SUBJECT: An Ordinance of the City of Hallandale Beach, Florida, Rezoning 137 SW 1 Avenue (Second Reading)

PURPOSE:

To adopt on Second Reading an Ordinance rezoning Lot 19 Less the North 10 Feet and Lot 20, Block 30 of the "Town of Hallandale Plat" (137 SW 1 Avenue) from RS-6 (Residential 6 units per acre) to B-G (Business General) and allocating Commercial Flexibility Acreage.

BACKGROUND:

The Applicant/Agent, Richard Shan, for Hallandale Beach Business Center, LLC is requesting the following:

1. Application #67-07-Z Rezoning a portion of the subject property in order to construct ancillary parking on property presently zoned RS-6 Residential (Single Family) District and the allocation of Commercial Flexibility Acreage.

The City Commission on December 19, 2007 approved the attached Ordinance on first reading and set the Second Reading/Adoption for January 9, 2008.

2. Application # 68-07-RD for Redevelopment Area Waiver pursuant to Section 32-178 (d)(12)  of the 15 foot minimum front yard setback required by Section 32-178 (d)(2) for buildings within the South Dixie Highway Overlay District.

The City Commission on December 19, 2007 approved this item.

3. Application # 66-07-DB for Major Development Review approval as provided by Article V Section 32-782 to construct a 17,985 square foot office building with associated parking.

The City Commission on December 19, 2007 approved this item.

DISCUSSION

Attached is the staff report prepared for the First Reading of this item that includes both the policy and technical analysis.

RECOMMENDATION:

The City Commission adopt the attached Ordinance on Second Reading.

SUBJECT: Submission of Gang Resistance Education and Training (G.R.E.A.T.) Grant Application

PURPOSE:

To consider approval of a G.R.E.A.T. (Gang Resistance Education and Training) Grant Application to the United States Department of Justice, Bureau of Justice Assistance.

BACKGROUND:

The Police Department has experienced a documented gang presence within the city, and many at risk youth have displayed known gang risk factors that contribute to youth violence. Both boys and girls have formed several local street gangs; 5 ct, 80’s and 90’s babies. Over the past year, these gangs have been responsible for several violent street fights with youths from other schools. They have also been involved in crimes such as shootings, weapons violations, criminal mischief, burglaries, possession of narcotics and stolen vehicles. Many of these groups have been observed congregating in large groups at our local parks, neighborhoods and in front of local stores.

Our Police Community Partnerships Division has identified 30 known juvenile gang members living within our city and many of these gangs have become well organized over the past year by utilizing the internet and “My Space.”

DISCUSSION:

Gulfstream Middle School has approximately 430 students enrolled for the 2007/2008 school year and the number is expected to increase since the enrollment at Hallandale Elementary School is approximately 1,200 students. Gulfstream Middle School is in its third year of existence and its first year with a School Resource Officer. Although some students have received the DARE curriculum when they attended Hallandale Elementary School, there is currently no follow-up program to educate the students about the dangers of gangs and drugs at Gulfstream Middle School. Hallandale High School has an active Crime Watch Program and the Criminal Justice Career Program, an International Affairs/Business Studies Magnet Program. With the addition of the G.R.E.A.T. Program, all three school levels will have the opportunity to receive life skills to help them avoid delinquent behavior and violence to solve their problems.

The G.R.E.A.T. Program is a school based, law enforcement officer-instructed classroom curriculum. Its primary objective is prevention and is intended as an immunization against delinquency, youth violence, and gang membership. The G.R.E.A.T. lessons focus on providing life skills to students to help them avoid delinquent behavior and violence to solve problems.

Staff will utilize funding from the G.R.E.A.T. grant to target all students in 6th, 7th, and 8th grades at Gulfstream Middle School. Our School Resource Officer will be certified through an approved training program to deliver the 13-lesson curriculum to students. G.R.E.A.T.’s violence prevention/life skills competency curriculum helps students avoid destructive behaviors.

