Westfall Township, Matamoras, PASeptember 15, 2020The Regular meeting of the Westfall Township Board of Supervisors was held Tuesday, September 15, 2020 at 7:00 pm. The meeting was held in person at the Westfall Township Municipal Building at 102 LaBarr Lane, Matamoras, PA with all following CDC Guidelines.Those present were Vice Chairman, Jerry Dotey; Supervisors; Paul Fischer and Paul Schaldonat; Solicitor, Robert Bernathy; and Secretary, Jodi Manheim. Also present were Road Master, Keith Rodriguez; Westfall Township Fire Chief, Fred Jacobs; Jeff Cammerino, Zoning Officer; Treasurer, Scott Myer; Chief Chad Stewart, Eastern Pike Regional Police Department; Mike Fischetta, EMC; Donald Wagner, Gary Williams, David Twiss, Mark Strouse, Krystyn Strouse and John Fuller, Engineer. There were approximately 6 members of the general public present. The Board maintained 25 people maximum in the room at one time to comply with the CDC Guidelines. Chairman Robert Melvin was absent. Vice Chairman Dotey officiated the meeting. The last executive session was held on August 3, 2020 at 8:07 pm and September 11, 2020 at 5:00 pm both for personnel matters. An executive session was also held just prior to this meeting at 6:30 pm for matters of litigation.APPROVAL OF AGENDA:A motion was made by Supervisor Schaldonat to approve the agenda with no revisions. The motion was seconded by Supervisor Fischer and carries with all in favor. PUBLIC COMMENT: No public comment.MINUTES: A motion was made by Supervisor Schaldonat to approve the August 3, 2020 Regular Supervisor Meeting Minutes. The motion was seconded by Supervisor Fischer and carries with all in favor. TREASURER’S REPORT: Mr. Myer gave the report through the month of September, 2020. Mr. Myer noted that income and expenses are in line with the time of year. A motion was made by Supervisor Fischer to approve the Treasurer’s Report through the month of September, 2020. The motion was seconded by Supervisor Schaldonat and carries with all in favor. HIGHWAY DEPARTMENT: Keith Rodriguez gave the report for August, 2020 which reflected the following: Ditch work was done on Decker Road and Cummins Hill RoadCleared Trees from the roadway after the August 4th StormHot patching was done on Bluestone Boulevard and Sand Pit RoadLines and markings were painted on Reuben Bell DriveTrimmed back trees on Pine Terrace, Meadowbrook and White Birch RoadReplaced 2 signs on Cummins Hill RoadTownship Clean Up Day August 22 A motion was made by Supervisor Fischer to approve the Highway Department report for August, 2020. The motion was seconded by Supervisor Schaldonat and carries with all in favor. BUILDING/ZONING DEPARTMENT: Jeff Cammerino gave the Building/Zoning Report for the month of August, 2020 which reflected the following:7 Building Permits totaling $7,056.90 4 Zoning Permits totaling $300.00A motion was made by Supervisor Schaldonat to approve the Building/Zoning Report for Augsut, 2020. The motion was seconded by Supervisor Fischer and carries with all in favor. EMERGENCY MANAGEMENT: Mike Fischetta gave the report for August, 2020 which reflected the following:-No calls for service for the month of August-Westfall EMA is looking to acquire an emergency contact for the Optimum cable company. There have been a few occasions where one of their lines have come down during a storm onto roads in the township and have created a hazard. I have been approached by a few agencies and utilities to see about getting an emergency contact so notification can be made when this happens. I am requesting that the township investigate the possibility of sending a letter to Optimum to see if they can provide a 24/7 contact. -Communications regarding Corona virus have slowed down however EMA is still closely monitoring the situation and status of the pandemic. The township did finally receive the disinfecting sprayer and tables that was ordered sometime in April. A motion was made by Supervisor Schaldonat to approve the Emergency Management Report for the month of August, 2020. The motion was seconded by Supervisor Fischer and carries with all in favor. CORRESPONDENCE: On desk for reviewOLD BUSINESS: Westfall Township Welcome Signs: A motion was made by Supervisor Fischer to contact Penn DOT for an easement agreement to install a sign in the Penn DOT Right of Way on Route 6 and 209 near the township line near Tractor Supply and the Wells Fargo Bank. The motion was seconded by Supervisor Schaldonat and carries with all in favor. A motion was made by Supervisor Fischer to approve the proposal dated August 3, 2020 from Sign Here Sign Company in the amount of $875.00 per sign for two signs. The motion was seconded by Supervisor Schaldonat and carries with all in favor. Corinne Tonkin-Heaters Hill Road: Solicitor Bernathy stated he reviewed the map, of Ms. Tonkin’s property on Heaters Hill Road, which Keith Rodriguez obtained from the Pike County Mapping Office. He also had a discussion with Ms. Tonkin. Solicitor Bernathy stated the bridge and wall are outside of the township right of way therefore the maintenance is not the responsibility of the township. He also noted the subject hole may be within the township right of way but is very hard to tell from the map without having a survey done. Ms. Tonkin stated the township had done work there about three years ago to fix the hole. Brief discussion followed. Ms. Tonkin agreed to sign an agreement/release with the township in regards to the township maintaining the sink hole. A motion was made by Vice Chairman