GOLF CARTS USE POLICY

ON CITY STREETS

BE IT RESOLVED by the City Council of Janesville, County of Waseca, State of Minnesota, under authority provided in Minn. Stat. § 169.045, that:

A Resolution regulating the use and operation of motorized golf carts on designated roadways under the City's jurisdiction be and hereby is established as follows:

SECTION I - PURPOSE

1) The purpose of this Resolution is to provide authority for the use of more fuel efficient and cost effective vehicles on city roads. The Resolution establishes standards and permitting the use of such vehicles on designated roadways within its jurisdiction pursuant to the authority granted by Minn. Stat. § 169.045.

SECTION II - AUTHORITY and PERMIT

2) Authorization to operate a motorized golf cart shall be by permit only. A permit shall be issued to the owner of a motorized golf cart or who has a valid Minnesota Driver’s License. Applications for permits shall be completed and reviewed by the Police Chief and City Administrator. Upon permit approval, permits shall last for 12 months and renewed annually. All approved permit information will be forwarded to the Waseca Sheriff Office.

SECTION III – JANESVILLE CITY CODE PROVISIONS

3) All provisions of Chapter 70.07, sections B, C, D, E, and F apply for golf cart use when not driving directly to Prairie Ridge Golf Course.

SECTION IV – RIGHTS AND DUTIES

(4.1) Every person operating a motorized golf cart under permit on designated roadways has all the rights and duties applicable to the driver of any other vehicle under the provisions of Minn. Stat. Chapter 169, except when those provisions cannot reasonably be applied to the vehicle.

(4.2) Motorized golf carts may only be operated on designated roadways from sunrise to sunset. Motorized golf carts may not be operated in inclement weather or when visibility is impaired by weather, smoke, fog, or other conditions, or at any time when there is insufficient light to clearly see persons and vehicles on the roadway at a distance of 500 feet.

(4.3) Motorized golf carts shall display the slow-moving vehicle emblem provided for in Minn. Stat. § 169.522 and a rear view mirror.

(4.4) Owners and operators of golf carts shall carry liability insurance coverage

pursuant to MN Statute 65B.48, Subdivision 5.

5) The golf cart operator shall have a valid permit, be at least 18 years of age and not had

their driver’s license revoked as a result of criminal proceedings.

(4.6) The operator shall be subject to all traffic resolutions, laws and State statutes.

(4.7) The number of occupants shall not exceed the design occupant load.

(4.8) No operation shall be permitted on private property, without the consent of the owner, or on any city sidewalk, trail or park.

(4.9) No United States or State of MN road shall be a designated roadway for golf carts; however the operator, under permit, may cross any street or highway intersecting a designated roadway.

SECTION V - SEVERABILITY

5) The provisions of this Resolution shall be severable. Should any section, paragraph, sentence, clause, phrase or portion of this regulation be declared invalid for any reason, the remainder of said regulation shall not be affected and the remainder of the provisions shall remain in full force and effect.

SECTION VI - PENALTIES

6) Violations of this Resolution shall be petty misdemeanors, except for any State or Federal law which would follow the penalties set forth by Statute. A violation of this policy within twelve (12) months of a conviction for a prior violation of this policy shall be a misdemeanor and shall result in revocation of the violator’s permit to operate the motorized golf car on designated roadways for a period of twelve (12) months following conviction.

SECTION VII – ADOPTION OF RESOLUTION AND EFFECTIVE DATE

7) These regulations and policy shall be in full force and effect upon adoption.
