SEQ CHAPTER \h \r 1TITLE: Pre-Employment Screenings CODE: HR 116EFFECTIVE DATE:April 2011POLICY:It is the policy of NewBridge Services, Inc. that all applicants for employment participate in pre-employment drug screening, tuberculosis (TB) screening, and a criminal background check. If applicable to the requirements of the position, some staff must have a two-step TB screening (and a single TB test annually thereafter), a physical exam (recurring every three years thereafter), screening for rubella and measles, a State level criminal history background check supported by fingerprints, and/or motor vehicle driving record check as a condition of employment. Staff may be exempted from some screenings with appropriate documentation. PURPOSE:To ensure the safety of clients, employee and the public.PROCEDURE:STANDARDS FOR ALL CANDIDATES REGARDLESS OF POSITIONAuthorizationAll job applicants sign a NewBridge Services, Inc. Employment Application which states that the applicant will be required to submit to pre-employment screening as a condition of employment.NotificationUpon completion of a Recommendation for Hire form and with required approval, a representative from the Human Resources Department contacts the applicant with an offer of employment. If the offer is accepted the HR staff instructs the candidate to report within 48-hours to the approve NewBridge Services testing site for the health related pre-employment screening(s). The candidate is informed that employment is contingent upon timely completion of the pre-employment screenings and all screenings resulting in satisfactory pletionThe Human Resources Department receives and reviews the results of all screenings. Candidates may not start working until all results have been received, reviewed and approved. Upon hire, the results of all health-related screenings are kept in the employee’s confidential Medical File.Criminal Background Check Applicants sign a disclosure and authorization form to obtain consumer reports for employment purpose and are supplied with a summary of their rights under the Fair Credit Reporting Act (FCRA).Using an approved vendor NewBridge Services Human Resources Department staff requests a criminal background check report for employment purposes abiding by FCRA and EEOC guidelines.The results of the background check are limited to informing employment decisions.If negative information is returned on the background report the results are reviewed by the Chief Administration Officer and/or COO/CEO.If NewBridge considers withdrawing an employment offer due to the results of a background check the applicant is notified by letter that adverse action is being considered. They are given a reasonable amount of time to dispute the accuracy or completeness of the report.NewBridge takes into account the applicant’s response and the following “Green” factors as recommended by the EEOC before making a final decision regarding hiring:Pre-Employment ScreeningsHR 116Page 2Nature and gravity of the crime;Harm causedLegal elements (specifics of crime)The time that has passed since the conviction and/or completion of the sentence, andThe nature of the job sought.If, after the individualized assessment and consideration of the applicant’s response to the report, NewBridge decides to withdraw the employment offer, NewBridge notifies the applicant by letter of the final adverse action.If an applicant is found to have falsified information on the background check authorization form or refuses to participate in the background check the offer of employment may be withdrawn.Drug ScreeningThe approved testing site collects a urine sample from the candidate and sends it to a third party laboratory for examination. The results of the laboratory examination are sent to a separate company for independent review by a Certified Medical Review Officer (MRO). The MRO makes the final determination of the results of the test. The MRO then delivers the results to the NewBridge Human Resources Department.The urine sample is tested for the presence of illegal or non-prescribed drugs in the following classes:CocaineAmphetaminesMarijuanaOpiatesPhencyclidine The MRO may contact the candidate to confirm valid prescriptions of medications that appear on the results. Validated prescriptions are reported to NewBridge as “negative” results. If the prescriptions are not validated the results will be reported to NewBridge as “positive.”If the candidate refuses/fails to complete the UDS within the required 48-hours or the MRO reports a positive result or substituted/adulterated specimen, NewBridge Services management will review the case. Specimen re-testing may be ordered or the offer of employment may be withdrawn.TUBERCULOSIS (TB) SCREENING FOR NON-DAS STAFFThe approved testing site administers the appropriate TB screening method(s) based on the applicant’s health history