INTRODUCTION

This emergency plan is meant to be in compliance with OSHA 29 CFR 1910.120(q).

□ “An emergency response plan shall be developed and implemented to handle anticipated emergencies prior to the commencement of emergency response operations. The plan shall be in writing and available for inspection and copying by employees, their representatives and OSHA personnel."

□ Each section of this plan is indexed to 1910.120(q) 2, "Elements of an Emergency Response Plan", and contains basic information required for each element, or else provides the appropriate reference to such information.

This plan is written to be in compliance with the National Incident Management System (NIMS) as prescribed by the Federal Department of Homeland Security (DHS) for 2007.

The purpose of this emergency pre-plan is to provide procedures and guidelines for fire fighting activities and related security, traffic control and first aid for any petroleum related fire incident located at the petroleum terminals within the City of Rensselaer or Town of East Greenbush.

The plan represents the joint efforts of the City of Rensselaer Fire Department and Fire District No. 3 of the Town of East Greenbush, with assistance from the Rensselaer County Bureau of Public Safety and these guidelines will be used in both the City and Town.

This plan is not intended to provide specific apparatus placement and/or assignment for each of the petroleum terminals, nor provide guidance for non-petroleum related incidents. The Incident Commander upon size-up and assessment will make such decisions.

PRE-EMERGENCY PLANNING AND COORDINATION (1910.120(q) 2 i)

The Town of East Greenbush and City of Rensselaer Fire Departments will determine which apparatus and mutual aid Fire and EMS Departments will be mobilized in the event of an incident at a petroleum facility in the Port of Rensselaer. They will determine available water and foam resources, and establish which lines of communication will be used. Provisions will be made to establish an incident command structure, and to insure the safety of emergency personnel and civilians.

A realistic “worst case” incident at the Port of Rensselaer is believed to be a tank fire involving a 242,000 barrel gasoline storage tank where the gasoline escapes into the secondary containment. The worst time of year for this incident is believed to be winter, with temperatures of 0 to -10 0F and a South wind at 10 to 20 mph.

This plan will be part of the Rensselaer County Fire Mutual Aid plan, and will be in agreement with the provisions of that plan.

Copies of this plan will be provided to the appropriate Fire, EMS, and Police Departments, Port of Rensselaer Petroleum and Chemical Facilities, Rensselaer County, the New York State Office of Fire Prevention and Control, and the US Coast Guard, and the Albany Port Commission.

LINE OF AUTHORITY AND PERSONNEL ROLES (1910.120(q) 2 ii, v, viii)

INCIDENT COMMAND

The Chief Officer for the Fire Department where the fire is located will establish a command post in proximity to the fire scene. The Chief Officer will serve as Incident Commander and will implement the Incident Command System (ICS) and the National Incident Management System (NIMS).

The command post will coordinate all activities at the fire scene including:

Fire apparatus

Water supply

Foam supply

Ambulances

Communications

Terminal personnel

Media

County Public Safety personnel

Coast Guard Representative

Law Enforcement

EnCon Representative

Local Government Representative

Races (Radio Amateur Civil Emergency Service)

TRAFFIC CONTROL COORDINATION

The ranking Fire Police Officer for the Fire Department where the fire is located shall be the TRAFFIC CONTROL COORDINATOR, until the Incident Commander assigns a Sector/Division Officer to that position.

The Traffic Control Coordinator assisted by local police, shall be responsible for the following:

Coordination and control of the ingress and egress of all traffic including all responding fire

apparatus, ambulances, foam supplies, press vehicles and spectators.

Coordination of all arriving emergency vehicles with the Command

Post at the fire scene.

Restriction of traffic to fire vehicles, ambulances, etc. as requested by the

Command Post.

Only emergency vehicles requested will be allowed into the fire area.

Once the traffic control points are established, no fireman will be

permitted to enter the fire area with his personal vehicle.

Verification that notification of Amtrak and requests that trains be slowed or delayed have

been made by Command.

Coordination with local police of all fire police on duty at the scene.

Establishment and coordination of traffic control points on Riverside Avenue at

Irwin Stewart Parkway, 9J at American Oil Road.

Verification that Command has established staging areas for responding emergency

vehicles on 9J, Port Road and/or on Riverside Avenue between the petroleum

facilities and the BASF plant. Coordinates the staging of vehicles as required.

Coordination of members of the Rensselaer County RACES unit and radio

communication between traffic control points and staging areas.

□ Establishment of a Control Point and coordination of Accountability procedures for arriving personnel with support from the Safety Officer.

