The way gasoline prices are jumping up you think we are having a gasoline shortage. Any kind of negative news; the oil companies increase prices. Once again, Oil Company GREED has taken over the industry.

High oil inventories and a weak demand does not justify gasoline price spikes. From April 24th to June 19th, wholesale gasoline increased approximately 66 cents a gallon while crude oil increased approximately14 dollars a barrel. Of the 42 gallons refined from a barrel of crude oil, 19.5 gallons is gasoline and for each $1 increase per Pat Moricca barrel of crude oil is equivalent of a 2.4 cent a gallon increase for gasoline. Prices for gasoline have increased faster than crude oil prices according to Energy Information Administration (EIA).

Each time gasoline prices rise, the consumer should drive less and maybe OPEC and the oil companies will get the message.

Big Oil Cozies Up to Ethanol, Biofuels

Jennings, La. -- Once arguing against ethanol's potential to solve the country's energy program, big oil companies are now warming up to biofuels technology. BP, for example, is now working at an experimental ethanol plant here, helping to make it more efficient, according to a report in The New York Times.

Oil companies and farmers are gradually learning to get along, as refiners see a need to become involved in ethanol production, the newspaper reported. Ethanol, made chiefly from corn, now represents approximately 9 percent of the country’s market for liquid fuels. Federal mandates are spurring an increase in that number.

The refiners' interest is coming in the nick of time for small ethanol firms that need capital and cannot find it in the private markets, according to The New York Times. Verenium Corp. for example, is partnering with BP here to test new forms of biofuels made from grasses in the sugar cane family.

The experiments are preparation for building a second, $250 million plant in Florida with the capacity to produce 36 million gallons of biofuels each year, the first commercial plant of its type built with oil company money and expertise.

"Any time you get Big Oil into the game, that changes the paradigm because nobody can go large scale chemical engineering like Big Oil," Brent Erickson, an executive vice president of the Biotechnology Industry Organization, told the newspaper.

2,000th E85 Site Milestone

Davie, Fla. -- The Renewable Fuels Association (RFA) celebrated the grand opening of the United States' 2,000th E85 fueling station last Thursday. The Griffin U-Gas station is located in the community of Davie, Fla., just north of Miami.

The expansion of the ethanol industry is allowing small communities all across the United States to benefit from the new jobs and economic opportunities the production of renewable fuels offers, the association said.

"Expanding ethanol production outside the traditional 'Corn Belt' is vital to setting America on the road toward energy independence," said RFA president Bob Dinneen. "Increasing the production and use of ethanol in places like Florida is helping provide stability to our motor fuels market against the volatile and costly nature of the world oil market. Congratulations to Griffin U-Gas, Urbieta Oil, Protec Fuel Management and the people of Florida on the opening of the 2,000th E85 station and for their commitment to helping set America on a path toward greater energy independence."

Florida Agriculture & Consumer Services Commissioner Charles H. Bronson, whose "Farm to Fuel" initiative is designed to produce renewable energy from Florida-grown crops, agricultural wastes and residues, and other biomass, , said, "As ethanol and other renewable fuels become more widespread, the demand for the biofuels produced on our farms and ranches will only increase. It will reduce our dependency on foreign oil and give agricultural producers in Florida alternative crops to keep their farming operations viable."

E85 is a blend of 85% ethanol and 15% gasoline and can only be used in flex-fuel vehicles (FFVs). There are nearly 8 million FFVs on the road today, the group said.

With gasoline prices on the rise, some analysts predict that consumers will pull back from spending once again!

Houston June 10, 09– Just in time for the heavy summer driving season, gasoline prices are increasing, rising 41 consecutive days to reach a national average of just under $2.62 a gallon, the New York Times reports. In the Midwest, problems at refineries are to blame for high pump prices. For example, Michigan, hit hard with unemployment, now has an average price of $2.93 per gallon the highest in the nation.

The cost of gasoline has jumped 62 percent since December, 08 and is threatening to put the brakes on a modest recovery fueled by consumer spending on apparel and electronics, among other items. While prices are far below last summer’s $4-plus gallon of gasoline, economists point out that recent advancements in pump prices could become a hindrance to economic growth.

Some analysts, looking at high oil inventories and a weak demand, are mystified by the pump price advancement. “I’m scratching my head,” said Adam Sieminski, chief energy economist at Deutsche Bank.

Shell's Gas Station Lease Dispute Hits Supreme Court

Houston -- The U.S. Supreme Court will rule in a case involving Shell Oil Co. to determine how much leverage oil companies have to change lease agreements with independent service station owners, Bloomberg News reported.

