BASIC WARRANTY ? 12 MONTHS 2,000 HOURS

Nissan For klift Corp oration, North Ame rica ("N FCNA") warr ants that each new N issan Ind ustrial T ruck shall be free, under normal use and maintenance, from defects in material or workmanship for the first 2,000 operating hours or for a period of twelve months from the date of first use by the original purchaser from an Authorized NFCNA Dealer, whichever occurs first.

POWERTRAIN WARRANTY ? 24 MONTHS 4,000 HOURS

For the first 4,000 operating hours or for a period of twenty-four months from the date of fi rst use by the original purchaser fro m an Authorized NFCNA D ealer, whichever occ urs first, NFCNA warra nts the following major components:

Internal Combustion Forklifts 1. Engine Cylinder head, block and all inter nal parts, oil pump, oil cooler, water pump, fuel pump, rocker cover, oil pan, intake and exhaust manifold, turbocharger, flywheel, seals and gaskets. 2. Transmission Case and all internal parts, clutc h cover and housing, torque co nverter and converter housing, t ransmiss ion contro l valve, s eals and gas kets. 3. Drive Axle (excluding brake assembly) Final drive housing and all interna l parts, seals and gaskets, axle tube ass embly and all internal drive components.

Electric Forklifts 1. Motor Traction motor (exc luding br ushes) 2. Traction Motor Controller and Components Controller assembly, including print boards, choppers and contactors (except contact tips) and accelerator controller. 3. Drive Axle (excluding brake assembly) Final drive housing a nd all internal parts, seals and gaskets, axle tube assembly and all internal drive components.

COVERAGE

During the specified warranty period, any defect in material or workmanship in any warranted item shall be repaired or replaced, at NFCNA's option, without charge by any Authorized NFCNA Dealer.

EXCLUSIONS AND LIMITATIONS

The warranties contained herein shall not apply to or inc lude any of the following:

1. Repair or replacement required as a result of: (i) accident; (ii) misuse or neglect; (iii) lack of reasonable and proper maintenance; (iv) repairs improperly performed or replacements improperly installed; (v) use of replacement parts or accessories not conforming to Nissan's specifications which adversely affect performance and/or durability; (vi) alterations or modifications not recommended or approved in writing by NFCNA; or (vii) deterioration of appearance/performance items due to normal use or exposure.

2. Normal replacement of service items (such as, but not limited to, tune-up parts, drive belts, bulbs, fuses, motor brushes and all filters).

3. Normal maintenance services (such as, but not limited to, e ngine tune-ups, fuel system cleaning, wheel alignment, brake and linkage adjustments and lubrications services).

4. Parts or accessories warranted by original manufacturer (such as, but not limited to t ires, batteries or hydraulic attachments).

5. Damage or failure caused to drivetrain compone nts resulting from failure of non-drivetrain components.

LIMITED REMEDY

1. The remedy under the warranties contained herein is limited solely to the repair of defects in material or workmanship by an Authorized NFCNA Dealer at its place of business or, at NFCNA's option, a t the pla ce where such Ind ustrial T ruck is ma intained, during c ustomary business hours. N FCNA will not be liable for incidental or consequential damages such as inconve nience or loss of us e of the N issan Ind ustrial T ruck to t he user, r esulting from breach of t he writte n warrant y or any imp lied warr anty.

2. THE WARRANTIES CON TAINED HEREIN ARE EXPR ESSLY IN LIEU OF ALL OTHER WARRANTI ES, EXPRESSED OR IMPLIED, INC LUDING ANY IMP LIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PUPOSE, AND OF ANY OTHER OBLIGATION OR LIABILITES ON THE PART O F THE MANUFACTURER AND DISTRIBUTORS OF NISSAN INDUSTRIAL TRUCKS, INCLUDEING EXPENSE, LOSS OR DAMAGE WHETHER DIRECT, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY, ARISING IN CONNECTION WITH THE SALE OR USE OF OR INABILITY TO USE THE NISSAN INDUSTRIAL TRUCK FOR ANY PURPOSE.

3. Some states prohibit exclusion or limitation of impl ied warra nty of merc hantabili ty or fitness for a particular purpose, and/or of incidental or consequential damages, so yo u may have addit ional rig hts.

No Authorized NFCNA Dealer is permitted or authorized to c hange, modify, or amend any term of the Limited Warranty.
