The Bruce J. S. Macdonald Fonds represents the life and accomplishments of a truly remarkable individual. The papers, now properly arranged and described fill in many historical blanks on local, national and even international levels.

Content Note

This fonds contains documents regarding the family, life and career of Bruce John Stewart Macdonald, spanning the years [189-?] to 1986, although not inclusively.

The fonds is divided into nine series: Private Life 1898 to 1986; Essex Scottish Regiment 1931 to 1986; War Crimes 1944 to [198-?]; Legal Career 1928 to 1986; Police Commissions 1923 to 1978; Speeches 1946 to [198-?]; Photographic Material [189-?] to 1985; Ephemera 1906 to [197-?]; and Maps 1943 to [194-?].

The first series, spanning the years 1898 to 1986, consists primarily of correspondence, newspaper clippings and certificates regarding the private life of Bruce Macdonald. Documents provide insight into Macdonald’s family, personal life, education, community service activities and his book, The Trial of Kurt Meyer.

The second series contains documents highlighting Macdonald’s association with the Essex Scottish Regiment. Documents within this series span the years 1931 to 1986. The majority of the documents deal with Macdonald’s involvement with the Regiment both during and after World War II. Unfortunately, there is no documentation of his involvement with the Regiment during the pre-war period.

The third series is composed of documents which focus on the war crimes trials after World War II. Documents within this series span the years 1944 to [198-?]. This series consists primarily of correspondence and reports involving several war crimes trials, including that of S. S. Brigadeführer Kurt Meyer. The majority of the Supreme Headquarters Allied Expeditionary Force SHAEF reports within this series are in very fragile condition and must be handled with extreme care. In those cases where two copies of the report exist, a research copy will be made available to researchers. Photographs are included in several of the reports which must also be handled with care. In a few cases, photographs have been removed from the files and must be requested separately. Researchers will be provided with cotton gloves when handling these reports.

RESEARCHERS MUST ALSO NOTE THAT SEVERAL REPORTS WITHIN THIS SERIES CONTAIN VERY GRAPHIC PHOTOGRAPHS OF CORPSES, EXHUMATIONS AND CONCENTRATION CAMP CONDITIONS. HESE PHOTOGRAPHS MAY BE CONSIDERED DISTRUBING AND SHOULD BE VIEWED WITH DISCRETION.

The fourth series consists primarily of correspondence and reports documenting Macdonald’s legal career and span the years 1928 to 1986. In some cases, photographs and plans have been removed from the files and must be requested separately.

Primarily correspondence, minutes and reports, the fifth series contains documents which

highlight Macdonald’s involvement with police commissions. The Windsor, Leamington and Ontario Police Commissions are documented as well as the Association of Municipal Police Governing Authorities. Documents within this series span the years 1923 to 1978.

Series six consists of numerous speeches made by Bruce Macdonald, spanning the years 1946 to [198-?]. When received by the Archives, the speeches were stored together in one large box. For ease of use, they have been divided into several broad topic areas. In some cases the speech has been transcribed, with the transcription filed along with the original speech. These speeches are invaluable as they document Macdonald’s view towards certain events and issues.

The seventh series consists of photographs, negatives and slides spanning the years [189-?] to 1985. These materials document Macdonald’s family and personal life, World War II, war crimes trials, legal cases and police ceremonies. As such, these materials supplement the textual documents within the fonds. The majority of the photographs, negatives and slides have been transferred to the Photograph Collection of the Municipal Archives. In those cases where photographs were physically attached to textual documents, they have remained within the files. All photographs must be requested separately by researchers. SEVERAL PHOTOGRAPHS DEPICT VERY GRAPHIC IMAGES OF CORPSES, EXHUMATIONA AND CONCENTRATION CAMP CONDITIONS. THESE PHOTOGRAPHS MAY BE CONSIDERED DISTURBING AND SHOULD BE VIEWED WITH DISCRETION.

Series eight contains textual and artifact ephemera which were included within the fonds. Material within this series span the years 1906 to [197-?]. Materials have been divided into textual material and artifacts and have been stored separately. Postcards within this series should be requested by PC-P/number.

The ninth series consists of maps dating from the 1940s. These maps may prove useful to researchers by supplementing information found within other documents, particularly those involving World War II and the war crimes trials. Due to their size, all maps are stored apart from the rest of the collection.

