Individuals enrolled in the “Ohio State exam Reviewcourse” are purchasing the professional knowledge of the instructor to assist the student to prepare for the Ohio state laws and rules exam.

The course is a 5-week intensive self-study test preparation program designed to provide the student a unique personalized and structured learning environment where progress is monitored by the instructor through email to help students maintain focus and complete scheduled assignments timely. The student and instructor can negotiate additional instruction time and fees if necessary.

THE INSTRUCTOR MAKES NO EXPRESS OR IMPLIED WARRANTY OR REPRESENTATION OF ANY KIND THAT COMPLETION OF THIS OR ANY LICENSURE PREPARATION COURSE OFFERED BY INSTRUCTOR WILL GUARANTEE A PASSING SCORE ON ANY LICENSING EXAM.

An individual’s ultimate success in passing the licensure exam is dependent on an individual’s professional experience, academic preparation, and the time and energy the individual can commit to exam study and preparation.

A student’s work schedule or other commitments may require more time to prepare for an exam than allotted. The student is solely responsible for licensing exam registration/testing and retesting fees.

NHA LICENSURE

| 1 |DEFINITIONS |

| | |

| |“Board” means the Board Of Examiners Of Nursing Home Administrators |

| |“Department” means the Ohio Department of Health |

| |“Operator” means the person, firm, partnership, association, or corporation required to obtain a license to operate a nursing home. |

| 2 |ADMINISTRATOR HOURS |

| | |

| |The administrator must be physically present in the facility no less than 16 hours per week |

| |The majority of the 16 hours must be between 6 AM and 6 PM during the normal work week |

| |3. “Full time” for the administrator means a 35 hour week |

| 3 |TEMPORARY LICENSE |

| | |

| |The temporary license issued for a maximum of 180 days |

| |The temporary license is to temporarily fill the position of a nursing home administrator vacated by reason of death, illness or such |

| |other cause |

| 4 |LICENSE APPLICATION SUBMITTED TO THE BAORD |

| | |

| |Must submit the application for NHA licensure to the Ohio Board of Examiners of Nursing Home administrators |

| 5 |PRECEPTOR |

| | |

| |“Preceptor” means the licensed nursing home administrator approved by the board to supervise the practical training and experience of |

| |the administrator-in training (AIT) during the period of an internship. |

| |A preceptor may not train his or her employer or supervisor. |

| 6 |INTERNSHIP |

| | |

| |Internship” means the period of practical training and experience, approved by the board, required of the nursing home |

| |administrator-in-training as a condition precedent to admission to examination for licensure as a nursing home administrator. |

| 7 |EDUCATION REQUIREMENTS |

| | |

| |1. To be eligible for licensure an applicant must possess one of the following: |

| | |

| |Special academic courses in nursing home administration of no less than 100 clock hours of study in core of knowledge: or |

| |A baccalaureate degree in nursing home administration or |

| |A master’s degree in nursing home administration |

| 8 |EXPERIENCE REQUIREMENTS |

| | |

| |1, Experience (internship) requirements for licensure is as follows: |

| | |

| |With a baccalaureate degree, need 9 months (1500 hours) of full-time internship in an internship site; |

| |With a baccalaureate degree in a related health care profession, the requirement is 6 months (1000 hours) of full-time internship in an |

| |approved internship site; |

| |With a baccalaureate degree in nursing home administration - no further qualifying administrative experience is required |

| |With a master’s or higher degree in any subject 6 months (10000 hours) full-time internship experience in an approved internship site |

| |With a master’s or higher degree in nursing home administration - no further qualifying administrative experience is required; |

| |With a master’s or higher degree in a related health care profession 3 months (500 hours) full-time internship in an approved internship|

| |site; |

| 9 |LICENSING EXAMINATION |

| | |

| |An applicant must complete the CORE OF KNOWLEDGE IN NURSING HOME ADMINISTRATION before they can take the licensing exam |

| |A candidate is deemed to have abandoned the application if he does not schedule, take and pass the exam within 3 attempts |

| |A candidate must retake an exam within 6 months from the notice of failure |

| |Failure to make a passing grade on any section of the licensing examination constitutes failure to pass the examination. |

| |A candidate is required to repeat in the whole the section or sections previously failed. |

| |If a candidate fails 3 times to attain a passing grade on the examination, he must complete additional education and experience |

| |requirements |

| 10 |CONTINUING EDUCATION |

| | Must complete 20 clock hours within 15 months preceding the renewal of the certificate of registration |

| |Must complete a minimum of 14 hours of continuing education through an approved training provider |

| |May complete a maximum of 6 hours of continuing education from other approved courses or programs. |