A group of Massachusetts gas station owners sued Shell and Motiva Enterprises LLC, charging the company with using rent increases to try to end franchise arrangements so the companies could take over operation of the stations, according to the report.

The station owners won a $3.3 million jury verdict, but a federal appeals court upheld part of the award, and both sides appealed to the Supreme Court, the report stated. The Supreme Court justices agreed to see the case at the suggestion of the Obama administration, which backs Shell and Motiva on the legal issues.

The case involves the U.S. Petroleum Marketing Practices Act, a 1978 law that gave independent station owners a level playing field in dealings with oil companies? The station owners are suing under provisions in the law barring improper lease terminations, but Shell and Motiva contend the station owners can’t cite the provisions since they accepted new lease terms and continued to operate the franchises. What the oil companies fail to mention is that the stations owners had no choice, either they’d sign or non-renewal for lack of agreement from both parties. Shell would not negotiate and knew that it would force the station owners to sign under duress.

The case includes eight of more than 50 Massachusetts station owners pressing lawsuits. The station owners objected to a decision to phase out a rent subsidy that was tied to gasoline sales and instead, calculate rent based on the real estate value.

Washington Update

Both the House and the Senate heard testimony on the issue of oil speculation and the lack of any real oversight. There is no doubt that the recent run-up in crude oil prices is a direct result of manipulation. Also, there was legislation introduced addressing credit card fees. The Fair Free Credit Act (HR 2695) was introduced in the House. The legislation would allow retailers to collectively negotiate with banks for the cost of certain credit card fees. In 2001, MasterCard and Visa received approximately $16 billion in fees; that figure rose to roughly $48 billion last year and that marked a 189% increase since 2001.

The fees are based on a percentage of total sales including taxes and account for one of the highest part of gasoline station’s operating cost. When the gasoline prices continue to climb, fees continue to climb including consumer credit card use.

In Florida, the fees have become so outrageous, that at least four counties Brevard, Marion, Osceola and Walton have simply refused to accept Visa for tax payments. The reason offered for this change is that officials did not want to have to charge their citizens fees for using the cards. Statements further went on to say it was ultimately a way to save their taxpayers money. It will be interesting to see how Visa responds.

No Visa Allowed 

A Florida tax collector’s office refuses to accept Visa credit or debit cards to avoid paying processing fees.

Ocala, Fla. – The Marion County Tax Collector’s office in Florida has given Visa the boot, refusing to accept the credit or debit card for payments to avoid paying processing fees, reports. As of May 1, the office no longer allows residents to pay with Visa plastic.

Tax Collector George Albright said he wanted to keep taxpayers from paying “convenience fees” that credit and debit card issuers charge for the privilege of using their cards. Customers using Visa to pay for their property tax bills or fishing licenses were assessed a 2.95 percent surcharge on the transaction amount, which the firm processing the payments paid.

However, in March, Visa informed Albright that his vendor would no longer be allowed to assess the surcharge. Last year, county residents used debit and credit cards to pay $9.3 million, with processing fees reaching approximately $285,000, according to Steve Barker, the tax collector’s information technology director. Seventy-five percent of those transactions used Visa.

If the tax office continued to accept Visa, the county would pay approximately $214,000 in processing fees. Residents can still pay using other debit and credit cards.

Visa spokesman Ted Carr responded in a statement, saying, “Visa generally does not allow merchants to impose a surcharge to consumers to cover the cost of accepting payment cards. These fees do nothing more than shifts the cost of doing business onto consumers.”

The continuing burden of interchange, or swipe fees on small business owners has become heavier and heavier to bear. It is the second largest expense behind payroll.

The newspaper writes that convenience store owner Bruce Mitchell said his operation paid out more than $3 million in credit card fees last year. “I am paying 25 percent more for credit card fees than I pay in wages,” he said.

Washington –The Senate Majority Whip Richard Durbin (D-IL) introduced S. 1212, the Credit Card Fair Fee Act, legislation that seeks to address the more than $48 billion that Americans annually pay in credit card swipe fees.

Credit card swipe fees called “interchange fees” by the big banks that set these rates are a percentage of each transaction that Visa and MasterCard and their member banks collect from retailers every time a credit or debit card is used. These fees average about 2 percent in the United States, the highest rate in the industrialized world.

In 2008, credit card fees cost U.S. convenience stores $8.4 billion compared to only $5.2 billion in store profits, according to NACS data. Almost all of these credit card fees are attributable to credit card swipe fees.

