REGULAR MEETING

OCTOBER 16, 2018

10:00 A.M.

A regular meeting of the North Wildwood City Council was held in the morning of the above date in the City Hall. The President of Council stated, “The meeting is now open. Adequate notice of this meeting has been provided by posting a copy of the revised notice of the time and place of this meeting on the City Clerk’s bulletin board and by mailing a copy of the same to The Herald, The Press and Wildwood Leader on January 3, 2018.”

ROLL CALL: Present were Mayor Patrick Rosenello, President of Council Salvatore Zampirri, Councilpersons Edwin Koehler, Margaret Bishop, David Del Conte, James Kane and Joseph Rullo. Councilwoman Kellyann Tolomeo was not present. Also present were City Administrator Kevin Yecco, Solicitor William Kaufmann and Engineer Ralph Petrella.

MINUTES: On a motion by Koehler, seconded by Kane, that the minutes of the regular meeting of October 2, 2018 be approved as read. Carried.

On a motion by Koehler, seconded by Bishop, the roll being called with all voting in the affirmative, the above permanent, full-time appointments were confirmed. Mayor Rosenello stated that the Public Works Department has six full-time vacancies; these appointments will four of the vacancies. Administrator Yecco confirmed that all four appointees are North Wildwood residents.

ORDINANCES:

ORDINANCE NO. 1762 - On a motion by Koehler, seconded by Kane, that Ordinance No. 1762 be placed on its second reading. Carried.

The City Clerk read Ordinance No. 1762 by its title, as required by Law, known as “An Ordinance Amending Ordinance 1078, As Amended And As Codified In Chapter 71, Article IV, Beach Patrol Pension Plan, Of The Code Of The City Of North Wildwood“.

This Ordinance has been published according to Law, posted on the City Clerk’s bulletin board with copies available in the City Clerk’s Office on request.

The President of Council stated this was the time and place to hold a public hearing on Ordinance No. 1762 and asked if anyone present had any objections to the passage of this Ordinance. Hearing none, he then asked the City Clerk if he had received any objections in writing, the City Clerk stated none, the President of Council declared the hearing closed.

On a motion by Koehler, seconded by Kane, that Ordinance No. 1762 be passed on its second reading and published according to Law, the roll being called, all voting in the affirmative, the President of Council declared Ordinance No. 1762 duly adopted.

ORDINANCE NO. 1763 - On a motion by Rullo, seconded by Koehler, that Ordinance No. 1763 be placed on its second reading. Carried.

The City Clerk read Ordinance No. 1763 by its title, as required by Law, known as “Refunding Bond Ordinance Of The City Of North Wildwood, In The County Of Cape May, New Jersey, Providing For The Refunding Of All Or A Portion Of Certain General Improvement Bonds Issued To The United States Department Of Agriculture, Appropriating $9,500,000 Therefor And Authorizing The Issuance By The City Of Refunding Bonds In The Aggregate Principal Amount Of Not Exceeding $9,500,000 For Financing The Cost Thereof“.

This Ordinance has been published according to Law, posted on the City Clerk’s bulletin board with copies available in the City Clerk’s Office on request.

On a motion by Koehler, seconded by Rullo, that Ordinance No. 1764 be passed on its first reading and published according to Law, the City Clerk called the roll, all voting in the affirmative, the President of Council declared Ordinance No. 1764 passed on its first reading.

CITY CLERK JETT stated that the Planning Board’s Re-Examination of the Master Plan, with its corresponding Public Hearing, will be held at a Special Meeting of the Planning Board on Tuesday, October 23, at 6:30 PM.

MAYOR ROSENELLO asked that everyone review the reports that were approved today, as they show how busy and dedicated the City’s workers are. The Police Department and Beach Patrol reports are particularly interesting.

PUBLIC:

JANET HEMPLE, 300 W. 15th Avenue, stated that the workers on the new bulkhead at W. 15th Avenue have done an excellent job. However, where the bulkhead extends to the private property, a fence was installed and the neighbor says that the City has given him that portion of the property. Is the new cement bulkhead his property or City property? When anyone goes near it the neighbor shouts that he will call the Police and sue anyone on his property. The Police came the other days with sirens and lights because my husband was standing near the bulkhead. These problems are on-going with the neighbor.

MAYOR ROSENELLO stated that numerous encroachments into the City right-of-way exist in the alleys and street ends on the west side. The City has vacated a number of streets and alleys where these encroachments exist due to the permanent decks and landscaping that have been built there. But at present the City has not vacated any portion of the street end at West 15th Avenue. These vacations are made on a case-by-case basis. A vacation is done by ordinance, so if a vacation there is considered in the future, there will be a public hearing. The City will communicate with Mrs. Hemple if an ordinance is forthcoming.

JANET HEMPLE stated that there are no visible encroachments at the property in question. There is a wood bulkhead on the property while the City’s new bulkhead is cement. There is no question where the property line is but they are claiming that part of the cement bulkhead is their property. They have left two old cars in the street, even during the bulkhead construction, although they have room on their private property for the cars.
