That I am the of , and that said entity is the Grantor/Mortgagor of real property located at .
There are presently tenants in said premises. Each of said tenants either (a) is in possession under a lease containing a standard subordination clause subordinating said lease to all existing and future mortgages, or (b) is a statutory tenant. No tenant has any option to purchase or right of first refusal granted to it nor any recorded conveyance. There are no other persons or parties in possession other than as aforesaid.
There are no street vaults under or adjoining said premises.
No work has been done upon the above premises by NYC nor has any demand been made by NYC for any such work that may result in charges and/or liens by the following: The NYC Dept. of Rent and Housing Maintenance Emergency Services; The NYC Dept. of Environmental Protection for water tap closings or any related work; The NYC Dept. of Health; or the New York City Dept. of Buildings.
The entity has not been known by any other name for the past ten years, except .
There are no judgments (including Environmental Control Board Judgments) filed against the entity in any court of this state or any state.
There are no federal or state tax claims, warrants or liens assessed or filed against the entity in this or any other state. All NYS Franchise Tax Reports and taxes have been filed and paid to date. All NYC Business Corporation Taxes have been paid to date.
That no proceeding in bankruptcy has ever been instituted by or against the corporation in any court or before any officer of any state or of the United States, nor has it at any time made an assignment for the benefit of creditors, nor any assignment, now in effect, of the rents and leases of said premises or any part thereof.
That I have carefully examined the judgments, liens, federal tax liens, state tax warrants, and parking violation listed in Exception(s) No.(s) in the above mentioned report, and state that they are not against but rather against entities of the same or similar name. has never done business at nor had a motor vehicle register at the addresses shown.
That the corporation is the same entity as the grantee in a deed recorded in Liber/Reel Page .
The corporation has received no notice to install or repair sidewalks/curbs on premises.
That I know of no other mortgages which will affect the premises that is not disclosed in the above referenced title report and I have not executed any other instrument which will affect the premises that is not disclosed by the above referenced title report.
That this affidavit is made to induce Riverside Abstract LLC as agent for Title Insurance Company to issue its policy of title insurance covering the above premises, free and clear of the aforesaid, knowing that it will rely upon the statements herein made.
