 30 days of damage, regardless of when their insurance company promises settlement. The Home Owner grants to the Park the right to demolish and remove the damaged home from the park at the Home Owner’s expense after thirty days. The Home Owner also forfeits the lot and Residency in the Park.

3. There shall be no sub-renting or sub-letting of one’s home in the Park. This includes, but is not limited to, bringing in, engaging, enlisting, loaning to, placing, signing on, taking in or on another person(s) into the Resident’s home. Only those person(s) who have gone through the Park Approval process and have been approved shall reside in a Home Owner’s home. This shall apply to all persons who visit longer than 30 days.

4. Commercial enterprises of any kind are not allowed in the park. The Resident shall not conduct any peddling or soliciting of any nature without the written consent of the Park. The Resident shall not use his/her home as a place of business, part time or full time. Baby sitting, child care, taking in of laundry, or animal boarding is not allowed.

5. The Resident shall see that no persons other than established service people shall be permitted on the Resident’s lot during his absence without the express written permission from the Resident and the Park. The Park requires that the Home Owner inform the Park of any and all service work to be done outside the home to be sure that any work done will meet park standards.

Pets

1. No pets are allowed without written approval of the Park. The Park reserves the right to be the sole judge of any pet as to whether it is suitable or unsuitable for park residency. 2. Guest pets shall be kept confined and meet all of the criteria of the park rules and regulations. “Pet sitting” or boarding is not allowed.

3. The Resident shall not keep any wild animals as pets, and under no circumstances shall there be cages, houses, or structures of any type for any animal(s) on his lot or anywhere in the park.

4. The Resident shall not keep any farm-type pets within the park, including but not limited to, rabbits, chickens, ducks, pigs, and geese. Park will permit domestic pets such as tropical fish, one bird, one hamster, and one gerbil, provided they remain inside the home and do not disturb their neighbors or other Residents of the park. Any health hazard caused by pets will be the Home Owner’s responsibility and/or lead to eviction. Any inside pets that repeatedly disturb, disrupt, or cause a health hazard to others in the park will have to be permanently removed from the park. If not removed from the park, the Home Owner and their Household will be evicted. The Park shall be the sole judge of what constitutes a health hazard or disturbance to other Residents.

5. The Park allows one indoor cat, neutered or spayed before 6 months old, with all shots, and the Resident shall keep up-to-date veterinary certificates on file in the park office. If the cat is taken outside, it shall be leashed at all times and picked up after.

6. Dogs

a. The Park allows one dog, with advanced Park permission.

b. The dog shall be a breed that does not exceed 35 pounds when full grown.

c. The dog shall be spayed or neutered before allowed in the park or before the dog is 6 months old, and have up-to-date rabies and distemper shots, with veterinary certificates on file with the park office.

d. Dog houses, dog pens, and dog runs are not allowed, and dogs shall not be left unattended outside.

e. Dogs will be leashed at all times, under control at all times, and never left to bark. Droppings will be picked up immediately, and placed in the dumpster in a plastic bag.

f. The Park Owner may require that a dog shall be removed permanently from the park after three complaints of barking, and/or not being picked up after.

g. If the dog bites any person or other animal, the dog owner shall remove it immediately and permanently from the park.

h. Complaints against a Resident about their dog need to be filed in writing at the office. The complaint shall include all issues, times and dates, and be signed by the complainant.

i. Damages by a dog will be the sole responsibility of the owner of the dog, including but not limited to, personal property, liability, attorneys fees, court fees, hospital fees, etc. The Home Owner is responsible for their dog and any dog belonging to a member of their Household or their Guest.

j. Please be thoughtful about where your dog drops. The well head protection area, the water system faucets and well heads, all buildings and homes, all lawns, play grounds, and the pool area are off limits. Please confine walking to the roads.

k. The Park reserves the right to be the sole judge as to whether a dog is suitable or unsuitable for park residency. Termination of a dog’s residency in the park shall be judged solely by the management.

l. The Resident shall indemnify, defend and save and hold harmless the Park owner and the Park management from any and all damage and liabilities relating to their dog or their Guest’s dog, and/or relating to termination of the dog’s residency.

Motor Vehicles

1. The Speed Limit in the park is 5 miles per hour, strictly enforced. Repeated violations of the speed limit by the Home Owner, their Household, or their Guests, shall be grounds for eviction of the Home Owner and their Household.