The documents within this fonds were donated to the Municipal Archives by Norma Macdonald and William Willson in 1988. Researchers should note that Bruce Macdonald transferred several original documents to the National Archives in Canada. Copies of these documents can be found in MS 43 I-1/6. Researchers should also note that several topics covered by this fonds can be found in other collections. Researchers interested in Charlie Knight caricatures should consult MS 44. Researchers interested in Bruce Macdonald’s career as City Solicitor should consult RG 9 Records of the Legal Department. Historical Note

Bruce John Stewart Macdonald was born on 2 December 1902 at Rose Bay, Nova Scotia to Dr. William Henry and Mary Annie Victoria Macdonald. In 1913 his family moved to Medicine Hate, Alberta, where his father practiced medicine. He graduated from the University of Alberta in 1924 with a bachelor’s degree and in 1926 with a law degree. While attending the University of Alberta, Macdonald was Editor-in-Chief of the weekly newspaper, President of the Law Club, Permanent President Class ’26 and a member of the champion debating team. In 1927 he completed a post graduate course at Harvard Law School. In September of that year he moved to Windsor and practiced law with Norman A. McLarty and Gordon L. Fraser.

Upon moving to Windsor in 1927, Macdonald joined the law firm of McLarty & Fraser. He remained with then until his appointment as Windsor’s first full-time City Solicitor in September 1930. As City Solicitor, Macdonald assisted in proceedings as well as with drafting special legislation for the 1935 amalgamation of Windsor, East Windsor, Sandwich and Walkerville. As counsel for the new City of Windsor, Macdonald represented the City in hearings before the Ontario Municipal Board regarding the refunding of a $40 million amalgamated city debt. After resigning as City Solicitor in 1937, Macdonald returned to private practice with McLarty and Fraser. On 16 September 1939 Macdonald married Norma Millard in a ceremony at All Saints’ Church, Windsor.

Macdonald joined the Essex Scottish Regiment in 1929 as a militia officer. He enlisted in September 1939 for overseas service and acted as Company Commander. He was promoted to second in command of the regiment in 1942 and remained in this position until May 1943. Macdonald served as Commanding Officer from 27 May 1943 to 22 July 1944, with the rank of Lieutenant-Colonel and commanded the Regiment in early fighting in Normandy. Prior to the Normandy invasion, he conducted a battle school for the training of all units of the Fourth Infantry Brigade.

From August 1944 to May 1945 Macdonald was the Canadian representative on the Supreme Headquarters Allied Expeditionary Forces (SHAEF) Court of Inquiry on War Crimes. During this time Macdonald traveled throughout Europe investigating reports of offenses against Allied troops taken prisoner by German Armed Forces. He would later serve as president of the court for three months, beginning in February 1945. In May 1945, the No. 1 Canadian War Crimes Investigation Unit was established, as the SHAEF Court of Inquiry was dissolved at war’s end and Macdonald appointed its Commanding Officer. This new unit carried on the work previously done by the SHAEF court, however, they only investigated reports of war crimes affecting members of the Canadian forces, Macdonald would also act as Chief Prosecutor of war criminals for the Canadian forces.

During his appointment with this unit, Macdonald acted as Chief Prosecutor of was criminals for the Canadian forces. In December 1945 he successfully prosecuted S. S.

Brigadeführer Kurt Meyer. Meyer was charged with directing his troops to deny quarter to Allied prisoners, as well as for being responsible for the killing of Canadian prisoners at his headquarters at Abbaye Ardenne near Caen, France. Meyer was convicted and sentenced to death, but was later commuted to life imprisonment. The trial and sentencing controversy made the Meyer case the most publicized war crime case in Canada at the time. Macdonald published a book about the trial, The trial of Kurt Meyer, in 1954. For his service in World War II, Macdonald was awarded the Order of the British Empire (OBE), the Croix de Guerre (France) and the Efficiency Decoration.

After returning from active service in 1946, Macdonald was appointed King’s Council and joined Wilson, Thomson & Macdonald. While at this firm, Macdonald acted as solicitor for both Essex County as well as the Sandwich, Windsor & Amherstburg Railway Co. On 1 April 1951 he was appointed Crown Attorney for Essex County. His primary challenge as Crown Attorney was to restore order to the troubled Windsor police department. That same day he became a member of the Windsor Police Commission and would eventually become its chairman. Macdonald was also a member of the Sandwich West, Leamington and Amherstburg police commissions, as well as president of the Association of Municipal Police Governing Authorities of Ontario. He was appointed a Judge of County and District Courts of Ontario with residence at Windsor in October 1961. He took a leave of absence from the judge’s bench from April 1962 to February 1964 to become the first chairman of the Ontario Police Commission. During this time the Ontario Police College was established, the Ontario Provincial Police reorganized and a report made on organized crime in Ontario. After retiring as Judge of the County in December 1977 ha became a Judge of Small Claims Court, a position he held into the year of his death.

