WCI Guidance for NC Unemployment – with updates through April 10On March 17th, Governor Roy Cooper announced an Executive Order related to the containment of COVID-19. His order includes the broadening of unemployment insurance benefits.In summary, there are 5 main changes to unemployment insurance (UI) benefits:The 1-week waiting period for unemployment benefits is waivedNo requirement to look for workEligibility: Job loss, reduced hours. Update 3/23/2020: According to Lockhart Taylor with NC Division of Employment Security, ‘reduction in hours’ still means less than three customary scheduled full-time days, consistent with § 96-15.01. Therefore, the Executive Order didn’t change that aspect of the existing law.Apply online at des. or via phone. No in-person applications. Employer is not charged for COVID 19-related claims.Guidance for EmployersThe employer response to the claim should be “lack of work” or “reduction in hours.” Update 4/10/2020: There will be a follow-up which would allow employers to respond “noncharging due to COVID-19.”“Attached worker claims” in association with COVID-19 is not advised as it could limit employee benefits. (see next point)Update 4/10/2020: Per Lockhart Taylor (NC DES), the oversight committee for the General Assembly has approved that, during times of disaster, employers can file attached worker claims. There will be no 6-week time limit for claim duration, no requirement of a positive account balance.Further, if the employee qualifies for UI money in NC, the employee will also then qualify for the $600 per week federal money. Maximum BenefitThe current maximum for unemployment in NC is $350 weekly for 20 weeks. Update 3/31/2020: The additional $600 in federal benefits will be for weeks ending April 4 – July 31. DES is awaiting guidance for issuing those payments. If you do not have online access, call 888-372-3453 (Weekly Certifications only).TIP: N.C. Executive Order 118 allows some requirements to be waived for people filing for unemployment due to COVID-19. If you are filing due to COVID-19, you may answer ‘yes’ to this question on the Weekly Certification: Did you look for work?Check your claim statusAfter you file your claim, your last employer will be given, by law, 10 days to respond to DES. No payment will be released prior to the end of this 10-day period. If there are no issues, individuals typically receive payment within about 14 days of filing their initial claim. ................
