The regular monthly meeting of the Board was called to order by the Chairman at 9:45 a.m. in the Conference Room of the Board’s offices, Baton Rouge, Louisiana. Members of the Board present:

There being a quorum, the regular order of business began.

Mr. Clouatre, Board member, led the members and audience in the Pledge of Allegiance, which was followed by an invocation given by Judge Darrell White, Retired, Hearing Officer then Judge White introduced himself and advised those present of his duties.

A MOTION was made by Mr. Weston and seconded by Mr. Meredith to authorized Judy Dupuy to do business with banks on behalf of the Louisiana State Licensing Board for Contractors. The motion carried unanimously.
A MOTION was made by Mr. Weston and seconded by Mr. Meredith to allow Judy Dupuy to serve as an additional Appointing Authority for the purpose of filing Civil Service actions and all personal actions relative to employees at the Board. The motion carried unanimously.

A MOTION was made by Mr. Weston and seconded by Mr. Crain and Mr. Clouatre to accept and approve the Waiver of Examination Agreement between the State of Ohio and the State of Louisiana. The motion carried unanimously.

Arco Electric Company, Incorporated (CL LIC No. 25487)
Administrative Hearing – Consider suspending or revoking the Louisiana commercial contractor’s license number 25487 held by Arco Electric Company, Incorporated for reason, that on information and belief the qualifying party for your firm has terminated employ-ment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all accord-ing to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.
Ms. Kris Fitch read the allegations against ARCO ELECTRIC COMPANY, INCORPORATED then asked if a representative of ARCO ELECTRIC COMPANY, INCORPORATED was present. Mr. Donald Case, representing Arco Electric Company, Incorporated was present.
Mr. Case came to the stand, was sworn in then Mr. Case stated that he was requesting a continuance to give him time to get legal assistance/counseling.
Ms. Fitch updated the Board Members regarding this matter and what had taken place at previous Commercial Board Meetings regarding this company and their qualifying party.
Mr. Lambert questioned Mr. Case. Mr. Case responded.
A MOTION was made by Mr. Meredith and seconded by Mr. Gallo to immediately revoke or suspend commercial license number 25487 held by ARCO ELECTRIC COMPANY, INCORPORATED for not having a current qualifying party in place. The motion carried unanimously.
Ballard Construction, Inc. (CL LIC No. 47537)
Administrative Hearing – Consider suspending or revoking the Louisiana commercial contractor’s license number 47537 held by Ballard Construction, Inc. for reason, that on information and belief the qualifying party for your firm has terminated employ-ment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all accord-ing to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.
Ms. Kris Fitch read the allegations against BALLARD CONSTRUCTION, INC. then asked if a representative of BALLARD CONSTRUCTION, INC. was present. There was no response.
A MOTION was made by Mr. Meredith and seconded by Mr. Graham and Mr. Gallo to immediately revoke or suspend commercial license number 47537 held by BALLARD CONSTRUCTION, INC. for not having a current qualifying party in place. The motion carried unanimously.
Eldorado Casino Shreveport Joint Venture (CL LIC No. 36582)

Ms. Kris Fitch regarding the allegations against SPECTRUM ENGINEERING, INC. then asked if a representative of SPECTRUM ENGINEERING, INC. was present. There was no response.
A MOTION was made by Mr. Meredith and seconded by Mr. Clouatre to immediately revoke or suspend commercial license number 40082 held by SPECTRUM ENGINEERING, INC. for not having a current qualifying party in place. The motion carried unanimously.
Jim Walter Homes, Inc. (CL LIC No. 30161 & RL LIC No. 81939)
Administrative Hearing – Consider suspending or revoking the Louisiana commercial contractor’s license number 30161 and your residential contractor’s license number 81939 held by Jim Walter Homes, Inc. for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.
Ms. Kris Fitch read the allegations against JIM WALTER HOMES, INC. then asked if a representative of JIM WALTER HOMES, INC. was present. There was no response.
A MOTION was made by Mr. Gallo and seconded by Mr. Clouatre to accept the letter dated January 21, 2010 from JIM WALTER HOMES, INC. surrendering both their commercial license number 30161 and residential license number 81939 back to this Board. The motion carried unanimously.

