I am writing in response to a Complaint filed against Thomas A. Smith T/A T2 Trucking, Docket No. C2013-2390104.

(, Thomas A. Smith, made the decision to cease operation and close my business, T2 Trucking, on August 1 s t , 2013. I took all necessary and proper steps to ensure that all agencies were notified and that commercial insurance coverage was canceled.

On August 1 s t , 2013 I contacted Progressive Insurance and canceled both commercial liability and cargo insurance coverage on the sole vehicle that was being used for business purposes, a 2008 Chevrolet Silverado 3500. Progressive exercised their legal right to carry continued commercial insurance on this vehicle for a period of thirty (30) days from the original date of cancelation, so the policy shows that coverage was in effect until September 5th. (1) Attached please find a copy ofthe final bill and effective date of insurance coverage cancelation issued by Progressive.

I then contacted Erie Insurance Agency and obtained noncommercial coverage for said vehicle. This vehicle has been used for personal use only since August l 5 ' , 2013. (2) Attached please find proof of noncommercial insurance issued for the 2008 Chevrolet Silverado 3500 on August 1 s t , 2013.

On August l s l , 2013 I contacted the Federal Motor Carrier Safety Administration and requested voluntary revocation of my operating authority. (3) Attached please find proof of voluntary revocation approved by the Federal Motor Carrier Safety Administration on August 28th, 2013.

On August 1 s t , 2013 I submitted a 'Cancelation Request form for Property Carriers' to the Pennsylvania Public Utility Commission via US Mail and, thereby, surrendered my PUC Operating Authority. I was informed on September 18th, 2013 that T2 Trucking was liable for Assessment Fees and that the 'Cancelation Request form' had not been received. I, again, replied in writing requesting cancelation of my PUC Operating Authority and submitted the request via fax to the Pennsylvania Public Utility Commission. (4) Attached please find proof of my request in a fax dated September 18th, 2013 and stamped as 'Received by Administrative Services 2013 Sep 18 PM 3:51' and 'Received by P.A.P.U.C. Secretary's Bureau 2013 Sep 24 PM 3:09.' (5) Attached please also find an updated 'Cancelation Request form for Property Carriers/

Between August 5th, 2013 and September 9,h, 2013 I obtained my HAZMAT Endorsement and was actively searching for employment. On September 1 1 t h , 2013 I was hired by T.M. Services Unlimited Trucking Company and began full-time employment as a truck driver for said company. (6) Attached please find a dated pay stub as proof of employment.

At no time since August 1 s t , 2013 was I operating T2 Trucking illegally or without the proper credentials or commercial insurance coverage. I feel that all of the above serve as proof that I officially and properly

closed T2 Trucking and ceased operations on August 1 s t , 2013 and, therefore, should not be imposed a penalty by your agency. Thank you for your time,
