The (municipality/county proposing the zone) is seeking to create (or recertify) an Enterprise Zone. The recent enactment of Substitute Senate Bill 19 encourages the involvement of the Board of Education in all local tax exemption program decision-making. I have included a copy of this law for your review. You may wish to closely review Sections 5709.82, 5709.83, 5709.85 and 5709.62 (5709.63 or 5709.632 depending on authority requested by the local governments) of the Ohio Revised Code. These sections become effective July 22, 1994 and may require involvement of the Board of Education.

The (municipality/county) has appointed (name/title) as the Enterprise Zone Manager. (Name of E.Z. Manager) has been instructed to meet with Board of Education at your convenience and explain and discuss the Ohio Enterprise Zone Program. At the very least, the (municipality/county) hopes to set a procedure to ensure the participation of the Board of Education where required, so that general expectations can be met.

Of particular note, notice to the Board of Education on general Enterprise Zone proposed agreements has been set at a minimum of fourteen (14) days prior to formal review and action by the local government. If a proposed agreement exceeds the stated incentive limits then the notice becomes a minimum of forty-five (45) business days. Note that projects exceeding the state incentive limits require approval by the Board of Education. The Board may designate a representative to request a formal meeting on any proposed project. In addition, any project generating $1,000,000 of new annual payroll in an area with a local income tax requires the local government and the Board of Education to meet and agree upon a revenue sharing arrangement. Finally, a representative of the Board is a mandatory participant in the Tax Incentive Review Council to annually review each Enterprise Zone project for compliance. These are only a few of the major points included in Substitute Senate Bill 19.