EMERGENCY MEDICAL SERVICES

The Ambulance Squad which provides emergency medical service to the terminal involved in the fire incident will be responsible for coordinating emergency medical services. The Chief Officer of this company will serve as EMS Command.

The ranking officer of the Ambulance Squad will respond with a minimum of one (1) ambulance vehicle with appropriate staff to the fire scene.

All additional responding ambulances, including mutual aid response will respond to and remain in the staging area.

The Ambulance Chief Officer and the County Ambulance Coordinator will respond to the Command Post.

No additional ambulance or rescue squad will respond to the fire scene unless authorized by EMS Command.

SAFETY

The Incident Commander will designate a Safety Officer.

The Safety Officer will be responsible for evaluating all emergency operations to insure that they are conducted in a safe manner. Responsibilities of the Safety Officer include (but are not limited to):

□ Coordinating Accountability with the Fire Police

□ Requiring personnel to perform only duties for which they are trained.

□ Requiring personnel to wear appropriate protective clothing.

□ Preventing the unsafe deployment of apparatus and personnel.

□ Monitoring personnel for signs of fatigue or illness.

The Safety Officer will have the authority to halt any unsafe operation and so advise the Incident Commander.

ACTIVATION OF THE PLAN (1910.120(q)2 iii, ix)

It is desired that all emergencies at Port of Rensselaer petroleum facilities be reported to emergency services by telephoning 911. The caller should describe the nature of the emergency as clearly as possible. If the emergency is a fire, the responsible Fire Company and Ambulance Squad will be dispatched immediately according to established procedures.

The responsible Fire Company shall request additional notifications as follows:

□ Mutual Aid as designated for each alarm.

□ EMS Zone and Fire Battalion Coordinators.

□ N.Y.S. Dept of Environmental Conservation in the event of a spill of petroleum product.

□ United States Coast Guard in the event of a spill in the Hudson River or a tributary.

INCIDENT CLASSIFICATIONS (1910.120(q) 2 i, ii, ix)

ALARM DESIGNATIONS

The Alarm Designations and mutual aid response included in this plan will be used for fire incidents at the petroleum terminals located in City of Rensselaer Town of and East Greenbush.

22. 1st Alarm Incidents:

Response to the 1st alarm fire and emergency incidents will be initially limited to the

company providing primary fire protection.

23. 2nd Alarm Incidents:

Automatic Mutual Aid will be called as indicated for the following terminal incidents:

1. Major structure fires

2. All tanker fires

3. All rack fires with exposures

4. All storage tank and pipeline fires

24. 3rd Alarm Incidents:

3rd alarm incident requiring extensive emergency resources

25. 4th Alarm Incidents:

Major tank involvement requiring significant supplies of foam

Apparatus Assignments for each alarm are provided in ATTACHMENT ONE.

SCENE MANAGEMENT (1910.120(q) 2 ii, iv, v)

A. The Incident Commander will implement all aspects of the Incident Command System.

1. A command post shall be established. This command post shall include necessary radio communications equipment, and where appropriate, telephone and data transmission capabilities.

2. The command post shall be located at a safe distance from the incident. This distance shall be determined by the nature of the incident, including type of petroleum product, quantity involved, and weather conditions.

3. All appropriate personnel shall be advised of the command location.

4. A Safety Officer shall be appointed by the Incident Commander, except in very minor incidents, where the Incident Commander may act as the Safety Officer

5. A Public Information Officer (PIO) shall be appointed, except for very minor incidents, where the Incident Commander may act as the PIO.

B. A "safe" zone shall be established in cooperation with responding police agencies. This safe zone will include a place of refuge to which emergency personnel can retreat in the event that control of the incident is lost.

C. Fire ground communications shall be conducted according to the following procedures.

1. At the discretion of the Incident Commander, all Fire Ground Communications will be on the Rensselaer County 800MHz system.

2. All communications between the command post and Rensselaer County Fire

Control will be on Rensselaer County 800MHz system 12-10.

3. All communications between command post and East Greenbush Fire Control on 12-1.

4. All Marine communications will be on Channel 16 (calling; 156.800 MHz), and Channel 21

(Working; 157.050 MHz)

5. All requests for mutual aid and other assistance shall be made directly to

Rensselaer County Fire Control from the Fire Ground Command Post. Only the Officer in

Charge or his designee will make the call for mutual aid.

6. Mutual aid and/or assistance not specifically requested by the command post will

not be allowed access to the scene.

7. All Rensselaer County fire apparatus responding to the scene shall use Rensselaer County 800MHz system until arriving at the fire scene or staging area.

