RESIDENTIAL BUILDING COMMITTEE MEETING MINUTES

August 4, 2010

The regular monthly meeting of the Residential Building Committee was called to order by the Chairman at 9:30 a.m. in the Conference Room of the Board’s offices, Baton Rouge, Louisiana. Members of the Residential Building Committee present:

There being a quorum, the regular order of business began.

Attending the meeting were: Michael McDuff, Executive Director; Judge Darrell White, Retired, Hearing Officer; Stephanie Laborde, Board Attorney; and from the staff; Bertha Jenkins, Kris Fitch, Bobbie Hughes; Michele Lemoine; Compliance Investigators – Mark Williamson, Carl Bourque, Lynwood Allemore; Sharon Fabre and Dwan Mizell recording the minutes.

Mr. Dana Dugas, Board Member led the members and audience in the Pledge of Allegiance which was followed by an invocation given by Retired Judge Darrell White

Retired Judge Darrell White introduced himself and advised those present of his duties.

MOTION was made by Mr. Dugas and seconded by Ms. Wendel to accept the Minutes of the July 14, 2010 regular meeting, as typed. The Motion passed.

NEW BUSINESS

CONTINUANCE – COMPLIANCE HEARING(S):

COASTAL HOMEBUILDERS, LLC (RL. 0088253)

Continuance – Consider an alleged violation of LA R.S. 37:2158 (A,5) of the Contractors’ Licensing Law by, COASTAL HOMEBUILDERS, LLC, Houma, Louisiana, permitting the contractor’s license to be used by another when the other contractor does not hold a license for the classification of work for which the contract is entered, at but not limited to, 222 Riverwood Drive, Houma, Louisiana.

Ms. Hughes read the allegations against COASTAL HOMEBUILDERS, LLC then asked if a representative of COASTAL HOMEBUILDERS, LLC was present. Attorney Chase Tettleton representing was present.

Attorney Tettleton came to the stand as legal representation for COASTAL HOMEBUILDERS, LLC, proposed a Settlement Offer of a No Contest plea and a $500.00 court cost associated with these proceedings. Ms. Laborde called Investigator Mark Williamson to the stand and was sworn in. Ms. Laborde questioned Mr. Williamson regarding his duties as a compliance investigator and his investigatory findings. Then the attorney reviewed the exhibit packet with the investigator. Ms. Laborde requested to submit the exhibit packet into record as legal evidence. Attorney Tettleton had no objection of the exhibit packet.

Retired Judge White accepted the exhibit packet for admittance. The attorney discussed with board members the process during the construction of project.

A MOTION was made by Mr. Ward and seconded by Ms. Wendel to accept the No Contest plea of COASTAL HOMEBUILDERS, LLC. The Motion passed.

A MOTION was made by Mr. Dugas and seconded by Ms. Wendel to reject the penalty Settlement Offer of COASTAL HOMEBUILDERS, LLC. The Motion passed.

MATTHEW PREGEANT (UNLICENSED)

Continuance – Consider an alleged violation of LA R.S. 37:2167 (A) of the Contractors’ Licensing Law by, MATTHEW PREGEANT, Houma, Louisiana, in that you have/or are in the process of constructing residence(s) in the amount of $738,230.00, at but not limited to, 222 Riverwood Drive, ($389,000.00) and 218 Hermitage Loop ($349,230.00), Houma, Louisiana, without possessing a State Residential Building License.

Ms. Hughes read the allegations against MATTHEW PREGEANT then asked if a representative of MATTHEW PREGEANT was present. Mr. Matthew Pregeant was present.

Mr. Pregeant came to the stand, was sworn in and pleaded Not Guilty to the allegations. Ms. LaBorde called Investigator Mark Williamson to the stand and was sworn in. The attorney questioned Mr. Williamson regarding his duties as a compliance investigator and his investigatory findings. Ms. Laborde reviewed the exhibit packet with the investigator. Ms. Laborde requested to submit the exhibit packet into record as legal evidence. Mr. Matthew Pregeant had no objection of the exhibit packet. Retired Judge White accepted the exhibit packet for admittance. Mr. Pregeant submitted his additional documents for legal record. Board Attorney had no objection and Retired Judge White accepted. Committee members reviewed and discussed with Mr. Pregeant the process and procedures of the constructed project, financial transactions and document agreements.

