2009 Pearson Student Media Online Survey Drawing

Official Rules

NO PURCHASE NECESSARY. SWEEPSTAKES OPEN ONLY TO LEGAL RESIDENTS OF THE U.S. AGED 18 OR OLDER.

To Enter:

The 2009 Pearson Student Media Online Survey Drawing ("Drawing") begins on November 18, 2009 and ends on December 31, 2009, at 11:59 p.m., (ET) ("Drawing Period"). You will be automatically entered into the Drawing when you complete the Student Media Survey form (including all mandatory questions) located at and clicking on the "Submit" button upon completion. All submissions become the exclusive property of Pearson Education and will not be returned. You understand that, by submitting an Student Media Online Survey, you are accepting the terms of these Official Rules and agreeing to be bound by them. You will be entered into the Drawing for each Student Media Online Survey submitted in accordance with the Official Rules.

Eligibility:

The Drawing is open to legal residents of the 50 United States and the District of Columbia, who are 18 years of age or older at the time of entry. The following persons are not eligible to enter the Drawing: (a) employees and officers of any organizations directly involved with this promotion, including any co-sponsor of the Drawing; (b) employees of Pearson Education, Inc., its affiliates and subsidiaries; and (c) immediate family members and persons living in the same household as the persons identified in (a) and (b) above. Only entrants logging onto the Internet from within the 50 United States and the District of Columbia are eligible to enter the Drawing. Void where prohibited or restricted by law. All federal, state, and local laws and regulations apply. Pearson Education reserves the right, at its sole discretion, to disqualify any entry if it concludes that the entrant has tampered with the entry process or the operation of the Drawing or has acted in violation of these Official Rules or any applicable state, federal, or local laws or regulations.

Prize:

Grand Prize: one (1) Apple iPod touch. ALL FEDERAL, STATE AND LOCAL TAXES THAT MAY ACCRUE FROM THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE PRIZE WINNER.

Winner Notification:

The prize winner will be selected in a random drawing to be held (two weeks after the closing of the drawing) on or about January 11, 2010 at the Pearson Education offices from all eligible entries received. Odds of winning a prize will depend upon the number of eligible entries received. The winners will be notified on or about January 11, 2010 by email ("Winner Notice"). The Winner Notice will include information on how the winners can claim their prize. Failure to comply with any rule, regulation or limitation will result in the forfeiture of the prize, in whole or in part.

The Winner Notice will also include a copy of an Affidavit of Eligibility and Publicity Release ("Affidavit and Release"). Within ten (10) days of receipt of the Winner Notice, the winners shall be required to sign, notarize and return to Pearson Education the Affidavit and Release. The winners must provide their full name and mailing address (the mailing address may not be a PO Box) in the Affidavit and Release. Failure to sign and return the Affidavit and Release within the time requested may result in forfeiture of the prize. No responsibility is assumed for lost, stolen, late or misdirected mail. The Affidavit and Release is null and void if incomplete, not legible or if they contain errors. Unclaimed or forfeited prize will not be awarded.

It is the entrant's sole responsibility to notify Pearson Education in writing if entrant changes email address or home address. General Conditions:

The Drawing will be governed, construed and interpreted under the laws of the United States. By entering this Drawing, participants agree to be bound by these Official Rules and the decisions of Pearson Education on all matters relating to the Drawing. By entering the Drawing, all entrants consent to the use or reproduction, in any format or media, of their names, addresses, likeness, and any statements they make in connection with the Survey and/or Drawing or about Pearson Education and/or Pearson Product without additional compensation, except where prohibited by law. Pearson Education may request, at Pearson Education's sole discretion, that the entrant/winner provide any of the foregoing information to Pearson Education. Entrants and winners also consent to being contacted by Pearson Education or a representative of Pearson Education or a third party with whom Pearson Education has a relationship regarding one or more of Pearson Education's or third party's products and/or services

Limitations of Liability:

