School BoardTeacher and Student HandbookRevised July2007Marmarth School District #12Statement of Non-DiscriminationYou are hereby notified that the Marmarth School District #12 does not discriminate on the basis of race, color, national origin, age, sex, or handicap in the educational programs or activities which it operates, and is required by title VI of the civil Rights Act of 1964, title IX of the Education Amendment of 1972 and Section 504 of the rehabilitation Act of 1973 of the Department of Health, Education and Welfare regulations not to discriminate in such a manner. This requirement not to discriminate extends to educational programs and activities, as well as to employment policies and practices.You are further notified that inquiries concerning the application of Title VI, Title IX, and section 504 may be referred to the Slope County Superintendent of Schools at Amidon, ND 58620, phone 701-879-6277, who has been designated as the person responsible for coordinating effects of the Marmarth School District to comply with and carry out its responsibilities under Title VI, Title XI, and Section 504, including any investigation of complaints alleging noncompliance. If complaint is not satisfied with the response from the designated coordinator and appeal may be made to the School Board which will consider the appeal at the next school board meeting.Each year the School Board will review the District’s compliance and will decide if further action is necessary.Positive DisciplineIt is the intention of this school board to provide fair and equitable policies to assure and effective, efficient working environment in which to provide its services. The responsibility for communicating and administrating work rules, job standards, and policies lies with the school board who are expected not only to know and understand the rules and policies and the reason for their existence but also to know and understand the need for developing and conducting orientation and re-orientation employees.Work rules and job standards are to be reasonable and fair to all employees. All employees must be informed of the existence of work rules and job standards pertinent to their respective areas of responsibilities at the time of hiring and periodically throughout their employment. Work rules and job standards must be administered consistently and uniformly for all employees.In the event that an employee does not adhere to established company work rules or demonstrates continued poor performance, the manner of discipline when necessary shall be of positive nature, unless gross misconduct occurs. Positive discipline provides a method for bringing problems to and employee’s attention in a way that reinforced the employee’s ability to work toward self-resolution of the problem. The ultimate objective for applying positive discipline is to correct any employee performance problems through education in the interest of retaining the employee within the organization at increased productivity.In cases where the employee is at risk of termination of employment and the school board suspects or has reason to suspect that the problem is related to chemical dependencies, marital or financial problems, parenting concerns, depression or any other external problem, the school board may require the employee to use the employee assistance program as a condition of continued employment. If the employee rejects the suggestion to use the employee assistance program, the school board may consider termination after all the steps in the positive procedure have been followed.Laws and Policies Relating to Teachers and StaffEach teacher must hold a valid North Dakota teaching certificate. To be valid, the certificate must be recorded in the office of the County Superintendent of Schools. The certificate should be shown to the business manager of the school board before the teacher receives any salary for the first month of teaching.Absence: According to the Century Code, teachers have 10 days sick leave per year due to sickness without loss of pay for the periods. Board will allow teachers’ sick leave for the doctor appointments and sickness in the immediate family. Any unused portion of permissible absences shall cumulate from year to year with a accumulation up to 45 days plus 5 personal day, not accumulative. The Marmarth School Board adopted a policy on teacher on teacher personal leave days stating that a teacher that used his/her five personal leave days before school is out may take and additional five days by submitting two sick days for each personal day taken per school calendar. This is limited to five additional personal leave days. (10-14-98)Alcohol and Drug Abuse Policy: the school has a clear responsibility to maintain an atmosphere which will promote a quality learning environment. The misuse of alcohol and other drugs by one employee may endanger the safety and will being of all other employees and all students. It is necessary that our employees be made aware of the danger inherent in making unwise choices about chemical uses. Further it is the responsibility of the school to interview whe n the school’s