A MOTION was made by Mr. Ward and seconded by Ms. Wendel to find MATTHEW PREGEANT guilty. The Motion passed.

A MOTION was made by Ms. Gibson and seconded by Ms. Wendel to continue the assessment of penalty until September 1, 2010 Committee Meeting on MATTHEW PREGEANT. The Motion passed.

SHAW ENTERPRISES, LLC (UNLICENSED)

Continuance – Consider an alleged violation of LA R.S. 37:2167 (A) of the Contractors’ Licensing Law by, SHAW ENTERPRISES, LLC, Houma, Louisiana, in that you have/or are in the process of constructing residences(s) or in the process of performing home improvements in the amount of $137,966.00, at but not limited to, 211 South Van Avenue, Houma, Louisiana, without possessing a State Residential Building License and/or LA R.S. 37:2175.2 (A) in that you have/or are in the process of performing home improvements in excess of $7,500.00 without possessing a State Home Improvement Registration.

Ms. Hughes read the allegations against SHAW ENTERPRISES, LLC then asked if a representative of SHAW ENTERPRISES, LLC was present. There was no response.

Ms. Hughes read a proposed Settlement Offer submitted by SHAW ENTERPRISES, LLC., pleaded No Contest to the allegations, a fine in the amount of $2,069.49 plus $500.00 Court Cost associated with these proceedings.

A MOTION was made by Mr. Ward and seconded by Ms. Wendel to accept the No Contest plea of SHAW ENTERPRISES, LLC. The Motion passed.

A MOTION was made by Ms. Gibson and seconded Ms. Wendel to accept the Settlement Offer of SHAW ENTERPRISES, LLC a fine in the amount of $2,069.49 plus $500.00 Court Cost associated with these proceedings. The Motion passed.

COMPLIANCE HEARINGS

SEAN CHAFFEE D/B/A HIGH DEMAND CONTSTRUCTION (UNLICENSED)

Administrative Hearing – Consider an alleged violation of LA R.S. 37:2175.2 (A) of the Contractors’ Licensing Law by, SEAN CHAFFEE D/B/A HIGH DEMAND CONSTRUCTION, Greenwell Springs, Louisiana, in that you have/or are in the process of performing home improvement contracting services in the amount of $27,900.00, at but not limited to, 7042 Bryce Canyon Drive, Greenwell Springs, Louisiana, without possessing a State Home Improvement Registration.

Ms. Hughes read the allegations against SEAN CHAFFEE D/B/A HIGH DEMAND CONSTRUCTION then asked if a representative of SEAN CHAFFEE D/B/A HIGH DEMAND CONSTRUCTION was present. Sean Chaffee and Stacy Chaffee were present.

Mr. and Mrs. Chaffee came to the stand, sworn in and pleaded No Contest to the allegations. Ms. Laborde called Investigator Carl Bourque to the stand and was sworn in. Ms. Laborde questioned Mr. Bourque regarding his duties as a compliance investigator and his investigatory findings. Then the attorney reviewed the exhibit packet with the investigator. Ms. Laborde requested to submit the exhibit packet into record as legal evidence. Mr. Chaffee had no objection to the exhibit packet. Retired Judge White accepted for admittance. Mr. Chaffee discussed with the board attorney and committee members the process and procedures of retaining a proper titled state registration. Homeowner, Denice G. Thomas came the stand, was sworn in and summarized the process during construction. Committee members listened to statements in reference to the project contract agreement.

A MOTION was made by Mr. Ward and seconded by Ms. Wendel to accept the No Contest plea of SEAN CHAFFEE D/B/A HIGH DEMAND CONTSTRUCTION. The Motion passed.

A MOTION was made by Mr. Ward and seconded by Ms. Wendel to assess SEAN CHAFFEE D/B/A HIGH DEMAND CONTSTRUCTION a fine in the amount of $1,000.00 plus $500.00 Court Cost associated with these proceedings and placed on one (1) year probation to be monitor by SLBC office staff. The Motion passed.