2. Vehicle operation is limited to roads and driveways.

3. No parking on lawns. All vehicles shall be parked only in the driveway. The Park reserves the right to limit the number of vehicles per household. Additional parking is available for Guests in the front parking lot.

4. The Resident, members of the family, or Guests shall not leave any motor vehicle unattended in the traveled part of the roadway at any time. Keys shall be removed and vehicles properly parked so as not to present a hazard.

5. The Resident, members of the family, or Guests shall not drive an automobile in the park if unlicensed, regardless of whether or not he is accompanied by a licensed driver.

6. There shall be no unregistered or non inspected vehicles allowed in the park. The Resident shall not store any vehicles in the park, registered or not.

7. Vehicles shall not be repaired or overhauled in the park. This includes, but is not limited to, cars, vans, trucks, trailers, ATV’s, boats, motorcycles, mini bikes, snowmobiles, motorized scooters, golf carts, etc.

8. For health and safety reasons, any gasoline spill must be reported to the Park immediately for clean up. The Home Owner will pay all expenses associated with a NHDES certified clean up. Damage to, but not limited to, paved parking area, roads, lawns, trees, or the park’s water system, caused by leaking gas, oil, antifreeze, or any other fluid, from a motor vehicle(s) shall be repaired or replaced by the Park at the Home Owner’s expense. This shall include Guest vehicles.

9. Resident’s registered campers, boats on trailers, and snowmobiles may be kept only with Park permission, in the Resident’s driveway. Utility trailers, construction trailers, and bob houses are not allowed to be kept in the park. No camper or tent will be set up or used in the park without prior permission. The Park reserves the right to limit the length of time and/or the number of the above items allowed.

10. Commercial or private vehicles over one ton capacity are not permitted in the park without Park permission.

11. Any contractor working in the park and leaving their vehicle(s), construction trailer or other equipment overnight, must properly secure and park them so as not to block traffic nor present a hazard to any Resident or their Guests.

12. Residents are responsible for snow removal and sanding of their driveway and walkway.

13. Motorized recreational vehicles, including but not limited to, ATV’s, mini bikes, motorized scooters, golf carts, etc., shall not be operated in the park, nor shall there be any outside storage of these items.

14. Snowmobiles will be allowed as indicated on the marked snowmobile trails. (See management for when and where). In addition, the Resident shall not operate any snowmobile, including but not limited to, on any plowed roads, across lots, or around homes.

Campfires

1. Campfires are only allowed in park-provided fireplaces. Campfires shall only be burned in accordance with the park’s campfire permit.

2. Fireplaces must only be installed by the Park and not moved or modified by anyone other than Park management. Availability may be limited as not every lot allows for a fireplace. The Park shall be the sole judge.

3. Campfires must burn no more than knee high, and must burn only clean firewood, no trash or demo materials allowed.

4. All campfires must be attended by a responsible adult who is capable of controlling and extinguishing the fire at all times.

5. When campfires are left, they shall be completely extinguished. Completely extinguished means extinguished so that it emits no smoke, heat, or flames. The term does not include a buried fire.

6. All wood shall be stored a shed, under the home, or neatly stacked outside in a park-approved area. Fireplace debris, when cold, shall be bagged and placed in the dumpster. The Resident may also ask the Park for removal of fireplace debris.

7. The Park will revoke fireplace privileges, remove the fireplace permanently, and may proceed with eviction if any or all of these campfire rules are not strictly adhered to by the Resident, their Household, and/or their Guest.

8. The Resident shall have no other open fires.

9. Charcoal or gas cooking is allowed in a grill and must be carefully attended by the Resident.

Conduct

1. Responsible quiet must be maintained between the hours of 10 pm and 8 am. No loud radios, televisions, partying, or other commotion. The Park shall be the sole judge on what is “responsible quiet”.

2. The Home Owner, members of his Household, and Guests shall comply in every respect with the ordinances and laws of the town of Alton, State of New Hampshire, and the United States of America, including but not limited to, all regulations of the Health Office, Police Department, and Fire Department. The Park reserves the right to evict any one found guilty of not complying with any of the above mentioned laws and regulations.

3. The swimming pool is for Residents and their Guests only – the Park reserves the right to limit the number of Guests in the pool to allow all Residents full use of the pool. All children under 15 must be accompanied by a responsible adult. All swimming is at the Residents own risk. Home Owner, their Household, and/or their Guests agree not to hold the Park liable for any and all injuries. Please see additional pool rules and pool hours posted at the pool.