Macdonald was very active in community service and during his life was involved with several organizations. He was president of the Rotary Club, Windsor Symphony Society and United Nations Association. He was first president of the Essex Scottish Officers Association, Essex Scottish Regimental Association and Honourary Life President of the South African Veterans Association. Bruce Macdonald died on 2 June 1986. Norma Macdonald died 8 July 1990 and is interred at Greenlawn Memorial Gardens.

Series Description

Documents within this first series span the years 1898 to 1986, although not inclusively and highlight the private life of Bruce Macdonald. Insight is granted into his family and personal life, his education at the University of Alberta and Harvard University, his community service activities as well as the development of his book, The Trial of Kurt Meyer.

Subseries Description

This subseries, spanning the years 1898 to 1986, contains documents relating to Bruce Macdonald’s family and personal life. Although primarily correspondence, this subseries contains a wide variety of documents. Included in this subseries are contracts, a calendar, certificates, notes, booklets, an interview, newspaper clippings, wills, a birth certificate, reports, a diary, an invitation, a victory bond, a programme and an honourary degree. Several documents within this subseries are of particular interest. The interview with the Osgoode Society (MS 43 I-1/10) contains a transcript of an interview with Bruce Macdonald, providing insight into his views on particular events throughout his life. In 1981, Macdonald was granted an honourary Doctor of Laws degree by the University of Windsor. The degree and accompanying documents are included within this subseries. Included in the Personal Correspondence files are letters congratulating Macdonald on various appointments as well as a letter awarding him the Croix de Guerre. Also of interest is a diary kept by Dr. William Macdonald during World War I. File MS 43 I-1/21 has restricted access as it contains a signed letter from Winston Churchill. A copy of the letter, however, can be found in MS 43 I-1/20. Researchers interested in Macdonald’s genealogy should consult MS 43 I-1/9 as it contains a history of the Macdonald family in Canada. Photographs have been removed from two files and relocated to the Photograph Collection of the Municipal Archives. Researchers should note that Macdonald transferred several original documents to the National Archives of Canada. These documents pertain to his case before the Department of National Defence in regards to his dismissal as Commanding Officer of the E ssex Scottish Regiment. Copies of these documents can be found in MS 43 I-1/6.

The Education subseries, spanning the years 1924 to 1977, although not inclusively, consists of documents pertaining to Bruce Macdonald’s university education. Although relatively small, this subseries does provide insight into Macdonald’s legal education. Included in the subseries are class notes, correspondence, a report as well as a 1924 University of Alberta yearbook. The Trial of Kurt Meyer

Subseries Description

This subseries contains documents pertaining to Bruce Macdonald’s 1954 book, The Trial of Kurt Meyer. This book provides a first hand account by Macdonald, who was chief prosecutor, into the most publicized Canadian war crimes trial of World War II. Documents within this subseries span the years 1954 to 1983, although not inclusively. Included are drafts and a manuscript of The Trail of Kurt Meyer, book reviews and articles, correspondence, royalty statements and a television script. Of interest in the Correspondence file (MS 43 I-3/2) is a letter from a parent of one of the Canadians executed on Meyer’s command, as well as a letter in which Macdonald discusses his view of Meyer’s sentence. Also included in this subseries is a report containing excerpts from a book Kurt Meyer published in response to The Trial of Kurt Meyer. Researchers interested in the published book itself should consult MS 26, which contains a copy of The Trial of Kurt Meyer. Essex Scottish Regiment

Series Description

This series documents Macdonald’s activity with the Essex Scottish Regiment both during and after World War II. Unfortunately, there is no documentation of his involvement with the Regiment during the pre-war period. Documents within this series span the years 1931 to 1986, although not inclusively. Primarily correspondence, minutes and programmes, these documents illustrate Macdonald’s involvement with the regiment and its various committees and associations. Also included in the series are caricatures, notes, reports, financial documents, a speech, by-laws, lists, certificates, newspaper clippings, a poster, a scrapbook as well as Macdonald’s record of service and medical record booklets. One of the caricatures included in this series was drawn by Charlie Knight, past political cartoonist for the Windsor Star. Researchers interested in other Charlie Knight caricatures should consult MS 44. Of particular interest are the War Correspondence files. Consisting primarily of correspondence between Bruce and his wife, Norma, these files provide invaluable insight into Macdonald’s actions and views during the war. The correspondence also clearly illustrates the relationship shared between Bruce and Norma. Included in the War Correspondence to Bruce Macdonald file (MS 43 II/39) is a letter to all ranks explaining his loss of command in August 1944. Researchers interested in this subject may also wish to consult the Relief of Command file (MS 43 II/26). The Uniform Identification Poster (MS 43 II/31) is of interest as it illustrates for German troops how to identify the uniform of the Essex Scottish Regiment. Also of interest, is a scrapbook (MS 43 II/28) kept by Norma Macdonald of the regiment’s activities during the war. The scrapbook also contains several articles dealing with the Kurt Meyer trial.