Dotey to approve the maintenance of the sink hold on Ms. Tonkins property subject to Ms. Tonkin signing an agreement/release with the township. The motion was seconded by Supervisor Schaldonat and carries with all in favor. Milford Township-Joint Comprehensive Planning-Update: Supervisor Schaldonat stated he has been in touch with Kevin Stroyan regarding an informal meeting. There has been no schedule set to date. This matter was tabled. Rosa Switch Road Estimates: A motion was made by Vice Chairman Dotey to approve the proposal dated September 15, 2020 from Morgan Site Contractors to supply the stone and excavator rental to the township to complete the project in the amount of $500 per tri-axle load (estimate 10 loads) and $500 per day excavator rental ($1,800 weekly rental). The motion was seconded by Supervisor Fischer and carries with all in favor. Solicitor Bernathy will provide a contract for Morgan Site Contractors. Bluestone Boulevard Project: Vice Chairman Dotey explained that the township is waiting for an easement agreement to be signed by the DCNR for a 10 foot easement. Solicitor Bernathy stated there seem to be no issues other than time. Vice Chairman Dotey stated the project may not be able to be completed before winter and may need to wait until spring. He stated Kiley Associates, LLC is contacting the contractor who the bid was awarded to see if they will honor the price until spring. NEW BUSINESS:Bond Release Request #6-Pike Health Properties: A motion was made by Vice Chairman Dotey to approve the bond reduction request, as per Kiley Associates, LLC review letter dated September 4, 2020, in the amount of $86,699.02 with the remaining bond amount of $966,947.89. The motion was seconded by Supervisor Fischer and carries with all in favor. Appointment/Authorization for Loan Signer-John Deere Purchase: A motion was made by Supervisor Fischer to appoint Vice Chairman Dotey and Scott Myer, Treasurer, to sign all loan documents related to the John Deere Backhoe purchase. The motion was seconded by Supervisor Schaldonat and carries with all in favor. Letter of Interest-David Twiss-Supervisor Position: Vice Chairman Dotey stated a letter of interest was received by Mr. Twiss for the vacancy on the Board. Letter of Interest- Raymond Banach-Supervisor Position: Vice Chairman Dotey stated a letter of interest was received by Mr. Banach for the vacancy on the Board. Letter of Interest-Richard Roa-Supervisor Position: Vice Chairman Dotey stated a letter of interest was received by Mr. Roa for the vacancy on the Board. Appointment of Supervisor to fill vacancy through 2023: A motion was made by Supervisor Fischer to appoint Mr. Richard Roa to the Board to fill the vacancy through 2023. The motion was seconded by Supervisor Schaldonat and carries with all in favor. Solicitor Bernathy asked if the applicants were present. Mr. Roa and Mr. Banach were not present. Mr. Twiss was present and the Board thanked him for his interest. Secretary Vacation Day Approval: A motion was made by Vice Chairman Dotey to approve the following vacation days for Jodi Manheim: August 27, 2020; September 3 and 17; October 15, 22 and 29; November 5, 19 and 30; December 3, 17, ? day 24 and ? day 31. The motion was seconded by Supervisor Schaldonat and carries with all in favor. Notice of Act 205 2020 Distress Determination Score (Pension Plan): Secretary Manheim stated we received the Municipal Pension Plan Report showing Total Distress Score of 0 for 2020. The plan is in good shape. No action needed or taken. PSATS Unemployment Compensation Group Trust-2020 Ballot for Election of Trustees: A motion was made by Supervisor Fischer to elect Jack M. Hines and Tim Horner to the Board of Trustees. The motion was seconded by Supervisor Schaldonat and carries with all in favor. PA Health Insurance Cooperative Trust-2020 Ballot for Election of Trustees: A motion was made by Supervisor Schaldonat to elect Jack M. Hines and Tim Horner to the Board of Trustees. The motion was seconded by Supervisor Fischer and carries with all in favor. SUBDIVISION/LAND DEVELOPMENT/CONDITIONAL USE-REVIEW AND ACTION: Downtown Baseball and Softball Academy-Sewage Planning Module: Representatives: John Fuller, P.E., Mark and Krystyn StrouseMr. Fuller addressed the Board and explained that the Planning Module is complete other than the Letter from the Fish and Wild Life Commission. He stated that their office has been closed due to COVID-19 and his certified mail was returned. Solicitor Bernathy stated that it sounds that it is impossible to comply. Brief discussion followed. Mr. Fuller submitted a letter to the DEP explaining the situation and asked that this letter be sent in with the application for DEP approval. The Board is in receipt of Planning Commission correspondence dated August 26, 2020. Also, Chris Wood, SEO has reviewed and signed off on the planning module. A motion was made by Supervisor Fischer to approve the Planning Module application from Downtown Baseball and Softball Academy and to send it to the DEP with the letter from Fuller to the DEP explaining the reason for the missing document from the Fish and Wild Life Commission. The motion was seconded by Supervisor Schaldonat and carries with all in favor. Wagner Lot Combination: Representatives: Gary Williams, Surveyor and Don Wagner, OwnerMr. Williams addressed the Board and explained the proposed plan. The Board is in receipt of Planning Commission correspondence dated August 26, 2020. Mr. Williams stated all comments have been addressed.