Epco Construction, Inc. (CL LIC No. 45233 & RL LIC No. 88112)
Administrative Hearing – Consider an alleged violation by Epco Construction, Inc. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgement which was rendered by the First City Court for the Parish of Orleans, No. 09-53070, Division “B”, Parish of Orleans, State of Louisiana, on the 24th day of November, 2009, in which Joycelyn Williams-Hayes and Epco Construction, Inc., holder of commercial contractor’s license number 45233 and residential contractor’s license number 88112, were ordered to pay in solidio, in the sum of ONE THOUSAND EIGHT HUNDRED FIFTEEN DOLLARS AND 94/100, ($1,815.94), plus legal interest from date of Invoice, until paid, twenty-five (25%) percent of principal and interest as attorney’s fees and all costs in favor of Nairn Concrete Services, Inc. IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the petitioner’s privilege on the following described property, located in Orleans Parish, Louisiana, owned by Joycelyn Williams-Hayes, be and it is hereby recognized, and that said property be seized and sold for one hundred (100%) percent cash at the moment of adjudication and the proceeds applied to pay the claim of the plaintiff in preference and priority over all others, with such property described as follows:

Ms. Kris Fitch read the allegations against EPCO CONSTRUCTION, INC. then asked if a representative of EPCO CONSTRUCTION, INC. was present. Mr. David Eppreley, representing.EPCO Construction, Inc. and Mr. David Parlovich, Attorney representing Nairn Concrete Services, Inc. were both present.
Mr. Eppreley and Attorney Parlovich both came to the stand. Mr. Eppreley was sworn in then Ms. Fitch asked Mr. Eppreley how he was pleading? Mr. Eppreley responded No Contest.
Attorney Pavlovich was also at the stand, introduced himself and gave a brief statement.
Mr. Talbot and Mr. Meredith each individually questioned Mr. Eppreley. Mr. Eppreley responded to each individually.
Then Attorney Pavlovich made a statement.
Attorney Murphy Foster, III asked Mr. Eppreley that once the judgment has been satisfied, to supply this Board with a copy of that document.
Mr. Gallo questioned Mr. Eppreley. Mr. Eppreley responded.
Attorney Murphy Foster, III entered the final judgment into the record. Judge White accepted.
A MOTION was made by Mr. Meredith and seconded by Mr. Weston to give EPCO CONSTRUCTION, INC. fifteen (15) days to satisfy the out-standing judgment. If after the fifteen (15) days this judgment is not satisfied, commercial license numbers 45233 and residential license number 88112 held by EPCO CONSTRUCTION, INC. will immediately be revoked. If the out-standing judgment is satisfied, the company need to provide this Board with a notarized documentation, showing the judgment was satisfied. The motion carried unanimously.
Epco Construction, Inc. (CL LIC No. 45233 & RL LIC No. 88112)
Administrative Hearing – Consider an alleged violation by Epco Construction, Inc. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgement which was rendered by the First City Court for the Parish of Orleans, No. 09-53071, Division “C”, Parish of Orleans, State of Louisiana, on the 14th day of December, 2009, in which Karen A. Robinson, and Epco Construction, Inc., holder of commercial con- tractor’s license number 45233 and residential contractor’s license number 88112, were ordered to pay in the sum of FOUR THOUSAND ONE HUNDRED SIXTY-NINE DOLLARS AND 25/100 ($4,169.25), plus legal interest from date of Invoice, until paid, twenty-five (25%) percent of principal and interest in attorney’s fees and all costs in favor of Nairn Concrete Services, Inc. IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the petitioner’s privilege on the following described property, located in Orleans Parish, Louisiana, owned by Karen A. Pflueger Electric Co., Inc. (CL LIC No. 304)
Administrative Hearing – Consider an alleged violation by Pflueger Electric Co., Inc. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a consent judgement which was rendered by the 24th Judicial District Court, No. 665,490, Parish of Jefferson, State of Louisiana, on the 7th day of August, 2009, in which Pflueger Electric Co., Inc., holder of commercial contractor’s license number 304, was ordered to pay in the principal amount of THIRTY-THREE THOUSAND NINE HUNDRED NINETY-EIGHT DOLLARS AND 85/100 ($33,985.85) with interest at the legal rate from the date of judicial demand until paid, attorney’s fees of $3,398.58, and all costs of court in favor of Southern Electric Supply Company, Inc. D/B/A Rexel.
Ms. Kris Fitch read the allegations against PFLUEGER ELECTRIC CO., INC. then asked if a representative of PFLUEGER ELECTRIC CO., INC. was present. Mr. David Stoehr, representing Pflueger Electric Co., Inc. and Mr. Frank White, Attorney representing Southern Electric were both present.
Mr. Stoehr and Attorney White both came to the stand. Mr. Stoehr was sworn in then gave his statement.
Mr. Talbot questioned Mr. Stoehr. Mr. Stoehr responded.