Researchers should note that Macdonald transferred several original documents concerning his service with the Essex Scottish Regiment to the National Archives of Canada. These documents pertain to his case before the Department of National Defence to regards to his dismissal as Commanding Officer of the Essex Scottish Regiment. Copies of these documents can be found in MS 43 I/1/6.

This subseries, spanning the years 1944 to 1945, consists primarily of reports prepared by the SHAEF Court of Inquiry for specific war crimes cases. These reports provide detailed information into specific cases of war crimes against Allied troops. Researchers should note that these reports are in fragile condition and must be handled with extreme care. Photographs are contained in two reports and must also be handled with care. Cotton gloves will be provided to researchers that request these reports. Of interest is a Joke Report (MS 43 III-1/4) in which Macdonald is tried and convicted for ‘shooting’ Allied officers with his camera. This subseries also consists of a memo, correspondence, cards and Christmas programmes. The memo (MS 43 III-1/1) is of interest as it appoints Macdonald as President of the Court of Inquiry.

This subseries consists primarily of reports prepared by the No. 1 Canadian War Crimes Investigation Unit into cases of war crimes against members of the Canadian Armed Forces. These reports provide detailed information on war crimes and the investigation into cases. Researchers should note that these reports are in fragile condition and must be handled with extreme care. In cases where two copies of the same report exist, a research copy will be made available to researchers. Maps have been removed from two reports and are stored apart from the collection. Researchers interested in viewing these maps should request them separately. Photographs are contained in two reports and must also be handled with care. Kurt Meyer Trial

Subseries Description

Included in the subseries are numerous reports, correspondence, notes, newspaper clippings and articles, a speech, diaries and copies of “The Maple Leaf”. Of particular interest to researchers are the three volumed Record of Proceedings, which contain detailed information on the Meyer trial. Two copies of these reports exist, with the research copy made available to researchers. These reports are in very fragile condition and must be handled with extreme care. Photographs have been removed from the Volume III research copy (MS 43 III-3/20) and transferred to the Photograph Collection of the Municipal Archives. Researchers wishing to view these photographs must request then by PC/ number.

Maps have been removed from several files and stored apart from the collection. Researchers whishing to view these maps must request them separately. The Committal Order file (MS 43 III-3/6) contains documents referring to the procedure for carrying out Meyer’s execution as well as the lifting of his death sentence. The Kurt Meyer Correspondence (MS 43 III-3/9) contains copies of correspondence Meyer wrote while in prison outlining his life and career. Researchers interested in this aspect of Meyer should also consult the Biography and Interrogation Reports (MS 43 III-3/3). Also of interest are copies of (The Maple Leaf” newspaper, printed for Canadian troops in Europe, which covered the trial in depth. For Macdonald’s first hand account of the trial, researchers should consult MS 43 I-3 which deals with his book The Trial of Kurt Meyer. For a copy of this book, researchers should consult MS 26. Documentation on the Meyer trial is also contained in the Correspondence and Reports files in MS 43 III-2. This subseries documents Bruce Macdonald’s legal career with Wilson, Thomson & Macdonald, including his position as solicitor for Essex County and the Sandwich, Windsor & Amherstburg Railway Co. Unfortunately, un documentation exists for Macdonald’s employment with McLarty & Fraser. Documents within this subseries span the years 1928 to 1953. The majority of the documents pertain to specific cases in which Macdonald was involved. Although primarily correspondence and reports, the subseries also contains notes, plans, certificates, leases, an agreement, a deed, minutes, by-laws, financial statements and newspaper clippings. This subseries documents Bruce Macdonald’s term (April 1951 to October 1961) as Crown Attorney for Essex County. Spanning the years 1940 to 1961, this subseries consists primarily of correspondence and reports. Also included are notes, a script, invitations, programmes, an agenda, a by-law, deeds, plans, a speech ad newspaper clippings. Photographs are included in one report (MS 43 IV-3/8) and must be handled with care. Several files deal with specific cases Macdonald was involved with as Crown Attorney. The Burke Inquest (MS 43 IV-3/2) deals with the investigation into the death of a private at Camp Petawawa. A plan has been removed from this file and stored apart from the collection. Researchers wishing to consult this plan must request it separately. The Le Claire and Whitney Indecent Performance (MS 43 IV-3/13) deals with a raid on the Windsor Armouries for an “immoral performance” at the Essex Scottish Reunion Banquet. County Court Judge