learning environment or employee’s ability to perform assigned duties is threatened.Therefore the school board supports the strict enforcement of the following alcohol and drug policy:The use, possession, distribution, dispensing or manufacture of alcohol or any illegal drug is prohibited in any building belonging to or used by the school district or on the grounds of any such building or on any property or in any vehicle belonging to the school district or at any school related activity.The district, school staff, students and parents will form a committee to oversee long range programs to bring about student and employee awareness and understanding of the dangers inherent in the use of alcohol, tobacco, and controlled drugs and to provide information about drugs and alcohol counseling and rehabilitation programs that are available to students and staff.Violation will result in more immediate action, which may include discharge, notifications of the federal agencies from which funds are received, and notification of proper authorities for prosecution. Due process procedures will be followed in any termination of employment.We recognize that chemical addiction is a treatable disease. Providing information. For referral or treatment when needed should be constructive and not a punitive action. Employees shall be allowed to use sick leave, to the extent accumulated, for chemical addiction treatment if undertaken at a facility approved by the division of Alcohol and Drug abuse of the North Dakota Department of Health. However, no employee shall be granted sick leave for inpatient treatment of alcoholism or chemical dependency more than twice.The district will attempt to provide a supportive school environment got students and staff who have been harmfully involved with drugs and alcohol, including those whose families are disrupted by chemical abuse.This policy will be distributed to each employee and to each new employee at time of employment. Documentation of employee receipt of this information shall be kept on file by the business manager. (Adopted 9-14-94, Amended 10-8-97)Care of Room: Each teacher shall be responsible for keeping their own room neat and orderly after each day. Each teacher is responsible for organizing and removing any items from the floor, heat registers, and book shelves before receiving their final pay check.Cleaning and Sanitization Recommendations:Custodians dealing with human secretions and excretions: Secretions and excretions include: blood, breast milk, feces, salvia, semen, sweat, tears, urine, and vomit. Several steps to prevent transmission of infectious agents (protozoa, pneumonia, athlete’s foot, cytomegalovirus, hepatitis B, AIDS) when dealing with the secretions and excretions listed above include:Wear rubber glovesClean (wipe, mop, scoop, absorb, etc.) up the secretion/excretion with disposable paper towels or rags.Disinfect (sanitize) the surface soiled using germicides labeled as mycobactericidal at the indicated dilutions: if the surface is cleanable by household bleach, use 1 to 10 (10percent) to 1 to 100 (1 percent) solution; for surfaces which would be ruined by bleach (i.e carpet) use an agent labeled as mycobactericidal that will not ruin the surface; in addition, a hot shampoo treatment and drying are recommended after the mycobactericidal treatment.Using double plastic bags, contain, transport, and dispose of the cleaning materials and secretions/excretions involved per standard guidelines for garbage disposal.At the conclusion of the cleaning and disinfection process, even though gloves were worn, wash hands thoroughly using soap, water and vigorous rubbing for at least 15 to 30 seconds; dry hands with paper towel and use paper towel to shut off the water supply.Following these guidelines will effectively reduce the transmission of infectious agents and inhibit the subsequent development of disease when dealing with secretions/excretions in the home, school or work environment. (Recommendations from the North Dakota State Department of Health, 1986)Teachers and other Primary Non-Custodial School Staff: to assist in preventing significant infectious diseases, following guidelines have been developed:If you are involved in cleaning up secretions/excretions (see list above) follow the suggestions outlined in the ‘Custodial Recommendations”. The most significant factor in preventing spread of pathogens (bacterial, viral, et.) in routine school settings is through hand washing after urinating or defecating, before eating, and after cleaning one’s nose.The recommended hand washing procedures are as follows:Turn on the water supply, wet hands and apply soap.Rub hands briskly together, paying particular attention to finger nails and tips for at least 15 to 30 seconds; then rinse.Dry hands with paper towels and use the paper towels to turn off the water supply. If you have knee or elbow operated water faucets (as in some newer facilities). Use your knee or elbow, wrist or back of hand to turn off water supply.