RONALD BENOIT (UNLICENSED)

Administrative Hearing - Consider an alleged violation of LA R.S. 37:2167 (A) of the Contractors’ Licensing Law by, RONALD BENOIT, DeRidder, Louisiana, in that you have/or are in the process of constructing residence(s) in the amount of $221,000.00, at but not limited to, 1394 Ernest Drive, DeRidder, Louisiana, without possessing a State Residential Building License.

Ms. Hughes read the allegations against RONALD BENOIT then asked if a representative of RONALD BENOIT was present. There was no response.

Ms. Hughes read a proposed Settlement Offer submitted by RONALD BENOIT, pleaded Guilty to the allegations, a fine in the amount of $2,250.00 plus $500.00 Court Cost associated with these proceedings.

A MOTION was made by Mr. Dugas and seconded by Ms. Wendel to accept the Guilty plea of RONALD BENOIT. The Motion passed.

A MOTION was made by Mr. Dugas and seconded by Ms. Wendel to accept the Settlement Offer of RONALD BENOIT a fine in the amount of $2,250.00 plus $500.00 Court Cost associated with these proceedings. The Motion passed.

COASTAL EMPIRE CONSTRUCTION GROUP, LLC (UNLICENSED)

Administrative Hearing - Consider an alleged violation of LA R.S. 37:2167 (A) of the Contractors’ Licensing Law by, COASTAL EMPIRE CONSTRUCTION GROUP, LLC, Mandeville, Louisiana, in that you have/or are in the process of constructing residence(s) in the amount of $132,560.00, at but not limited to, 3422 Derby Place, New Orleans, Louisiana, without possessing a State Residential Building License.

Ms. Hughes read the allegations against COASTAL EMPIRE CONSTRUCTION GROUP, LLC then asked if a representative of COASTAL EMPIRE CONSTRUCTION GROUP, LLC was present. There was no response.

Ms. Laborde called Investigator Lynwood Allemore to the stand and was sworn in. Ms. Laborde questioned Mr. Allemore regarding his duties as a compliance investigator and his investigatory findings. Then the attorney reviewed the exhibit packet with the investigator. Ms. Laborde requested to submit the exhibit packet into record as legal evidence. Retired Judge White accepted the exhibit packet for admittance.

A MOTION was made by Mr. Dugas and seconded by Ms. Gibson to find COASTAL EMPIRE CONSTRUCTION GROUP, LLC guilty. The Motion passed.

A MOTION was made by Mr. Dugas and seconded by Ms. Gibson assess COASTAL EMPIRE CONSTRUCTION GROUP, LLC a fine in the amount of $3,976.80 plus $500.00 Court Cost associated with these proceedings with thirty days prior to suspension of Residential Building License number 880102 until fine paid. The Motion passed.

CLASSIC HOME REPAIR, INC. (UNLICENSED)

Administrative Hearing – Consider an alleged violation of LA R.S. 37:2167 (A) of the Contractors’ Licensing Law by, CLASSIC HOME REPAIR, INC., New Orleans, Louisiana, in that you have/or are in the process of constructing residence(s) or performing home improvements in the amount of $120,000.00, at but not limited to, 6434 Galvez Street, New Orleans, Louisiana, without possessing a State Residential Building License and/or LA R.S. 37:2175.2 (A) in that you have/or are in the process of performing home improvements in excess of $7,500.00 without possessing a State Home Improvement Registration.

Ms. Hughes read the allegations against CLASSIC HOME REPAIR, INC. then asked if a representative of CLASSIC HOME REPAIR, INC. was present. There was no response.

Ms. Laborde called Investigator Lynwood Allemore to the stand. Ms. Laborde questioned Mr. Allemore regarding his duties as a compliance investigator and his investigatory findings. Then the attorney reviewed the exhibit packet with the investigator. Ms. Laborde requested to submit the exhibit packet into record as legal evidence. Retired Judge White accepted the exhibit packet for admittance.