Funding will also be used to institute a summer education and recreation program to continue to build on the school-based program and reinforce the 13-lesson cognitive, social, and self-esteem-building lessons.

Due to the limited amount of time available when staff received information about the grant opportunity and the application deadline of December 13, 2007, staff submitted an electronic grant application online contingent upon City Commission approval at the first available commission meeting date. Staff requested $77,243.97 in grant funding for personnel training and time and a summer program, providing $211,225.77 in existing programs and local in-kind match.

RECOMMENDATION:

The City Commission approve the G.R.E.A.T. grant application in the amount of $77,244 to the U.S. Department of Justice, Bureau of Justice Assistance and authorize the local in-kind match, as presented in the staff report.

I would like to discuss putting on the November 2008 ballot an amendment to Charter Section 3.08(1) eliminating the one year waiting requirement regarding former Commissioners seeking employment with the City. I believe Commissioners gain knowledge that is invaluable to the success of our Community and their service to the City should not be hindered with a one year waiting period.

Please place an item on the January 9, 2008 agenda to discuss the composition of the Police Fire Pension Board. Currently, the City has a Police Firefighter Pension Board composed of City employed sworn police officers, firefighters and residents. Section 3.08 of the City Charter prohibits City Commissioners from holding other Hallandale Beach City Office while presiding on the Commission. I would like to discuss the current ordinance to ensure the City Commission is protected and following all appropriate laws.

I would like to discuss the creation of an ordinance requiring security cameras or other security measures as determined by the Chief of Police for businesses operating 24 hours, businesses that have an extended hours license to operate after 2:00 A.M., and businesses that have a history of illegal activities.

Attached please find a Sun-Sentinel article regarding robberies at 24 hour businesses and a corresponding Sun-Sentinel survey on the same subject matter.

SUBJECT: 2007-2008 Legislative Issues, Priorities and Action Plan

PURPOSE:

Consideration of Resolutions relating to the City’s 2007-2008 Legislative Issues, Priorities and Action Plan.

BACKGROUND/DISCUSSION

At the December 18, 2007 Special Commission Meeting, the Commission directed the preparation of Resolutions supporting or opposing legislation and related issues. Resolutions are attached for Commission consideration beginning with Item 7.E. and continuing through Item 7.N.

The following Resolutions are attached:

1. Supporting Senate Bill SB816 Proposed by Florida Senator Mike Bennett; Creating an Act Relating to Uniform Traffic Control; Creating the "Mark Wandall Traffic Safety Act"

2. Supporting A Complete Review and Analysis of the Proposals Before the Taxation and Budget Reform Commission Pertaining to Florida Sales and Use Tax Provisions to Remove Exclusions and Exceptions for Purposes of Providing Revenues for Schools in Florida. Mayor Cooper has submitted a letter to the Taxation and Budget Reform Commission regarding this matter and this Resolution will further document the City’s position.

In addition to the above resolutions, at the December 18, 2007 Special Meeting the City Commission directed staff to draft the below listed resolutions. These resolutions have not been prepared for the reasons described below.

1. Opposing Committee Member Lacasa’s proposals regarding the elimination of the School Board portion of the property taxes and replacing them with increased sales tax – Lacasa outlined his proposal and it was reported in the media, however, to date no proposal has been submitted to the Taxation and Budget Reform Commission. Once a proposal is formally submitted Staff will draft the appropriate resolution for the Mayor’s signature and forward same to the State.

2. Opposing two local bills addressing a Special Fire Tax District and Creating a Commission to review all Special Districts in Broward County – These two bills were pending at the time of the Commission meeting but were subsequently withdrawn from the Broward Delegation and will not be brought before the Florida Legislature.

3. Urging Congress to Oppose Legislation that Preempts State and Local Laws over Collective Bargaining for Public Safety Employees – The bill currently has no movement. If the bill should move forward, staff will do an evaluation and bring the Resolution to the Commission.

RECOMMENDATION:

The City Commission consider adoption of Resolutions related to the City’s 2007-2008 Legislative Issues, Priorities and Action Plan.