(Recommended by the North Dakota Department of Health 1986)Conferences: Teachers are required to have one parent teacher conference in the fall and one in the spring.Dismissal: teachers and pupils in violation of our drug, alcohol, and tobacco policies are subject to dismissal.Fire Drills: Teachers shall have a fire drill once per month.Flag: The United States flag must be displayed in seasonable weather during the school hours on each school day. The Pledge of Allegiance to the flag shall be recited each morning before beginning the day’s studies.Grading Procedures: Teachers are to follow the grading scale set forth by the School Board. The scale is as follows;A(94-100) Work is superior, above requirementsB(88-93) Work meets requirements, very well doneC(80-87) Work meets requirements, satisfactoryD(74-79) Work is not satisfactory, but passingF(0-73) Work is not acceptable and or incompleteFor grades 3rd-8th teachers must send home grades every two weeks. Grades sheets must go home every other Friday for all students in 3rd-8th grade.If a student has a D or below they are to receive a grade report every Friday. This report must be mailed home by 10:00am Friday morning and must be signed and returned to school on Monday. This will continue until the student’s grade is a C or better.If a student has an F in any subject for 3 consecutive weeks a parent/teacher conference must be scheduled to try and improve the student’s grade.All assignments MUST be graded and passed pack the following day. This gives the teacher a chance to re-teach any subject area the next day and students to correct assignments.It is the teacher’s responsibility to make sure all papers are passed back. If the teacher assigns a student to do this job the teacher must make sure the job is done every day before any student can go home.Grievance Procedure: The purpose of this procedure is to secure, at the lowest possible administrative level, equitable solutions to grievances which may from time to time arise. Both parties agree that these proceedings shall be kept as informal and confidential as may be appropriate at any level of the procedure.Procedure: Since it is important that grievances be processed as rapidly as possible, the number of days indicated at each level should be kept to a minimum and every effort should be made to expedite the process. The time limit specified may, however be extended by mutual agreement. In the event that a grievance is filled on or after April 1st which, if left unresolved until the beginning of the following school year, could result in irreparable harm to the party of interest, the time limits set forth herein shall be reduced to one-half rounded to the nearest day so that the grievance procedure may be complete prior to the end of the school year or as soon thereafter as is possible.Grievance Steps:Level One: A grievance shall be first discussed with the immediate supervisor of an employee as may be appropriate with the intent of resolving the matter informally. However, before an aggrieved employee can move to Level Two, he/she must first submit to the immediate supervisor a written statement. The immediate supervisor shall have a period of not less than 5 working days during which to hold a conference with the grievant. Following the conference, but not later than 5 working days from the date of the filing of the grievance, the immediate supervisor shall tender a written response to the grievantLevel Two: If the grievance is not satisfactory resolved at Level One, within 5 working days after the grievant filed a written grievance, the grievant may submit the written grievance to the County Superintendent of Schools. The County Superintendent or designee shall schedule and hold a conference relative to such grievance within 10 working days of receipt of such grievance. Within 5 working days of such meeting, the County Superintendent or designee shall communicate in writing to the grievant. Should the immediate supervisor be the County Superintendent, this level would be omitted and Level Three would be moved into place.Level Three: If the grievance is not satisfactorily resolved at Level Two (or at Level One if the immediate supervisor is the County Superintendent) within 10 working days after the grievance was filed at Level Two (5 in the noted exception), the grievant may submit the written grievance to the School Board. The School Board shall schedule and hold a conference relative to such grievance within 10 working days of receipt of such grievance. Within 5 working days of such meeting, the School Board shall communicate in writing a decision of the grievance.Rights and Representation: No reprisals of any kind shall be taken by either party or by any member thereof against a party of interest, or any other participant in the grievance procedure by reason of such participation. Any party of interest may be represented at all states of this procedure by a person(s) of his/her choosing.Miscellaneous: If a grievance affects a group or class of employees, it may submit such grievance to commence at Level Three (or at Level Two should the immediate supervisor be the County Superintendent). All documents, communications, and records dealing with the process of a grievance shall be filed separately from