PURPOSE:

The purpose of this policy is to clearly define the organization’s expectation regarding pre-employment drug testing.

POLICY:

Each applicant for employment will be required as a condition of employment to undergo a urine drug screen. Applicants will be asked to read the policy and sign the Pre-Employment Offer and Employee Consent to Alcohol and Drug Screening.

PROCEDURE:

If an applicant tests positive and is determined to be in violation of this policy, the applicant will be ineligible for employment until: (a) the expiration of 12 months following the date of the test; and (b) the applicant submits to a second urine drug screen which does not disclose that the applicant is in violation of this policy. If an applicant as described above is hired, another urine drug screen test may be conducted within sixty (60) days following the date of employment and the employee may be subjected to unannounced drug testing for the first twelve (12) months as a condition of employment. Thereafter, the employee will be subject to testing, the same as current employees.

It is preferred that a new employee be tested prior to reporting for work. However, it is realized that under certain circumstances a new employee may start before test results are known. In such circumstances the employee's hiring is conditional upon passing the drug test.

All employment offer letters are to contain a statement that employment is conditional upon passing a drug test. Employees will be required to read and sign the Pre-Employment Offer and Employee Consent to Alcohol and Drug Screening immediately prior to the first day of employment.

PRE EMPLOYMENT OFFER AND EMPLOYEE CONSENT TO ALCOHOL AND DRUG SCREENING

On this day, a copy of the NVH Drug and Alcohol Policy was made available to me. Consistent with that policy, I have been requested by NVH to submit to a screening test for illegal drugs, illegally used legal drugs and/or alcohol which includes the collection of blood, urine and/or breath samples and other necessary medical tests to determine the presence or use of alcohol, drugs or controlled substances. I also understand that in the event I become a NVH employee, I may be subject to future for cause testing in accordance with the Drug and Alcohol Policy.

I hereby voluntarily consent to provide NVH with samples of blood, urine, and/or breath for such purpose at laboratories designated by NVH. I consent to having specimens tested at the selected laboratories. Further, I certify that the specimen collected from me will be mine and will not be adulterated or altered in any manner.

The tests will be used to detect the presence of the following substances, in addition to other substances for which NVH may be required to test for under Federal or State law or contractual agreement:

• Alcohol, Cocaine, Metabolites, Methadone

• Amphetamines, Hallucinogens, Phencyclidine (PCP)

• Benzodiazepines

• Barbiturates

• Marijuana (cannabinoid metabolites)

• Propoxyhene (Darvon)

• Opiate derivatives (morphine, codeine)

I understand that all screening tests for drugs will be subject to careful testing procedures with mandatory confirmation of any preliminary positive tests. I further understand that if my test indicates a confirmed positive for illegal drugs, I will not be considered for employment, or in the event I am an employee at the time of the test I may be subject to discipline including termination, in accordance with the Drug and Alcohol Policy. I will be given reasonable opportunity to explain confirmed positive test for substances other than illegal drugs. If I provide an unacceptable explanation I will be denied employment.

I understand that I may request a copy of any tests taken, as part of the screening tests upon receipt of the results by NVH’s Director of Human Resources, from the laboratory.

I understand the results of these tests and other relevant medical information may be used for employment decisions. I hereby authorize the designated laboratory to release results to NVH’s Director of Human Resources. I further agree to hold NVH, its agents, officers and employees harmless from, and waive all claims existing and future for any, and all liability (including negligence) arising in connection with the testing for drugs and/or alcohol.