Subseries Description

This subseries, spanning the years 1961 to 1983, contains documents relating to Bruce Macdonald’s career as a Judge of the County and District Courts of Ontario. He was appointed a Judge in October 1961 and remained in the post until having to retire in December 1977. Primarily correspondence and reports, this subseries also consists of newspaper clippings, notes, a certificate, minutes and a transcript. Two cases in which Macdonald presided as judge are documented. The Raymond Denis case (MS 43 IV-4/1) involves a federal government official convicted of attempting to obstruct justice by offering a bribe. The Royal Bank Robbery (MS 43 IV-4/2) involves the theft of $1.1 million from the Royal Bank in Windsor, at that time the largest amount stolen in Canadian history. Two inquiries are also documented within this subseries. The Chatham Municipal Inquiry (MS 43 IV-4/4) was a judicial inquiry into charges that threats and other acts of intimidation were being made against certain past and present members of the Chatham City Council. The Malden Township Inquiry investigated allegations of impropriety in connection with subdivision agreements entered into by the then current and two previous councils of the township. Also documented in this subseries is Macdonald’s activity as president of the County and District Judges Association of Ontario.

This subseries contains documents concerning Bruce Macdonald’s position as Judge of the Small Claims Court. He was appointed in 1978 and remained on the bench into 1986, the year of his death. This series documents Bruce Macdonald’s activities with the Windsor, Leamington and Ontario Police Commissions as well as the Association of Municipal Police Governing Authorities. Unfortunately, no documentation exists for Macdonald’s activities with the Sandwich West and Amherstburg Police Commissions. Documents within this series span the years 1923 to 1978.

Subseries Description

This subseries contains documents relating to Bruce Macdonald’s association with the Windsor Police Commission. The subseries consists primarily of correspondence and reports, but also includes agendas, an agreement, transcripts, notes, a programme, a poster, minutes, plans, newspaper clippings and yearbooks. Plans have been removed from the New Police Building file (MS 43 V-1/20) and are stored apart from the collection. Researchers interested in viewing these plans should request them separately. The Emancipation Day file (MS 43 V-1/6) documents a discrimination case against the Windsor Police Department for not allowing a carnival license to hold Emancipation Day celebrations in Jackson Park. Several inquiries are also documented within this subseries. The Drouillard Road Inquiry (MS 43 V-1/5) investigated allegations of police inactivity in the Drouillard road area. The Essex Scottish Reunion Inquiry (MS 43 V-1/7) investigated a raid on the Windsor Armouries for an “immoral performance” at the Essex Scottish Reunion Banquet. Researchers should see MS 43 IV-3/13 for more documentation on this subject. The Windsor Police Committee of Inquiry Report (MS 43 V-1/27) involves an investigation into the unusually large number of resignations from the Windsor Police Department during 1964. Of interest is the 1977 Windsor Police Annual Report which contains a tribute to Macdonald upon his retirement from the commission. Photographic Material

Series Description

This series consist of 1003 photographs, 35 slides and 31 negatives spanning the years [189-?] to 1985. The photographs have been roughly separated into periods of Macdonald’s life, in much the same way as series I to V. Photographs depict his childhood and family, his university years, the Essex Scottish Regiment and World War II, the Kurt Meyer trial, war atrocities and police ceremonies. In some instances, the negative exists for the photograph. Many of the photographs involving war crime trials are evidence photographs which have been removed from the reports. In such instances, the photographs compliment the textual documents found in the collection. Most of the slides depict emergency rescue procedures, bomb diagrams and damaged buildings. The majority of the photographs, negatives and slides have been removed from the collection and transferred to the Photograph Collection of the Municipal Archives. In those cases where photographs were physically attached to textual documents, they have remained within the files. Photographs in two photo albums have not been removed, however, the albums were transferred to the Photograph Collection. RESEARCHERS MUST NOTE THAT SEVERAL PHOTOGRAPHS DEPICT VERY GRAPHIC IMAGES OF CORPSES, EXHUMATIONS AND CONCENTRATION CAMP CONDITIONS. THESE PHOTOGRAPHS MAY BE CONSIDERED DISTURBING AND SHOULD BE VIEWED WITH DISCRETION.