the personnel file of the participants.The grievant shall be informed at least 10 working days in advance of any scheduled meeting herein, but may agree to waive such time consideration to expedite the meeting at any earlier date.Should an employee or his/her representative(s) be required by the employer’s scheduling to be absent from regular assignment for the execution of this grievance procedure, he/she shall be released without loss of pay or benefits.All written communications required herein shall be served personally or by certified U.S. Mail.Homework: if parents believe students are receiving excessive homework, a meeting of parent, teacher, and school board will follow to determine how much after school time the teacher should spend with that students to reduce the homework to an acceptable level.Hours of Duty: Teachers shall be at the school half hour before school starts and half hour after school ends with the exception of before a holiday at which time they may leave after all the students have left the school.Instruction to Students: Teachers must provide instruction to pupils who are sufficiently advances to purse the subject of: reading, spelling, math, language, English, grammar, geography, United States History, civil government, nature study and elements of agriculture, physiology and hygiene also shall be taught and other subjects as may be required by the Department of Public Instruction. Sequential programs shall be followed in each subject. Texts shall be kept up-to-date as required by the Department of Public Instruction.Inventories: Teachers are required to submit an inventory of books, equipment and needs at the end of the school year. Inventory forms are sent to the County Superintendent. Please site repair work and special requests in inventory for School Board approval for ensuing school year.Lesson Plans: Teachers will make weekly lesson plans. They will be completed by school session time at the beginning of the week. A copy will be filed weekly with the County Superintendent. These plans should be available for review by any board member during the school session time.Pay Checks: Teachers will be paid on the second Thursday of each month.Payroll Deductions: Deductions from the teacher’s salary shall be made for such required purposes as Teacher’s retirement, Income tax withholdings, and social security.Purchase Orders: The School Board will provide for all necessary supplies and equipment for the proper instruction of all required subjects. PLEASE HAVE ANY PURCHASES APPROVED BY THE BOARD PRIOR TO ORDERING. The teachers are responsible for ordering all books and supplies for their classrooms and SUBMIT THE PACKING SLIP TO THE BUSSINESS MANAGER. The teacher is responsible for stamping any books that are not consumable which will be provided by the school board. Student Handbook: Teachers are responsible to see that a handbook is sent home with each student at the beginning of the school year. Teachers must also review the handbook with their class on the first day of school. The last page of the handbook must be signed by the parent and brought back to school and kept on file.Student Services Written Program: Services to be provided students will be determined on a individual basis. Counseling will be provided primarily be the classroom teacher with assistance of parents and the County Superintendent of Schools. Should further assistance be needed, it is available upon request to the Southwest Multi County District Special Education Unit where a school psychologist will be notified and will arrange to consult with all concerned. Time required will vary with each case.Family and staff consultation is also available on a individual basis. Teachers will consult with parents and County Superintendent wherever necessary. At least 2 parent/teacher conferences are scheduled each year. Southwest special education unit will be available for consultation and Badlands human Services is also available through the Unit. Should special services be necessary, adequate time will be allowed to provide them. Badlands Services will provide needed personnel through a contract with the Special Ed. Unit of which the school is a part.Diagnostic and prescriptive services are provided mainly by a learning disabilities teacher. Should a student be having problems with any subject, the teacher will notify the County Superintendent who will contact the LD teacher for testing in that area or in any area thought necessary. If testing indicates the need for assistance, the LD teacher will arrange the needed time for such work. Should other types of difficulties-speech or hearing or vision- be discovered by the classroom teacher or other personnel working with students, the County Superintendent will be notified to request additional types of diagnostic or prescriptive services. If severe learning difficulties are encountered, the Special Ed Unit will again be involved to provide these further detailed types of testing. These steps will first be discussed with the parents to determine need and to gain permission for such testing. Time will be allowed as needed for each individual