By completing the Survey and/or entering the Drawing, participants agree to release Pearson Education, Inc. and its respective affiliates, parents and subsidiaries, and their respective employees, agents, and representatives (collectively, "Entities") from any and all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to person or property that may be sustained in connection with the receipt, ownership, or use of a prize or with participation in this Drawing. By entering this Drawing, entrants agree that no claim relating to such injuries, damages, or losses shall be asserted against any of the Entities. Entrants agree that none of the Entities shall be liable for any injury or damage to any person's computer hardware, software, or peripherals utilized in participating in the Drawing. None of the Entities are responsible for technical, hardware, software, or other communication failures of any kind, whether caused by any of the Entities, users, or by any equipment, programming, or other cause, whether or not such failures limit an entrant's ability to participate in the Drawing. If for any reason (including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause that corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Drawing), the Drawing is not capable of being conducted as described in these Official Rules, Pearson Education shall have the right, at its sole discretion, to cancel, terminate, modify, or suspend the Drawing.

Pearson Education reserves the right to disqualify any individual it finds has tampered with the entry process or the operation of the Drawing, or who has acted in violation of these Official Rules or any applicable state, federal, or local laws or regulations, or is acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. CAUTION: ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE DRAWING MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, PEARSON EDUCATION AND ITS AGENTS RESERVE THE RIGHT TO PROSECUTE SUCH PERSON AND/OR SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULL EXTENT PERMITTED BY LAW.

PRIZEWINNER’S AFFIDAVIT OF ELIGIBILITY AND RELEASE AND PUBLICITY RELEASE

I, ________________, being duly sworn, state:

I am submitting this Affidavit to Pearson Education, Inc. (“Sponsor”), with the understanding that it will be relied upon to determine whether I am entitled to receive the prize for which my entry has been drawn in the “Student Media Survey (“Drawing”). I understand that the prize I won is an Apple iPod touch (the “Prize”).

I represent that I have fully complied with all of the Official Rules of the Drawing. I have committed no fraud or deception in entering the Drawing or claiming my prize.

I hereby accept the Prize in complete satisfaction of obligations to me by the Sponsor I understand that by accepting the Prize, I am solely responsible for all federal, state and local taxes on my prize and all other expenses.

I represent that as of date of entry, and as of today’s date I was and am an instructor and that my acceptance of the prize does not violate any rules, regulations or policies of my school. I understand that the prize is also being awarded in accordance with any and all applicable laws, rules and regulations (including but not limited to laws, rules or regulations at the state, municipal or local level).

I further represent that as of the date I entered this Drawing and date of this Affidavit, I was not and am not an employee of Pearson Education, Inc., its parent companies, affiliates, or their immediate families (parents, children, siblings, spouse) in the same household.

I hereby give permission to the Sponsor to reproduce, copy, display or otherwise use my name, picture or likeness, home town and Biographical information, statements, Survey or any material based upon or derived therefrom (or to refrain from so doing) in whole or in part, in any manner or media whatsoever throughout the world, including but not limited to advertising and promotion, with no right of approval, compensation or benefit.

I hereby release, discharge and absolve Sponsor, its parent companies, subsidiaries, affiliates, advertising and promotion agencies and their directors, officers and employees from any and all claims or causes of action that I, my heirs, executors, administrators and assigns, had, now have or hereafter may have, by reason of my participation in the Survey and/or Drawing, the awarding of the prize, any loss or damage to any prize, any action, claim or suit for personal injury or loss or damage to property in connection with the receipt and use of the prize, or based on publicity rights, defamation, invasion of privacy or merchandise delivery.

I hereby certify that I have read and understand this Affidavit and Release document and that I fully accept the stated terms and conditions.

I understand that the Sponsor will rely upon the information and representations I provide, and I warrant the accuracy and correctness thereof.

I also understand that I will not be eligible to claim or receive the Prize if I fail to sign this document or if any statement made by me in this Affidavit and Release is false.