A MOTION was made by Mr. Dugas and seconded by Ms. Wendel to find CLASSIC HOME REPAIR, INC. guilty. The Motion passed.

A MOTION was made by Mr. Dugas and seconded by Ms. Wendel to assess CLASSIC HOME REPAIR, INC. a fine in the amount of $3,600.00 plus $500 Court Cost associated with these proceedings and issued a cease and desist order. The Motion passed.

JAMES T. CREIGHTON D/B/A ELITE HOMES (UNLICENSED)

Administrative Hearing – Consider an alleged violation of LA R.S. 37:2167 (A) of the Contractors’ Licensing Law by, JAMES T. CREIGHTON D/B/A ELITE HOMES, Shreveport, Louisiana, in that you have/or are in the process of constructing residence(s) or performing home improvements in the amount of $91,900.00, at but not limited to, 911 South Gate Road, Shreveport, Louisiana, without possessing a State Residential Building License and/or LA R.S. 37:2175.2 (A) in that you have/or are in the process of performing home improvements in excess of $7,500.00 without possessing a State Home Improvement Registration.

Ms. Hughes read the allegations against JAMES T. CREIGHTON D/B/A ELITE HOMES then asked if a representative of JAMES T. CREIGHTON D/B/A ELITE HOMES was present. Mr. James T. Creighton was present.

Mr. Creighton came to the stand, was sworn in and pleaded Guilty to the allegations. Mr. Creighton summarized the handling of documents and discrepancies with the homeowner during the construction of the project. The committee members discussed the process and procedures of retaining a proper titled state registration.

A MOTION was made by Mr. Dugas and seconded by Ms. Wendel to accept the Guilty plea of JAMES T. CREIGHTON D/B/A ELITE HOMES. The Motion passed.

A MOTION was made by Mr. Dugas and seconded by Ms. Wendel to assess JAMES T. CREIGHTON D/B/A ELITE HOMES a $500.00 Court Cost associated with these proceedings. The Motion passed.

RICHARD A. HELSEL D/B/A HELSEL CONTRACTING (UNLICENSED)

Administrative Hearing – Consider an alleged violation of LA R.S. 37:2167 (A) of the Contractors’ Licensing Law by, RICHARD A. HELSEL D/B/A HELSEL CONTRACTING, New Orleans, Louisiana, in that you have/or are in the process of constructing residence(s) or performing home improvements in the amount of $86,898.00, at but not limited to, 908 North Redon Street, New Orleans, Louisiana, without possessing a State Residential Building License and/or LA R.S. 37:2175.2 (A) in that you have/or are in the process of performing home improvements in excess of $7,500.00 without possessing a State Home Improvement Registration.

Ms. Hughes read the allegations against RICHARD A. HELSEL D/B/A HELSEL CONTRACTING then asked if a representative of RICHARD A. HELSEL D/B/A HELSEL CONTRACTING was present. There was no response.

Board Attorney LaBorde called Investigator Lynwood Allemore to the stand. The attorney questioned Mr. Allemore regarding his duties as a compliance investigator and his investigatory findings. Then the attorney reviewed the exhibit packet with the investigator. The board attorney requested to submit the exhibit packet into record as legal evidence. Retired Judge White accepted the exhibit packet for admittance.

A MOTION was made by Mr. Dugas and seconded by Ms. Wendel to assess RICHARD A. HELSEL D/B/A HELSEL CONTRACTING a fine in the amount of $8,689.80 plus $500.00 Court Cost associated with these proceedings and issued a cease and desist order. The Motion passed.

BRIAN KEMP D/B/A KEMP BUILDERS (UNLICENSED)

Administrative Hearing – Consider an alleged violation of LA R.S. 37:2167 (A) of the Contractors’ Licensing Law by, BRIAN KEMP D/B/A KEMP BUILDERS, Vidalia, Louisiana, in that you have/or are in the process of constructing residence(s) or performing home improvements in the amount of $125,696.70, at but not limited to, 1291 Highway 568, Ferriday, Louisiana, without possessing a State Residential Building License and/or LA R.S. 37:2175.2 (A) in that you have/or are in the process of performing home improvements in excess of $7,500.00 without possessing a State Home Improvement Registration.