Series Description

Series eight consists of ephemera material found in the collection during processing. Material within this series span the years 1906 to [197-?]. The material is associated with the life of Bruce Macdonald, or that of his father, Dr. William Macdonald. Ephemera has been divided into textual material and artifacts and have been stored separately. These materials compliment other documents found in the collection and are of interest in their own right.

Subseries Description

This subseries, spanning the years 1919 to [197-?], consists of textual ephemera found in the collection. The majority of the material is associated with World War II. Included are programmes, a menu, books, envelopes, cards, postcards, a booklet, an invitation and a certificate. The postcards have been assigned PC-P/ numbers and transferred to the Photograph Collection of the Municipal Archives. Researchers wishing to view these postcards should request them by their PC-P/ number. Of particular interest are several church programmes regarding services for troops as well as handbooks about the German army. Also of interest is “daag” (MS 43 VIII-1/4), a book containing cartoons involving Canadian troops in Holland. Although some of these materials do not directly involve Macdonald, they do provide insight into the atmosphere during World War II.

Series Description

This series consists of 10 maps dating from the 1940s. Included are maps of several European cities such as Vienna, Paris and London. Also included are several military maps useful to researchers in comprehending where certain events occurred and in understanding troop locations. Biographical sketch: Bruce John Stewart Macdonald was born on 2 December 1902 at Rose Bay, Nova Scotia. He graduated from the University of Alberta in 1924 with a bachelor’s degree and in 1926 with a law degree. In September 1927 he moved to Windsor and practiced law with McLarty and Fraser. From 1930 to 1937 he was Windsor’s first full-time City Solicitor. After resigning as City Solicitor in 1937, Macdonald returned to private practice with McLarty and Fraser. On 16 September 1939 Macdonald married Norma Millard in a ceremony at All Saints’ Church, Windsor. Macdonald was an officer with the Essex Scottish Regiment from 1929 to 1944 and on active service from September 1939 to June 1946. He enlisted with the unit in September 1939 and served as Company Commander and Second-in-Command till May 1943. He was Commanding Officer of the Essex Scottish from May 1943 to July 1944, with the rank of Lieutenant-Colonel and led his regiment during its early fighting in Normandy. In August 1944 he was appointed the Canadian member of the Supreme Headquarters Allied Expeditionary Forces Court of Inquiry on War Crimes. From May 1945 to June 1946 he headed the No. 1 Canadian War Crimes Investigation Unit and was Chief Prosecutor of war criminals for the Canadian Armed Forces. In December 1945 he successfully prosecuted the most famous Canadian war crimes trial, that of S. S. Brigadefuhrer Kurt Meyer. He published a book about the trial, The Trial of Kurt Meyer, in 1954. For his service in World War II, Macdonald was awarded the Order of the British Empire (OBE), the Croix de Guerre (France) and the Efficiency Decoration. In 1946 he was appointed Kings Counsel and returned to private practice in Windsor with Wilson and Thomson. On 1 April 1951 he was appointed Crown Attorney for Essex County. That same day he became a member of the Windsor Police Commission and would eventually become its chairman. Macdonald was also a member of the Sandwich West, Leamington and Amherstburg police commissions, as well as president of the Association of Municipal Police Governing Authorities of Ontario. In October 1961 he was appointed a Judge of the County and District Courts of Ontario with residence at Windsor. He took a leave of absence from this position between April 1962 and February 1964 to become the first chairman of the Ontario Police Commission. After retiring as a Judge of the County in December 1977 he became a Judge of Small Claims Court, a position he held into the year of his death. Macdonald was very active in community service and during his life was involved with several organizations, including the Rotary Club, Windsor Symphony Society and United Nations Organization. Bruce Macdonald died in Windsor on 2 June 1986.

Custodial history: The documents within this fonds were donated to the Windsor Municipal Archives by Norma Macdonald and William Willson in 1988. The records were stored in the basement of the Macdonald’s home at 2060 St. Mary’s Gate, Windsor.

