Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 2. Description of Action: The proposed action is for the brand name award of a firm-fixed-price delivery order under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) IV, Governmentwide Acquisition Contract (GWAC). No competition is expected as International Business Machines (IBM), the Original Equipment Manufacturer is the only provider of the brand name International Business Machines (IBM) maintenance and support. 3. Description of Supplies or Services: IBM Fraud and Abuse Management Software (FAMS) is currently installed in the Austin Information Technology Center environment where the Chief Business Office Purchased Care (CBOPC) Program Integrity Tolls (PIT) Platform resides. FAMS is used in conjunction with the existing PIT software application to identify and avoid improper medical claim payments. FAMS contains over 9000 fraud, waste and abuse detection algorithms. FAMS functionality analyzes data from the PIT data repository and profiles the billing behavior of all providers within each medical specialty (taxonomy) and identifies aberrant or fraudulent billing. A Program Integrity Specialist evaluates the FAMS data outputs against established provider profiles to identify fraudulent or improper billing. Required maintenance and support for the existing FAMS software includes 24X7X365 phone support and periodic IBM FAMS release updates to include functional enhancements and bug fixes. The period of performance for this action shall be 12 months from date of contract award. The total estimated price of this proposed action is 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is 41 U.S.C. 4106(c)(2) as implemented by Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B) entitled, “Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.”5. Rationale Supporting Use of Authority Cited Above: The proposed source for this action is IBM, 6710 Rockledge Drive, Bethesda, Maryland 20817. IBM FAMS is currently installed in the AITC environment where the CBOPC PIT resides. This action provides for continued use of the existing IBM FAMS perpetual license and maintenance support which is an integral part of the CBOPC PIT platform. No other vendor’s software is compatible with this pre-existing implementation. Due to the fact that IBM does not sell FAMS through a third party vendor/reseller, only IBM is capable of providing the FAMS perpetual license renewal and maintenance support. Acquisition of a different software product would require an entirely new platform, database and infrastructure which would result in approximately $250,000.00 in duplicative costs for customizing a new software package to meet the needs of VA and to monitor the new software. These costs would not be recovered through competition to implement a new software product. Due to the proprietary nature of this software, no other vendor other than IBM can access the proprietary code to provide the maintenance support required.6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. In accordance with FAR 16.505(a)(4)(iii)(A)(2) this Justification for an Exception to Fair Opportunity will be posted on the NASA SEWP IV website with the solicitation to all contract awardees. 7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government will continue to perform market research to determine if there are any other software products available that will enable future requirements to be competed.8. Market Research: The Government’s technical experts performed market research in January 2015 by contacting Grant Thornton, Emdeon, Booz Allen and Hamilton, Deloitte and General Dynamics Information Technology. Although other fraud waste and abuse billing detection software tools are available, such as Emdeon EDGE - Fraud, Waste and Abuse Protection Suite; Verisk Health - Fraud, Waste and Abuse Prevention; and Optum - Retrospective Fraud, Waste and Abuse Investigation, none of these products meet VA’s interoperability and compatibility requirements with the existing IBM-based PIT Platform without a substantial duplication of cost to VA. Based on the above, only IBM FAMS meets all of the Government’s requirements. Additional market research was conducted in March 2015 by the Contract Specialist utilizing the NASA SEWP IV GWAC Manufacturer Lookup tool that identified 35 prospective GWAC holders that are resellers of IBM products and services. However, it was subsequently confirmed that IBM only directly sells customers FAMS and the associated maintenance and support and not through resellers.9. Other Facts: None. ................