Ms. Hughes read the allegations against BRIAN KEMP D/B/A KEMP BUILDERS then asked if a representative of BRIAN KEMP D/B/A KEMP BUILDERS was present. Mr. Brian Kemp was present.

Mr. Kemp came to the stand, was sworn in and pleaded No Contest to the allegations. Ms. Laborde outlined the contractor’s case to the committee. The attorney reviewed the exhibit packet and Investigator Bourque gave statement of his investigatory findings. Mr. Kemp discussed the process during the construction of the project, financial transactions and document agreements. The committee members informed Mr. Kemp the procedures in retaining a proper state license by following the rules and regulation of the state board contractor’s law.

A MOTION was made by Mr. Ward and seconded by Mr. Dugas to accept the No Contest plea of BRIAN KEMP D/B/A KEMP BUILDERS. The Motion passed.

A MOTION was made by Ms. Wendel and seconded by Mr. Ward to assess BRIAN KEMP D/B/A KEMP BUILDERS a fine in the amount of $500.00 plus $500.00 Court Cost associated with these proceedings and issued a cease and desist order. The Motion passed.

DANNY SMITH GENERAL CONTRACTOR, INC. (HI 552104)

Administrative Hearing – Consider an alleged violation of LA R.S. 37:2167 (A) of the Contractors’ Licensing Law by, DANNY SMITH GENERAL CONTRACTOR, INC., Vidalia,

Louisiana, in that you have/or are in the process of constructing residence(s) or performing home improvements in the amount of $125,696.70, at but not limited to, 1291 Highway 568, Ferriday, Louisiana, without possessing a State Residential Building License and/or LA R.S. 37:2175.2 (A) in that you have/or are in the process of performing home improvements in excess of $7,500.00 without possessing a State Home Improvement Registration.

Ms. Hughes read the allegations against DANNY SMITH GENERAL CONTRACTOR, INC. then asked if a representative of DANNY SMITH GENERAL CONTRACTOR, INC. was present. Mr. Danny Smith was present.

Mr. Smith came to the stand, was sworn in and pleaded No Contest to the allegations. Board attorney outlined the contractor’s case to the committee. The attorney reviewed the exhibit packet and Investigator Bourque gave statement of his investigatory findings. Mr. Smith discussed the process during the construction of the project, financial transactions and document agreements. The committee members informed Mr. Smith the procedures in retaining a proper state license by following the rules and regulation of the state board contractor’s law.

A MOTION was made by Mr. Ward and seconded by Ms. Wendel to accept the No Contest plea of DANNY SMITH GENERAL CONTRACTOR, INC. The Motion passed.

A MOTION was made by Mr. Ward and seconded by Mr. Dugas to assess DANNY SMITH GENERAL CONTRACTOR, INC a fine in the amount of $500.00 plus $500.00 Court Cost associated with these proceedings and place them on one (1) year probation to be monitor by SLBC office staff. The Motion passed.

BECK & CALL GENERAL CONTRACTORS, INC. (UNLICENSED)

Administrative Hearing – Consider an alleged violation of LA R.S. 37:2175.2 (A) of the Contractors’ Licensing Law by, BECK & CALL GENERAL CONTRACTORS, INC., Arlington, Texas, in that you have/or are in the process of performing home improvement contracting services in the amount of $46,640.00, at but not limited to, 601 Stoner Avenue, Shreveport, Louisiana, without possessing a State Home Improvement Registration.

Ms. Hughes read the allegations against BECK & CALL GENERAL CONTRACTORS, INC. then asked if a representative of BECK & CALL GENERAL CONTRACTORS, INC. was present. There was no response.

Ms. Laborde called Investigator Carl Bourque to the stand and was sworn in. Ms. Laborde questioned Mr. Bourque regarding his duties as a compliance investigator and his investigatory findings. Then the attorney reviewed the exhibit packet with the investigator. Ms. Laborde requested to submit the exhibit packet into record as legal evidence. Retired Judge White accepted the exhibit packet for admittance.