Several original documents concerning Macdonald’s service with the Essex Scottish Regiment have been transferred to the National Archives of Canada. These documents pertain to his case before the Department of National Defence in regards to his dismissal as Commanding Officer of the Regiment. Copies of these documents can be found in MS 43 I-1/6. One file has restricted access as it contains a signed letter by Winston Churchill. A copy of the letter is made available to researchers. MS 43 I Private Life

Scope and content: Documents within this series highlight the private life of Bruce Macdonald. The series relates to Macdonald’s family and personal life, his education at the University of Alberta and Harvard University, his community service activities as well as the development of his book, The Trial of Kurt Meyer. Documents within this series pertain to Macdonald’s life in Windsor, Nova Scotia and Alberta. The series is divided into four subseries.

The first subseries, Family and Personal Files, contains documents relating to Bruce Macdonald’s family and personal life. Although primarily correspondence, this subseries contains a wide variety of documents. Included in this subseries are contracts, a calendar, certificates, notes, booklets, an interview, newspaper clippings, wills, a birth certificate, reports, a diary, an invitation, a victory bond, a programme and an honourary degree.

The second subseries, Education, consists of documents pertaining to Macdonald’s university education. Included in this subseries are class notes, correspondence, a report as well as a 1924 University of Alberta yearbook.

The third subseries contains documents pertaining to Bruce Macdonald’s 1954 book, The Trial of Kurt Meyer. This book provides a first hand account by Macdonald, who was chief prosecutor, into the most publicized Canadian war crimes trial of World War II. Included are drafts and a manuscript of the book, book reviews and articles, correspondence, royalty statements and a television script.

The fourth subseries, Community Service, documents Macdonald’s involvement with a variety of clubs and organizations. Consisting primarily of correspondence, certificates and speeches, this subseries also includes lists, reports, minutes, a constitution, newspaper clippings and programmes.

MS 43 II Essex Scottish Regiment

Date(s) of creation: 1931-1986

Extent of descriptive unit: 20.5 cm of textual records

Biographical sketch: Bruce Macdonald joined the Essex Scottish Regiment in 1929 as a militia officer. He enlisted in September 1939 for overseas service and acted as Company Commander until 1942. During parts of 1942 and 1943 he was second in command of the Regiment. He served as Commanding Officer from 27 May 1943 to 22 July 1944, with the rank of Lieutenant-Colonel and commanded the Regiment in early fighting in Normandy. He was demobilized in June 1946. For his service during the war, Macdonald was awarded the Order of the British Empire, the Croix de Guerre (France) and the Efficiency Decoration.

Scope and content: The series documents Macdonald’s activity with the Essex Scottish Regiment both during and after World War II. Macdonald’s experience in World War II is documented as well as his involvement with the Regiment and its various committees and associations. Documents pertain to the Regiment’s activities in Windsor as well as in Europe during World War II. Documents within the series are primarily correspondence, minutes and programmes. Also included are caricatures, notes, reports, financial documents, a speech, by-laws, lists, certificates, newspaper clippings, a poster, a scrapbook, as well as Macdonald’s record of service and medical record booklets.

MS 43 III War Crimes

Biographical sketch: From August 1944 to May 1945 Bruce Macdonald was the Canadian representative on the Supreme Headquarters Allied Expeditionary Forces (SHAEF) Court of Inquiry on War Crimes. During this time, Macdonald traveled throughout Europe investigating reports of offenses against Allied troops taken prisoner by the German Armed Forces. He would later serve as president of the court for three months, beginning in February 1945. In May 1945 the No. 1 Canadian War Crimes Investigation Unit was established, as the SHAEF Court of Inquiry was dissolved at war’s end and Macdonald appointed its Commanding Officer. Macdonald also acted as Chief Prosecutor of war criminals for the Canadian forces.

Scope and content: This series documents activities surrounding the war crime trials held in Germany during 1945 and 1946. Various trials are documented, including that of S. S. Brigadefuhrer Kurt Meyer, involving war crimes against Canadian and other Allied troops. Also included is documentation pertaining to the legal aspects of war crime trials. The series is divided into four subseries.

The first subseries, Supreme Headquarters Allied Expeditionary Forces (SHAEF) Court of Inquiry, consists primarily of reports prepared by the SHAEF Court of Inquiry for specific war crime cases. Also included in the subseries is a memo, correspondence, cards and Christmas programmes.

The second subseries, No. 1 Canadian War Crimes Investigation Unit, consists primarily of reports into cases of war crimes against members of the Canadian Armed Forces. Also included are other reports, correspondence and minutes.

