RENTAL OF PORTABLE CHEMICAL TOILETS INCLUDING MAINTENANCE AT VARIOUS LOCATIONS ON THE ISLAND OF OAHU

The Department of Transportation Harbors Division, Oahu District, is interested in contracting the rental and servicing of portable chemical toilets within Honolulu Harbor. All labor, materials and equipment necessary for the transport, placement and service of units described herein shall be provided by the Bidder.

The rental units, number and service requirements below are estimates for bidding purposes only. Quantities may change at any time:

Honolulu Harbor – Piers 16-18

a. Rental and Service two times (2x)/week for one (1) Standard Unit

Honolulu Harbor, Piers 36-38

Pier 36

a. Rental and Service two times (2x)/week for one (1) Handicap Unit (ADA

Compliant)

Pier 37

b. Rental and Service two times (2x)/week for one (1) Handicap Unit (ADA Compliant)

Scope of Work

Bidder shall furnish portable chemical toilets and provide all labor, materials and equipment necessary, for the transport, placement and service of units described herein. Contract is an indefinite quantity contract. Locations provided on the bid sheet are current locations units are stationed. Quantities can decrease or increase at any time.

Servicing of Units. Servicing should include pumping out waste material, cleaning and sanitizing of the unit, replacement of chemicals and materials associated with use of the units such as but not limited to toilet paper and deodorizing liquid. Bidder shall be responsible to ensure that rental units are in serviceable condition and shall replace any unit(s) that the State deems unserviceable.

A schedule of service days and times shall be coordinated with Harbors Division Harbor Agent prior to the commencement or work. The Agent’s contact number is (808) 587-2066.

Should the Bidder fail to conform to the requirements herein, the Bidder shall immediately remedy any defects due to faulty workmanship. Should the Bidder fail to comply, the State reserves the right to terminate the service.

Should the management of any of these parks included in this solicitation be transferred to another entity, cancellation of services may be implemented without penalty with 30 days’ written notice.

Authority of the State

The State shall decide all questions that may arise as to the work performed hereunder, as to the manner of such performance, as to the interpretation of any law, rule or regulation, policies and procedures, as to compensation, and as to any other matter that may arise under the Contract. The decision of the State in such matters shall be final as long as not in violation of law and not arbitrary, capricious, or characterized by abuse of discretion.

Liability Insurance

The Bidder shall provide a Certificate of Insurance with the following minimum insurance coverage(s) and limit(s):

Each insurance policy required by this contract, including a subcontractor's policy, shall contain the following clauses:

"This insurance shall not be canceled, limited in scope of coverage or non-renewed until after 30 days’ written notice has been given to the:

1. "The State of Hawaii is added as an additional insured as respects to operations performed for the State of Hawaii."

3. "It is agreed that any insurance maintained by the State of Hawaii will apply in excess of, and not contribute with, insurance provided by this policy."

The minimum insurance required shall be in full compliance with the Hawaii Insurance Code throughout the entire term of the contract, including supplemental agreements.

Term

The term shall be for twelve (12) month period from the date of the Notice to Proceed. The contract shall not exceed $100,000.00.

Bid Quotation

Bid price shall include all labor, transportation, all applicable taxes and any other costs incurred to provide services specified. Bidder shall bid out a total yearly (1-year) cost for the work described in this document. All documents must be submitted electronically.

Attachment II Bid Breakdown Portable Toilets 2017, must be filled out and submitted electronically along with the Bid Quotation.

Hawaii Compliance Express. At the time of bidding and throughout the period of the contract, the Offeror shall be a member of good standing in the Hawaii Compliance Express (HCE). Information on joining and the requirements for HCE can be found at:

Invoice

The successful Bidder shall send an original and three (3) copies of the invoice to:

The invoice should reference the purchase order number and provide a breakdown of the monthly cost for billing and accounting purposes.

Any additional charges for extra service days shall be approved by the State prior to the work being done.

Permits, Licenses and Taxes

The Contractor shall procure all permits and licenses, during the original or extended contract term, pay all charges, fees, and taxes, and give all notices necessary and incidental to the due and lawful prosecution of the work. Failure to procure and maintain valid permits and licenses required by law and these specifications may be cause for the State to terminate the contract.

Additional Conditions

Approvals. Any agreement arising out of this offer may be subject to the approval of the Department of the Attorney General as to form, and is subject to all further approvals, including the approval of the Governor, required by statute, regulation, rule, order, or other directive.

Cancellation of Solicitations and Rejection of Offers. The solicitation may be cancelled or the offers may be rejected, in whole or in part, when in the best interest of the purchasing agency, as provided in §§3-122-95 through 3-122-97, HAR.

Campaign Contributions

CAMPAIGN CONTRIBUTIONS BY STATE AND COUNTY CONTRACTORS PROHIBITED If awarded a contract in response to this solicitation, offeror agrees to comply with HRS §11-355, which states that campaign contributions are prohibited from a State and county government contractor during the term of the contract if the contractor is paid with funds appropriated by the legislative body between the execution of the contract through the completion of the contract.