How Time Has Changed The Gasoline Industry For The Franchise Dealer

In 1959, I started my career in the gasoline station business in Paramus N. J., moved to a Paterson N. J. Cities Service station that eventually became Citgo. I sold my station in 1978 and moved to Florida and settled in a Longwood Sunoco gasoline station and became a member in the Florida association. I was a member of the NJGRA, Jerry Ferrara was the Executive Director.

For many years, the Oil Company’s contracts were simple and short. Today they are overloaded with legal regulations and restrictions that only an attorney can understand and heavily loaded in favor for the Oil Companies and very long!

For many years we were treated like customers and something happened along the way that changed the Oil Company and dealer relationship. We were no longer a customer; we became a number. I could never understand the change in attitude towards their dealers who worked very hard and sacrificed to be successful from the Oil Companies. The relationship seemed to change overnight from cooperation and friendship to xycz€&§=0.

After 35 years I retired in 1994 and live in Florida and run the independent dealer association here.

Jack Gets Out of the Box

San Diego -- Jack in the Box Inc. entered into a purchase and sale agreement for 55 of its 61 Quick Stuff convenience stores and gas stations.

The quick-serve restaurant chain announced its intent to sell the convenience chain in October 2008. The company expects the all-cash transaction to close by the end of its fiscal year, ending Sept.27, 2009, the company stated. Ray Cleeman, president of SMJ Capital Advisors LLC, was the exclusive financial advisor to Jack in the Box for the sale of Quick Stuff. It expects to complete the sale of those locations by the end of the current fiscal year as well.

"The board and management of Jack in the Box agreed that by selling Quick Stuff, we can focus on maximizing the potential of our Jack in the Box and Qdoba brands," Linda Lang, chairman and chief executive officer, said, in a statement. "We appreciate the dedication of all of our Quick Stuff employees, and will look to them to assist in a smooth transition during this process."

Executive Order 09-126 is in effect (severe weather)

The Executive Order expires July 22. This is the only Order currently in affect.

Executive Order 09-126 was issued on May 22 due to severe weather including heavy rainfall and flooding.  Counties affected are Brevard, Clay, Duval, Flagler, Lake, Nassau, Orange, Putnam, Seminole, St. Johns and Volusia. Florida Statute, Section 501.160 (price gouging) is in affect.  This EO will expire July 22.

Executive Order 09-114 was rescinded June 9, 2009.

Warehouse club offers discounts, support, more for independent c-store owners

Bentonville, Ark. -- Sam's Club said it is supporting independent convenience store owners during their busiest time of year through its launch of the "100 Days of Summer" program and a special membership offer designed to help c-store owners make a profit. The Sam's Club $15 membership a savings of $20 is available for purchase May 22 though June 5, and valid through Labor Day.

With more than 25 years of experience helping small businesses succeed, Sam's Club is qualified to help independent c-store operators maximize profits in today's uncertain economy, the Bentonville, Ark.-based warehouse retailer said. A real help for convenience stores will be for Sam’s Club to stop selling gasoline below retail gasoline stations.

U.S. Senator Targets Speculation 

Sen. Sanders proposes a bill that would require the FTC to eliminate “excessive speculation.”

Washington – In an effort to diminish the risk of an energy pricing bubble, U.S. Sen. Bernie Sanders (I-VT) introduced a bill earlier this month that would require the U.S Commodity Futures Trading Commission to eliminate “excessive speculation,” the Bureau of National Affairs reports.

Sanders wrote a letter to congressional colleagues on June 10 summarizing the proposal, stating that the recent increase in gasoline prices was “largely driven by excessive speculation” and not by supply and demand economics.

“The last thing the middle class needs right now is to be ripped-off at the gas pump this summer because speculators on Wall Street some of the same people who received the largest taxpayer bail-out in U.S. history are allowed to jack-up oil prices through manipulation and outright fraud,” Sanders said. As such, his Energy Market Manipulation Prevention Act (S. 1225), since referred to the Agriculture Committee.

The run-up to $140 per barrel crude oil last year led many in Congress and throughout the nation to question the impact of speculative investment on commodities markets and to consider whether to increase regulations governing such behavior.

The Financial Crimes Enforcement Network (FinCEN) today announced the launch of FinCEN Updates – a new, free

e-mail subscription management service designed to keep the financial industry, the media and the public informed of news, rulemakings, advisories and other developments at FinCEN. This new secure e-mail subscription management service permits users to customize their updates, which enables them to receive e-mails related to the topics to which they have subscribed.

FinCEN Updates allows users to choose their subscription preferences. Subscription items include advisories, guidance, news releases, rulings, enforcement actions, and current career opportunities at FinCEN. Users can add or delete subscription items themselves, and have the option to password protects their accounts for increased security.