The third subseries, Kurt Meyer Trial, contains documents pertaining to the trial of S. S. Brigadefuhrer Kurt Meyer. Included in the subseries are numerous reports, correspondence, notes, newspaper clippings and articles, a speech, diaries and copies of “The Maple Leaf”.

War Climes Documentation, the fourth subseries, consists primarily of reports and journals dealing with the legal aspects of war crimes. Also included in the subseries is an agreement, a French book on concentration camps, a video in which Macdonald lectures a law of war course and proceedings of a war crimes trial.

MS 43 IV Legal Career

Date(s) of creation: 1928-1986

Extent of descriptive unit: 75.5 cm of textual records and 8 architectural drawings

Biographical sketch: Upon moving to Windsor in 1927, Macdonald joined the law firm of McLarty & Fraser. He remained with them until his appointment as Windsor’s first full-time City Solicitor in September 1930. In 1937, Macdonald resigned as City Solicitor amidst controversy. He returned to practicing law with McLarty & Fraser and remained there until the outbreak of World War II. After returning from active service in 1946, Macdonald was appointed King’s Counsel and joined Wilson, Thomson & Macdonald. While at this firm, Macdonald acted as solicitor for Essex County as well as the Sandwich, Windsor & Amherstburg Railway Co. On 1 April 1951 he was appointed Crown Attorney for Essex County. He was appointed a Judge of County and District Courts of Ontario with residence at Windsor in October 1961. After retiring from this appointment in December 1977, he was made a Judge of Small Claims Court. He remained in this position into 1986, the year of his death.

Scope and content: This series contains documents pertaining to the legal career of Bruce Macdonald. The majority of the documents relate to the Windsor and Essex County area. The series is divided into five subseries.

The first subseries, Private Practice, documents Macdonald’s legal career with Wilson, Thomson & Macdonald, including his position as solicitor for Essex County and the Sandwich, Windsor & Amherstburg Railway Co. The fourth subseries, County Court Judge, contains documents relating to Macdonald’s career as a Judge of the County and District Courts of Ontario. Primarily correspondence and reports, this subseries also consists of newspaper clippings, notes, a certificate, minutes and a transcript.

The fifth subseries, Small Claims Court Judge, documents Macdonald’s position as Judge of the Small Claims Court. Consisting primarily of judges books, the subseries also contain a certificate, correspondence and newspaper clippings.

MS 43 V Police Commissions

Biographical sketch: In April 1951 Bruce Macdonald became a member of the Windsor Police Commission and would later serve as its chairman. He was also a member of the Sandwich West, Leamington and Amherstburg Police Commissions. Macdonald took a leave of absence from the Judge’s bench in April 1962 to become the first chairman of the Ontario Police Commission. He returned to the bench in February 1964. Macdonald also served as president of the Association of Municipal Police Governing Authorities.

Scope and content: The series documents Macdonald’s activities as a member of the Windsor, Leamington and Ontario Police Commissions as well as the Association of Municipal Police Governing Authorities. The series is divided into four subseries: Windsor Police Commission; Leamington Police Commission; Ontario Police Commission; and Association of Municipal Police Governing Authorities. The majority of the documents are correspondence and reports, however, the series also includes agendas, an agreement, speeches, transcripts, notes, a programme, a poster, minutes, plans, newspaper clippings and yearbooks.

MS 43 VII Photographic Material

Scope and content: This series consists of photographs, slides and negatives maintained by Macdonald throughout his life. Photographs depict Bruce Macdonald’s childhood and family, his university years, the Essex Scottish Regiment and World War II, the Kurt Meyer trial, was atrocities and police ceremonies. Material pertains to Windsor and Essex County, Nova Scotia, Alberta, France, Germany and Italy. In some instances, the negative exists for the photograph. The majority of the slides depict emergency rescue procedures, bomb diagrams and buildings damaged during World War II.

Note(s): The dates of creation are not inclusive. Photographs have been roughly arranged into periods of Macdonald’s life, in much the same way as series I to V. The majority of the photographs, slides and negatives have been removed from the collection and relocated to the Photograph Collection of the Windsor Municipal Archives. In those cases where photographs were physically attached to textual documents, they have remained within the files. Photographs in two photo albums have not been removed, however, the albums were transferred to the Photograph Collection. Finding aid contains a listing of all photographs, slides and negatives. The majority of the textual material is associated with World War II. Included in the series are programmes, a menu, books, envelopes, cards, postcards, a booklet, an invitation, a certificate, pins, medals, button covers, wallets, signs, a locket, a bracelet and a lock of Bruce Macdonald’s hair.