FIRST RESPONDER ACTIONS (1910.120(q) 2 iii, vii, x, xi, xii)

A. All responders shall wear full structural fire fighting protective clothing,

including positive pressure SCBA as necessary. Decontamination, if required will be performed

by trained personnel, following generally recognized procedures.

B. Involved substances shall be identified as soon as possible using generally accepted methods.

1. Placards

2. Labels

3. Verbal information

4. Shipping documents

5. Appearance of the material

6. Reference materials or agencies

C. Strategic objectives shall be:

1. Life safety

2. Rescue

3. Fire suppression

4. Environmental protection control

D. Incident termination

1. Fire Department(s) involvement shall end when danger to the public has been eliminated.

2. Scene restoration is the responsibility of the carrier or owner of the

product(s) involved.

3. A post incident critique will be held as soon as practical to evaluate the

response to the incident and make recommendations with regard to additional

planning, training and/or equipment.

EVACUATION AND PLACES OF REFUGE (1910.120(q) 2 vi)

In the event that the evacuation of residents of the area surrounding the emergency scene is necessary, the Incident Commander will issue the evacuation order unless a State of Emergency has been declared, in which case the Local Chief Executive shall issue the order.

Areas to be evacuated will be determined based on the best technical information available to Incident Command.

In-place sheltering shall be evaluated as an alternative to evacuation. If implemented, the public will be advised to close all windows and doors, and shut off all ventilating equipment. The Rensselaer County Emergency Alert System (EAS) program shall be considered for this assignment.

If necessary, additional notification to the public will be made using radio and television broadcasts, mobile public address systems, and door to door canvassing as appropriate.

Evacuation routes shall be selected to avoid exposure to products of combustion or other hazardous materials. Shelters shall be selected which are sufficiently removed from the incident to insure the safety of the evacuees.

In the event that large numbers of individuals must be evacuated, the operation of shelters shall be the responsibility of the American Red Cross and the Rensselaer County Civilian Emergency Response Program (CERP).

TRAINING (1910.120(q)2 ii)

Training shall be based upon the duties and functions to be performed by each responder. If a response involves hazardous materials, personnel will be trained according to the following response levels as set forth in OSHA 1910.120.

□ First responder awareness

□ First responder operations level

□ Hazardous materials technician

□ Hazardous materials specialist

□ On scene incident commander

This training will be administered on an on going basis including but not limited to the following; in house, NYS Office of Fire Prevention and Control. industry, seminars, and any other generally accepted training or work related assignments meeting the competency and skills required to perform the task.

RESOURCES

WATER SUPPLIES

The fire protection at the Port will rely on water from the following four (4) sources:

□ Public Water System fire hydrants

□ Petroleum Fuel and Terminal (Apex) dry hydrant

□ Gold Bond water tank and hydrants

□ Drafting from the Hudson River

The specific water supply plan for each terminal will depend on its location and the specific fire ground decisions made by the Incident Commander. See ATTACHMENT TWO for details on water supplies for each facility.

FOAM SUPPLIES

All foam used for fire fighting purposes at the Rensselaer/East Greenbush petroleum terminals will be A.F.F.F. – 3%-6%, AFFF/ARC – 3%-6%, or a compatible foam product.

Specific details on available foam supplies are provided in ATTACHMENT THREE.

All foam used from the Port Foam Bank must be used in accordance with the Port of Rensselaer Fire Protection Agreement contained in ATTACHMENT SIX of this Plan.

The Fire Department responsible for the fire incident shall acquire foam as needed from the Port Foam Bank.

FIRE PROTECTION AGREEMENT

in the development and maintenance of a Central Foam Stockpile to be used generally to provide for the fire protection of facilities and tankers at, and from, the Port of Rensselaer.

This agreement is subject to the following conditions and terms:

1. Each participating company shall provide a supply of A.F.F.F. 3%-6% foam equal at a value of $1000 for the initial stocking of the Foam Bank.

2. The foam shall be stockpiled and stored in a central location mutually acceptable to all participating companies and accessible to both the East Greenbush and Rensselaer Fire Departments.

3. The foam may be used for the fire protection of any facility or tanker owned and/or filled by participating members.

4. The foam may be used at non-participating facilities or facilities outside the Port of Rensselaer subject to the approval of the Chief of either the East Greenbush or Rensselaer fire departments.

5. All foam used in the actual fire protection of any facility or the company responsible for the facility or tanker requiring the foam shall replenish the Foam Bank immediately.

6. The Chiefs of the East Greenbush and Rensselaer Fire Departments will have joint responsibilities for maintaining and supervising the Foam Bank and for the development of procedures to provide for access to the foam as necessary.