4. The Resident shall see that his children do not play in the street.

5. The Resident shall see that his children’s noise shall be kept under control at all times.

6. All lot boundaries must be respected at all times unless otherwise invited.

7. Bicycles shall be ridden on the roads in the park only during daylight hours.

8. Drinking in the privacy of one’s home is a personal matter, but drunken behavior, drinking in the streets, noise, shouting, fights, or similar behavior occasioned by the excessive use of alcohol shall be grounds for eviction. The Park shall be the sole judge of what constitutes excessive use of alcohol and/or unacceptable behavior.

9. This is a drug free community. Any buying, selling, and/or use of illegal drugs within the park shall be grounds for eviction of the Home Owner and the Household. The Home Owner is responsible for any Guests of their Household, even in this situation, and may be evicted for Guests conduct.

10. The Resident agrees that there shall be no swimming in the Merrymeeting River. The use of docks and waterfront is at the Resident’s and Guest’s own risk.

11. Fireworks, including sparklers, are not allowed in the park at any time.

Yard and Lawn Care

1. The Park will rake yards in the spring and fall, and mow lawns.

2. Trees, plants, and shrubs must not be trimmed, cut, or moved by the Resident. The Home Owner shall be liable for, but not limited to, the removal and replacement costs of damaged trees plus $200. Nails, ropes, etc., shall not be attached to the trees.

3. The Resident shall notify the Park of any tree that presents a hazard.

4. Any tree removal requested by the Resident may be considered. The request may be denied by the Park for any reason. If the request is granted, the tree will be removed by the Park or its contractor, and the Home Owner shall prepay for removal and clean up.

5. Lawns and yards must be kept free of litter and rubbish so as to present a neat appearance at all times.

6. Rubbish barrels must be kept in a shed. Plastic liners must be used for disposal of trash in the dumpster.

7. The Home Owner owns and is responsible for upkeep of their fuel/oil tanks. For health and safety reasons, any fuel oil spill must be reported to the Park immediately for a NHDES certified clean up. The Park will perform the clean up and/or call experts to do the clean up. The Home Owner is responsible for all costs associated with any and all clean up of petroleum products.

8. Replacement oil tanks shall be a new certified horizontal tank placed on a park-installed concrete slab at the Home Owner’s expense, connected by an oil company according to state regulations and park standards, and the location will be determined by the Park. Tanks may need to be enclosed, at the Park’s discretion. The Home Owner shall notify the Park prior to new tank installation.

9. Propane gas tanks connected to the home shall be installed by a gas company. Propane gas tanks less than 100# are not allowed for safety reasons.

10. Skirting must be installed on all homes and be commercially manufactured vinyl made specifically for skirting a manufactured home. The Park must approve the skirting before installation.

11. Fences are not allowed without Park permission.

12. Cable television is available in the park. Contact the cable company for information. Television antennas, satellite dishes, and CB radio antennas are not allowed.

13. Mailboxes are owned and maintained by the park only. Check with the office for availability and permission.

14. The Resident may not have a vegetable garden.

15. Woodstoves are not allowed in the park.

16. Trampolines, pools, swing sets, and play structures are not allowed in the park.

17. Clotheslines are not allowed without prior permission.

Park Standards

1. All home exteriors, porches, awnings, sheds, skirting, oil tanks, and other structures shall be kept clean, painted and in good repair at all times by the Home Owner. The Park shall be the sole judge of what constitutes attractive appearance.

2. Boxes, toys, bicycles, equipment, trash cans, shovels, brooms, tools, rakes, ladders, and all other matter shall be kept in a shed.

3. Sheds, decks, additions, etc., shall be painted to match the appearance of the home. Oil tanks shall be painted the same color as their background, so as not to be noticed, unless they are enclosed.

4. In the event that the Resident does not keep his lot in proper order as required by these rules, the Park may, 5 days after written warning, have all the necessary work performed on the lot to place it in proper order. All costs and expenses shall be billed to the Home Owner to be paid within 30 days, and shall be considered additional rent.

Building or Exterior Changes

1. Additions, porches, stairs, pitched roofs, sheds, screened rooms, and other additions must be commercially built to park building requirements. Written Park permission, followed by a Town of Alton building permit, must be secured before any construction begins or materials are delivered. Anyone planning to build shall submit a description of the proposed change, and the Park shall review such proposal with regard to surrounding structures, lot limitations, and other homes in the park. Building requirements for the park are available at the park office.