| |A maximum of 5 hours of continuing education may be taken by self-study. |

| |Cannot carry over credits from one renewal period to the next |

| |Continuing education course hours must be submitted to the board by the training agency conducting the educational activity |

| |The licensee must be provided a certificate of attendance for all courses completed and the licensee is responsible to maintain a copy |

| |of those certificates if audited by the Board. |

| 11 |CERTIFICATE OF REGISTRATION |

| |A licensee is issued a nursing home administrator license |

| |The licensee is then registered by the Board and is issued a certificate of registration |

| |The certificate of registration must be renewed every year |

| |The licensee must complete 20 hours of continuing education every year to renew their certificate of registration |

| |Must renew the certificate of registration prior to expiration of certificate of registration in order to maintain continuing compliance|

| |A certificate of registration that is not renewed by the renewal date adds an additional 5 clock hours of continuing education per |

| |calendar quarter until renewed |

| |If a certificate of registration is not renewed after 6 months of the renewal date and lapses, the licensee must re-apply for licensure |

| |under the current requirements to reactivate their license |

| |Every person holding a valid license must display the license in the nursing home and have at hand the current certificate of |

| |registration. |

| 13 |INACTIVE LICENSE |

| |A licensed administrator who temporarily abandons the practice of nursing home administration shall notify the board in writing in 10 |

| |days |

| |The individual may thereafter register to be re-licensed upon meeting annual registration requirements. |

| 14 |PENALTIES |

| | |

| |A first serious violation of licensing laws is a fine not less than $50 nor more than $500 for the first offense |

| |Each subsequent offense is a fine is not less than $100 nor more than $500 or imprisoned for not more than 90 days, or both. |

|15 |SUSPENSION OR REVOCATION OF LICENSE |

| | |

| |The board may suspend or revoke a license or certificate of registration where the licensee: |

| | |

| |Has willfully or repeatedly violated any licensing rules |

| |Has willfully or repeatedly without regard to resident health and safety |

| |Is guilty of fraud or deceit in the practice of nursing home administration |

| |Has been convicted in a court of felony |

| |Is unfit or incompetent by reason of negligence, habits, or other causes |

| | |

| |Examples of unfit behavior are |

| | |

| |Failure to make good faith efforts to maintain compliance with pertinent statues and rules |

| |Failure to manage a home to insure the safety, health and welfare of residents |

| |Physical inability to serve as a nursing home administrator as evidenced by the |

| |statement of two licensed physicians; |

| |Mental incompetency declared by a decree of any court; |

| |Willfully permitting unauthorized disclosure of information relating to a patient |

| |Revocation or suspension of a license in another state |

| |Is unfit or incompetent by reason of negligence, habits, or other causes |

| |Is guilty of fraud or deceit in the practice of nursing home administration |

| | |

| |The Department may do the following where a licensee engages in unethical, unauthorized or unprofessional conduct: |

| | |

| |Suspend a license |

| |Revoke a license |

| |Refuse to issue or renew a license |

|16 |CHILD SUPPORT DEFAULT |

| | |

| |The department will not renew or issue a license to an individual who has defaulted on child support payments |

| |The individual will be required to pay the outstanding payments in full |

| |The employer will be notified to with hold future payments from wages paid the individual |

|17 |SUBMIT APPLICATION TO THE BOARD |

| |An application for license must be submitted to the Ohio Board of Examiners of Nursing Home Administrators |

|18 |REISSUANCE OF LICENSE AND REGISTRATION |

| |A license or registration that has been revoked may be re-issued |

| |An application for the reissuance of a license or registration, or both, must not be made prior to 1 year after revocation |

|19 |RECIPROCITY |

| | |

| |An administrator licensed in another state may apply for an Ohio license if the licensing requirements of the other state are equivalent|

| |to Ohio |

| |The applicant is not required to retake the national exam but must take the Ohio laws and rules exam |

|20 |ADMINISTRATOR REQUIRED |

| | |

| |No person can operate a nursing home unless it is under the supervision of a licensed administrator |

|21 |.REPORTING CHANGE OF ADMINISTRATOR AND ADDRESS |

| | |

| |Every operator of a nursing home must report to the Board Of Examiners Of Nursing Home Administrators the name and license number of |

| |each nursing home administrator within 10 days after the operator engages a nursing home administrator |

| |Must report to the Board Of Examiners Of Nursing Home Administrators within 10 days after a nursing home administrator leaves a facility|

| |and is no longer employed |

| |Must report a change of residence mailing address and the name and address of each place of employment to the board within 10 days after|

| |any change. |