problem.Health services are provided by the County Health Nurse whenever necessary. Teachers may administer minor first aid and will call the parents in case of illness or accident. In case of emergency, teachers will call parents and an ambulance. Should the injury be such that waiting for an ambulance or parents to arrive would further endanger the student, the teacher amy transport said student towards the hospital while another teacher notifies the ambulance and parents of such action. The County health Nurse also conducts health screenings for scoliosis, blood pressure, vision, hearing, etc. on an annual schedule and will come to the school when requested or when possible contagious diseases are discovered.Any of the above services are to be coordinated by the County Superintendent of Schools and/or the Director of the Southwest Multi District Special Ed Unit. Minimum time allowed for any services will be based on necessity and on the recommendations listed in the Administrative Manual according to enrollment.Substitute Teachers: Must be certified in North Dakota and approved by the School Board.Supervision: It is MANDATORY that the playground be supervised at ALL times at recess and during the lunch hour. Unnecessary rough play will not be tolerated. The full-time teachers shall be responsible for all recess times. The teacher on recess duty shall be solely in charge. At the end of each recess all equipment shall be brought into the school and put away. Teachers are responsible for storing all equipment in the school at the close of the school year.Teachers Evaluations: Teachers are to be evaluated twice a year. One evaluation is to be prearranged. For the evaluation that is prearranged the Teacher must fill out the Pre Observation Form prior to the arranged evaluation. The teacher evaluation forms must be filed out by both the teacher and the County Superintendent. After the evaluation the County Superintendent and the teacher must meet and have a conference over all information. A plan is to be agreed upon by both for all areas that need work. These areas will be reevaluated at a later date. After the conference the evaluation must be signed by both partied and then a copy is to be given to the teacher, the School Board and one copy is to be filed in the teachers personnel file.Teacher register: All teachers are required by law to keep a teacher’s register of such forms as required by State Superintendent of Schools on forms provide by that official. A final report being made in triplicate with two copies going to the County Superintendent who forwards one to the State and the third copy to the business manager of the school district before the said manager issues the salary check for the last month of the school to the teacher.Teacher Preparation: Teachers are expected to attend the annual in-service workshop called by the County Superintendent.Teacher Professional Preparation and Growth Policy: Teachers in Slope County elementary schools are required to hold a North Dakota Educator’s Professional Certificate in accordance with NDCC 15-36-11. Teacher’s certificates are valid only when they have been recorded in the office of the Slope County Superintendent of Schools as stated in NDCC 15-36-10 and must be exhibited to the school district business manager prior to receiving any salary for the first month taught. If the certificate expires within six weeks of the end of the school term, the teacher may finish the term without renewal or reexamination thereof according to NDCC 15-36-12.Teachers shall have preparation appropriate for their grade levels as stated in NDCC 15-45-02 for kindergarten, NDCC 15-47-46 for self-contained classroom in grades 1-8 or for special classes such as art, music, physical education, computer education, and foreign languages. Teachers providing separate subject classes for keyboarding, North Dakota Studies, and health shall have completed courses or workshops in those areas. Remedial/basic skills teachers shall have the REO1 reading credential or have completed the 20 semester hours of course work required within two years of assuming those duties. All certified professional staff is required to obtain a minimum of 4 semester/6 quarter hours of college credit each five years. Any teacher holding a First Grade Life Certificate is required to participate in 64 clock hours of in service training during each five year period established by date of initial contract. A college credit of 1 semester hour may substitute for each 16 clock hours of in service.All appropriate records of hours earned and in service credits shall be reported to and maintained by the school board business manager and are a part of the teacher’s personnel file. All records shall be reviewed and updated annually prior to the fall starting date of school. Records must be submitted to the business manager by the August meeting of the school board. Teachers will be expected to attend a day of in service in the fall with the County Superintendent of School.Telephone calls: Long distance telephone calls made by the teacher for personal reasons shall be paid for by the teacher.