2. Any change to the exterior of the Resident’s home or any part of the lot must have prior written park approval. This includes, but is not limited to, painting, landscaping, plants and shrubs, paving, etc.

3. A screened room or screened porch is a living space, and, since they are visible to the public, shall not be used as a shed for storage (i.e. Motorcycles, toys, bicycles, etc.)

Park Water & Septic System

1. The Park shall be responsible for water from the well to the ground-level shut off under the home. Leaks that occur above the ground are the responsibility of the Resident and must be repaired immediately.

2. The above-ground water line must be electrically heat-taped, insulated and operable by October 15th of each year. The Home Owner is responsible to keep incoming water from freezing from frost level to the home – any damages to the park’s water lines, due to freezing, will be repaired by the Park at the Home Owner’s expense.

3. Underground leaks should be reported to the Park as soon as they are suspected.

4. The underground water shut-off shall be turned off and on only by the Park.

5. The Park shall be responsible for the septic pipe from the top of the ground to the tank. Running the water to keep pipes from freezing is not allowed, as it causes damage to septic pipes and septic systems. Any accumulation of ice in the septic pipe due to leaky or running faucets, toilets or other plumbing, or damage to the septic system, will be repaired at the Home Owner’s expense.

6. The above-ground septic pipes must be kept air and water tight by the Home Owner to prevent leakage.

7. The Home Owner shall be responsible for the costs of repair to the septic system where repairs are due to obstructions in pipes caused by Residents or their Guests, due to malfunctioning toilets or faucets which overburden the leach field, or if sanitary napkins, disposable diapers, hand towels, Kleenex, cigarette butts, or any other foreign objects are found in the septic tank. Table scraps, grease, cooking oils, coffee grounds, etc, should be put into plastic bags or containers and placed in the dumpster. The Home Owner shall be charged if any of the above articles are found to be the cause of any septic problems, or are found in the system when pumped – the minimum charge shall be equal to the cost of pumping the system. If you have a problem and you cannot get a serviceman, call the Park – this is most important.

8. Washing machines and dishwashing machines are allowed in year round homes.

9. Garbage disposals are not allowed in any home.

10. In-home water filtration systems or water softener systems are allowed provided they do not place additional water in the septic system. These systems must be properly maintained to the manufacturer’s specifications so as not to present any health risk to any Resident, Guest, or to the park water system.

11. The watering of lawns, washing of homes, and the occasional car washing is allowed, using minimal water. The Park reserves the right to limit or suspend these water uses if abuse or weather conditions warrant.

Trash

1. All trash shall be disposed of by the Resident immediately and not left on the deck or in the back of any vehicle. All trash placed in the dumpster shall be in plastic garbage bags. Please crush cartons.

2. Rugs, furniture, large cardboard boxes, heavy metal, wood or construction materials, tires, etc. are not allowed in the dumpster. Ask about proper disposal.

3. Leaves and raked up matter after spring clean up may be placed in a pile on the edge of the road for pick up by the Park. Any disposal of this matter behind one’s home may be cleaned up by the Park at the Home Owner’s expense.

Miscellaneous

1. The interpretation and application of all Park Rules, Regulations, and Standards shall be in the sound discretion of the Park Owner and Park Management.

2. The Park Owners and/or its management shall not be liable for damages claimed for personal injury, property damage, or other injury or damages suffered by Home Owners, Residents, their Guests, Invitees, or other third parties while on park property and use of park facilities is at the risk of the user thereof. The Home Owner/Residents/Guests agree to indemnify, defend and save and hold the Park Owners and its management harmless from and against any and all liability, damages, suits, actions, claims, costs and expenses, including reasonable attorney’s fees incurred with respect to any such claims of personal injury, property damage or other injury or damage.

The Park Owner and/or its management shall not be liable for any personal injury, property damage or other injury or damage due to a Homeowners’s/Resident’s failure to keep the lot in good condition and repair, nor for damages arising from, among other things, plumbing, gas, water, trees, septic, snow or ice upon the premises, nor for any neglect of other Homeowners/Residents or other occupants of the park. Home Owner agrees to carry a sufficient amount of property and liability insurance to provide for these contingencies and to provide written proof of insurance to the office yearly.

3. The Home Owner, Resident, and their Guests, shall save and hold harmless the Park Owner and/or its management from, but not limited to, any fires, lost or stolen property, storm damage, and acts of God, which result in personal injury and/or property damage claims to the Home Owner, Resident or his Guests.

