1. Per my records and Ariel Photos it appears there have been some additions and changes to the structure sometime between 1984 and 1993. You will need to either submit a copy of an approved permit for these changes from the Permit Office or you will need to apply for a new building permit for the work that was completed illegally. You may contact Mike Stripling with the Permit Office for a “Freedom of Information Act” request form to do research on the property at 301-883-5888 to see if prior permits exist. 03-24-11 Comment Satisfied. Per further conversation with my supervisor Debbie Gallagher a separate building permit will not be required since the illegal additions where constructed sometime between 1984 and 1993. The copies of the two building permits that have been submitted are for, #3872-1982-CGU-01 for the open pavilion for outdoor seating to include 50 seats and #429-1985-CE for a fire damage to replace in kind. 2. The latest permit #3872-1982-C was for a pavilion on slab only for additional seats for the existing restaurant. Per the site plan submitted it appears the pavilion has been enclosed and now a basement exists. When did this work take place? Proof of a building permit will be required for this or one will be required. 03-24-11 See satisfactory comment #1 above. Not Required. BEL

3. Need to revise the site plan to demonstrate the width of the entrance and all drive aisles. 03-24-11 Comment Partially Satisfied. Need to clearly demonstrate the entrance width from the parking space to the curb. The 45’ entrance appears to include the entire parking space. This is not acceptable. 4. Need to revise the site plan to demonstrate the dimensions of all parking spaces. Need to also clarify the handicap spaces for the 16’x19’ van accessible space and the 13’x19’ car accessible handicap spaces. 03-24-11 Comment Still Outstanding. The parking spaces are not scaling to required dimensions. Standard nonparallel parking spaces are 9.5’x19’ and standard parallel spaces are 8’x22’. Also you are required at least two handicap spaces of which one must be 16’x19’ and the other may be the same or 13’x19’. All 5 provided handicap spaces must scale at these sizes. 5. Need to revise the site plan to demonstrate a parking schedule for the church. This needs to include the total number of seats and if any other use will operate at this site. The parking ratio for a church is 1 space for every 4 seats. Also need to demonstrate the total number of spaces required and provided and how many of each size space you will be providing. Make sure the number of spaces provided in the parking schedule match what is demonstrated on the plan. 03-24-11 Comment Partially Satisfied. Need to include in the parking schedule the required parking ratio of 1 space for every 4 seats at 188 seats equals 47 spaces required, and need to include in the parking breakdown of how many nonparallel spaces at 9.5’x19’, parallel at 8’x22’ and handicap spaces at 16’x19’ and 13’x19’ the site will contain. Need to also add a note if any other uses will operate at the same time and if so then you will need to include that use in the parking schedule as well. BEL. 04-12-11 Comment Satisfied. All spaces are delineated and no other uses will operate at the same time as the church. BEL

6. Need to revise the site plan to clearly demonstrate the 5 parking spaces at the front of the building. I am only counting 4 spaces. 03-24-11 Comment Partially Satisfied. It appears only 4 spaces will be provided at the front of the property but all spaces must be dimensioned and to scale at 9.5’x19’ for the nonparallel spaces and 13’x19’ for the handicap spaces. 04-12-11 Comment Satisfied. 7. Need to revise the site plan to demonstrate the setback from the building to all property lines to demonstrate conformance with the C-A zone. 03-24-11 Comment Partially Satisfied. All of the setbacks are shown but it appears that 10’x33.2’ structure at the rear of the building will not meet the required 12’ setback. Need to either remove, relocate or apply for a Variance with the Board of Zoning Appeals at 301-952-3220. If you will apply for the Variance then once it has been approved you will need to forward me a copy of the approved decision. BEL. 04-12-11 Comment Satisfied. Per the revised site plan the portion of this building that is located within the setback will be removed. BEL

8. Need to revise the site plan to demonstrate the right-of-way width and include the centerline. 03-24-11 Comment Satisfied. R/W shown. BEL

9. Need to revise the site plan to add a note under the General Site Note section for the use/uses and number of seats. 03-24-11 Comment Partially Satisfied. 11. Need to revise the site plan to correct the lot size and acreage to match Plat 102@27. 03-24-11 Comment Still Outstanding. The square footage of Parcel “B” per Plat 102@27 is 41,898 sq. ft. or 0.9618 Acres, you do not include the Dedicated area per the plat at the front of the property. Need to correct the square footage and acreage on the site plan and in the general notes. BEL. 04-12-11 Comment Satisfied. Site plan revised. BEL

12. Need to submit a Landscape Plan in conformance with the new Landscape Manual that was adopted on 12-13-10. The landscape plan must be signed and sealed by a licensed State of MD landscape Architect. Need to comply with all required sections. If any of the required sections cannot be met then you will need to contact Lisa Chapman at 301-952-5541 for information on the Alternative Compliance process. 03-24-11 Comment Stands. The landscape plans must be signed and sealed by a licensed State of MD landscape architect and must be in conformance with Section 4.2, 4.3, 4.4, 4.7, and 4.9 of the 12/13/10 newly adopted landscape manual. It does appear that Alternative Compliance will be required for Section 4.7 of the landscape manual for the required building setback and landscape yard width of a “C” buffer. Also per prior comment #7 above instead of applying for a Variance with the BOA office the setback issue of the existing structure can be included in the Alternative Compliance review if you will keep the building in this location. You will need to contact Lisa Chapman at 301-952-5541 for more information on the AC process. BEL. 03-31-11 Comment Updated. Per meeting with Susan Lareuse, Alan Hirsch, and Steve Adams it has been determined that the site is exempt from landscaping per Section 1.1(d) since this permit is for interior work and a new use only. However you must demonstrate the prior required landscaping from the 1982 plan which consisted of a 6’ perimeter strip around the entire property, a 10’ landscape strip along the street, interior islands and the landscaping within the islands. You must also include a landscaping plant list, no landscape schedules are required. You may obtain a copy of the site/landscape plan, permit #3872-1982-CGU-01, at the Park & Planning Information Service Office on the lower level at the address above. BEL. 04-12-11 Comment Satisfied.