A MOTION was made by Mr. Ward and seconded by Ms. Wendel to find BECK & CALL GENERAL CONTRACTORS, INC. guilty. The Motion passed.

A MOTION was made by Mr. Ward and seconded by Mr. Dugas to assess BECK & CALL GENERAL CONTRACTORS, INC. a fine in the amount of $11,660.00 plus $500.00 Court Cost associated with these proceedings and issued a cease and desist order. The Motion passed.

JAMES DAVIS (UNLICENSED)

Administrative Hearing – Consider an alleged violation of LA R.S. 37:2175.2 (A) of the Contractors’ Licensing Law by, JAMES DAVIS, Prairieville, Louisiana, in that you have/or are in the process of performing home improvement contracting services in the amount of $17,500.00, at but not limited to 17663 Old Jefferson Highway, Prairieville, ($8,200.00), and 42358 Highway 931, ($9,300.00), Gonzales, Louisiana, without possessing a State Home Improvement Registration.

Ms. Hughes read the allegations against JAMES DAVIS then asked if a representative of JAMES DAVIS was present. There was no response

Ms. Laborde called Investigator Mark Williamson to the stand and was sworn in. Ms. Laborde questioned Mr. Williamson regarding his duties as a compliance investigator and his investigatory findings. Then the attorney reviewed the exhibit packet with the investigator. Ms.

Laborde requested to submit the exhibit packet into record as legal evidence. Retired Judge White accepted the exhibit packet for admittance.

A MOTION was made by Mr. Dugas and seconded by Ms. Wendel to find JAMES DAVIS guilty. The Motion passed.

A MOTION was made by Ms. Wendel and seconded by Mr. Ward to assess JAMES DAVIS a fine in the amount of $4,375.00 plus $500.00 Court Cost associated with these proceedings and issued a cease and desist order. The Motion passed.

Administrative Hearing – Consider an alleged violation of LA R.S. 37:2175.2 (A) of the Contractors’ Licensing Law by, LAWRENCE FAYE, Houma, Louisiana, in that you have/or are in the process of performing home improvement contracting services in the amount of $18,063.00, at but not limited to, 1734 Savanne, Houma, Louisiana, without possessing a State Home Improvement Registration.

Ms. Hughes read the allegations against LAWRENCE FAYE then asked if a representative of LAWRENCE FAYE was present. There was no response.

Ms. Laborde called Investigator Mark Williamson to the stand and was sworn in. Ms. Laborde questioned Mr. Williamson regarding his duties as a compliance investigator and his investigatory findings. Then the attorney reviewed the exhibit packet with the investigator. Ms. Laborde requested to submit the exhibit packet into record as legal evidence. Retired Judge White accepted the exhibit packet for admittance.

Administrative Hearing – Consider an alleged violation of LA R.S. 37:2175.2 (A) of the Contractors’ Licensing Law by, MARCEL HODAS D/B/A MH REMODELING, Baton Rouge, Louisiana, in that you have/or are in the process of performing home improvement contracting services in the amount of $30,789.76, at but not limited to, 10714 Aberdeen Acres, Denham Springs, Louisiana, without possessing a State Home Improvement Registration.

Ms. Hughes read the allegations against MARCEL HODAS D/B/A MH REMODELING then asked if a representative of MARCEL HODAS D/B/A MH REMODELING was present. Mr. Marcel Hodas was present.

A MOTION was made Mr. Dugas and seconded by Mr. Ward that the following application(s) for home improvement registrations be approved pending all requirements being met as long as they are or it is initialed by a member of the Residential Building Committee and that the registration certificate be issued as soon as staff has determined that all requirements have been met for or beginning with A-FAB ENTERPRISES, INC. and ending with WILLIAMS PAINTING & DRYWALL, LLC. The Motion passed.

A MOTION was made by Mr. Dugas and seconded by Mr. Ward to open the Agenda. The Motion passed.

Committee members and staff discussed concerns and complications regarding the contractor’s insurance policy coverage and statements with specifications of new construction and/or remodeling coverage.

ADJOURNMENT