4. Failure to comply with these Park Rules, Regulations, and Standards, after being given written notice of the failure to comply and a reasonable opportunity thereafter to comply, is grounds for eviction. All costs and expenses incurred by the Park Owner as a result of a breach of these Park Rules, Regulations, and Standards, including reasonable attorney’s fees, shall be paid by the Homeowner/Resident as additional rent. Payment shall be due within thirty (30) days of the date of written notice of the cost or expense.

5. The Park Owner’s consent to a Home Owner’s/Resident’s breach or violation of the Park Rules, Regulations, and Standards, whether written or oral, express or implied, shall not waive any other provision or covenant of the Park Rules, Regulations, and Standards or any subsequent or prior breach or violation of the same. The Park Owner’s acceptance of a rental payment with knowledge of a Homeowner’s/Resident’s breach or violation of the Park Rules, Regulations, and Standards shall not waive such breach or violation.

6. If any provision of these rules is declared to be invalid by a court of law, or it is changed by enactment of the legislature, or by local ordinances, state and federal statutes, rules and regulations, then all other provisions of these park rules shall remain valid and in force. Such contravention or invalidity shall not invalidate the entire agreement, but it shall be construed as if not containing the particular word, phrase, provision, or performance held to be invalid, and all other rights and obligations of the parties hereto shall be enforced accordingly.

7. All complaints to the Park Owner regarding the park owner, conduct of other Residents in the park, or the conduct of Guests, shall be submitted in writing and signed.

8. The Resident shall submit complaints against the Park Owner in writing, signed by the Resident, and mailed to 80 Heron Point Road, Alton NH 03809.

9. A copy of any added or changed rules, regulations, and standards superseding or supplementing the terms herein, will be furnished to all Residents at least (90) ninety days prior to the effective date of change.

10. These rules, regulations, and standards are effective on the date of a signed and park approved Resident application.

Privacy Policy

Merrymeeting River Mobile Home Park and Sales Inc recognizes that personal information collected by Merrymeeting should be used only for the purpose for which it is collected. Therefore, it is the policy of Merrymeeting that all information collected shall not be disclosed to other persons for any reason without the express written permission of the Resident(s)/ HomeOwner(s).

The September 30, 2013 Amendment to the:

“Merrymeeting River Mobile Home Park & Sales Inc.

Park Rules, Regulations and Standards of 2008”

Pursuant to the Notice Required by Law, to provide a 90 day notice of the change, the following Park Rule on Page 3 of “Merrymeeting River Mobile Home Park and Sales, Inc. Park Rules, Regulations and Standards of 2008” pertaining to “Rents, Fees, and Charges”, shall now read as follows:

1. Monthly Rents are due and payable in advance on the first day of the month.

2. Rents received in the office by 5:30 on the 7th day of the month due may earn a discount when the Home Owner, Resident, Household, Family Unit, Guest, Person, Residence and their Site meet all of the requirements and none of the above mentioned are in violation of and/or in non-compliance with any part, section or standard of the “Merrymeeting River Mobile Home Park & Sales Inc. Park Rules, Regulations and Standards of 2008”. Upon any written notice of any violation and/or non-compliance of the “Park Rules”, the Homeowner and/or the Residence shall immediately lose the ability to take a discount. No further discounts will be allowed until the violation has been fully corrected and all noticed issues have been brought back into compliance with the “Merrymeeting River Mobile Home Park and Sales Inc. Rules, Regulations and Standards 2008” as so amended. (This section pertains only to allowed discounts of rent and in no way supersedes nor negates any other remedies allowed to the Park for any violations and/or non-compliance of the “Merrymeeting River Mobile Home Park and Sales, Inc. Park Rules, Regulations and Standards of 2008” as amended.)

3. Rents received after the 15th day of the month will be assessed a service fee, and may be subject to eviction. The rent discount may not be taken if there are any outstanding bills due to the Park or any violation(s) and/or any non-compliance with the Park Rules. (See current rent letter for rents, fees and discounts.)

4. Rents may be paid at the office during office hours, or mailed to :

5. There will be a fee for each check that is returned, and the discount will not be allowed. A returned check will then be replaced by cash or money order.

6. A Home Owner and their Household may be evicted for non-payment of rent and/or for other violations of the park rules, regulations, and standards.

7. There is a non-refundable fee for processing the Residency Application. (See the current Residency Application package.)

8. The Park may require the Resident to pay a security deposit of one month’s rent upon acceptance into the Park for residency.

This amendment will become effective on January 1, 2014.