A MOTION was made by Mr. Weston and seconded by Mr. Meredith and Mr. Fenet to give PFLUEGER ELECTRIC CO., INC. sixty (60) days to satisfy the out-standing judgment. If after the sixty (60) days the judgment is not satisfied, commercial license numbers 304 held by PFLUEGER ELECTRIC CO., INC. will immediately be revoked. The motion carried unanimously.

Federal Construction Group (Unlicensed)
Continuance – Consider an alleged violation by Federal Construction Group of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Federal Construction Group, acted as a contractor to perform work on the RPM-Installation-Port of Lake Charles project in Lake Charles, Louisiana in the amount of $455,791.00 without possessing a Louisiana state contractor’s license.
Mrs. Bobbie Hughes read the allegations against FEDERAL CONSTRUCTION GROUP then asked if a representative of FEDERAL CONSTRUCTION GROUP was present. Mr. Mike Reynoso was present.
Mr. Reynoso came to the stand, was sworn in then Mrs. Hughes asked Mr. Reynoso how he was pleading? Mr. Reynoso responded No Contest then gave his statement.
Mr. Lambert questioned Mr. Reynoso. Mr. Reynoso responded.

A MOTION was made by Mr. Lambert and seconded by Mr. Gallo and Mr. Clouatre to accept the No Contest plea of FEDERAL CONSTRUCTION GROUP. The motion carried unanimously.
A MOTION was made by Mr. Lambert and seconded by Mr. Weston to assess FEDERAL CONSTRUCTION GROUP a fine of 3% of $455,791.00 – which equals $13,673.73 plus $500.00 administrative fees associated with these proceedings for a total of $14,173.73 and a cease and desist order. The motion carried unanimously.
AJ's Plumbing Service, LLC (Unlicensed)
Administrative Hearing – Consider an alleged violation by AJ's Plumbing Service, LLC of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, AJ's Plumbing Service, LLC, acted as a contractor to perform plumbing work on the Wild Bill's Car Wash project in Roseland, Louisiana in the amount of $18,872.00 without possessing a Louisiana state contractor’s license.
Mrs. Bobbie Hughes read the allegations against AJ’S PLUMBING SERVICE, LLC then Mrs. Hughes read the settlement offer of $300.00 plus $500.00 administrative fees associated with these proceedings for a total of $800.00 that was submitted by AJ’S PLUMBING SERVICE, LLC.
A MOTION was made by Mr. Graham and seconded by Mr. Lambert to accept the settlement offer of $300.00 plus administrative fees associated with these proceedings for a total of $800.00 submitted by AJ’S PLUMBING SERVICE, LLC. The motion carried unanimously.
Crain's Mechanical Inc. (CL LIC No. 41816)
Administrative Hearing – Consider an alleged violation by Crain's Mechanical Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Crain's Mechanical Inc., entered into multiple contracts with multiple unlicensed contractors to perform plumbing and electrical work on the Wild Bill's Car Wash project in Roseland, Louisiana in an amount in excess of $10,000.00.

Administrative Hearing – Consider an alleged violation by Narretto Electric of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Narretto Electric, acted as a contractor to perform work on the Wild Bill's Car Wash project in Roseland, Louisiana in the amount of $22,900.00 without possessing a Louisiana state contractor’s license.
Mrs. Bobbie Hughes read the allegations against NARRETTO ELECTRIC then asked if a representative of NARRETTO ELECTRIC was present. Mr. John Narretto was present.