and delivers the results to the NewBridge Services Human Resources Department. Methods:Mantoux Tuberculin Skin Test (TST) with PPD (preferred)QuantiFERON-TB Gold blood testChest X-rayAn individual with a positive TST or QuantiFERON-TB Gold test, as reported by the testing site, will submit to a chest X-ray to rule out the presence of active TB. An individual with X-ray results of “Abnormal – Compatible with Tuberculosis” will be referred to an Infectious Disease doctor for further examination and possible treatment. The cost of such follow-up is at the candidates’ expense. The employment process is paused until the applicant is medically cleared. If the candidate fails to follow the full TST process and does not return to the approved testing site to have the TST interpreted within the required 48-72 hours a new TST must be completed at their own expense. Pre-Employment ScreeningsHR 116Page 3If the candidate does not complete the TB Screening process satisfactorily and in a timely manner the offer of employment may be withdrawn.Exemptions/Waivers - A candidate may not have to submit to TB screening(s) if the candidate can provide the Human Resources Department with any of the following documentation:Negative results of a TB screening performed by a medical facility in the previous six months;A chest X-ray evaluation showing negative results in the previous two years;Adequate and completed treatment for tuberculosis disease and latent tuberculosis infection.ADDITIONAL STANDARDS FOR EMPLOYEES ON THE DAS ROSTER ASSIGNED TO DAS LICENSED SITESHealth Screening(s)Tuberculosis (TB) ScreeningThe approved testing site administers a two-step Mantoux TST in accordance with the Tuberculosis Surveillance Procedures for Substance Abuse Treatment Facilities, published by DMHAS.If the initial TST result is “negative,” as reported by the testing site, a second TST will be administered one to three weeks later.If the initial or subsequent TST is “positive,” as reported by the testing site, the applicant will submit to a chest X-ray to rule out the presence of active TB.An individual with X-ray results of “Abnormal – Compatible with Tuberculosis” will be referred to an Infectious Disease doctor for further examination and possible treatment. The cost of such follow-up is at the candidates’ expense. The employment process is paused until the applicant is medically cleared.If the candidate fails to follow the full TST process and does not return to the approved testing site to have the TST interpreted within the required 48-72 hours a new TST must be completed at their own expense. If the candidate does not complete the TB Screening process satisfactorily and in a timely manner the offer of employment may be withdrawn.Pre-Employment TB Screening Exemptions/Waivers - A candidate may not have to submit to TB screening(s) under the following conditions:Applicant presents documentation from a medical facility showing negative results of a two-step Mantoux in the previous 12 months;If an applicant can provide documentation of negative results of a TB screening performed by a medical facility in the previous 12 months, then only a single one TST would be required upon hire;Documentation of adequate and completed treatment for tuberculosis disease and latent tuberculosis infection.A single TST shall be repeated on an annual basis for employees with an initial negative TST. Employees with an initial positive TST who were medically cleared are exempt from the annual screening requirement.Symptomatic applicants/employees shall be referred for a chest X-ray and medical evaluation for active TB regardless of TST result.Rubella and Measles ScreeningThe approved testing site will perform a rubella and measles hemagglutination inhibition test to check if applicant is seronegative or seropositive for Rubella antibodyThe employee is informed of the results.Pre-Employment ScreeningsHR 116Page 4The Human Resources Department maintains a lists of all seronegative and unvaccinated employees.Exemptions/Waivers - A candidate may not have to submit to one or both screening(s) if the candidate can provide the Human Resources Department with any of the following documentation:Seropositivity from a previous measles and/or rubella screening;Receipt of rubella and/or measles vaccination;Physician diagnoses measles (provides exemption from measles screening only);Born prior to 1957 (provides exemption from measles screening only)Physical ExamsThe approved testing site administers a physical exam and provides a fitness-for-duty statement to the Human Resources Department.A repeat physical exam and fitness-for-duty statement is required every three years.Criminal Background Check with FingerprintingIn addition to the background screening conducted by an approved vendor as described in Section A.4, applicants who will be on the DAS Roster and assigned to work at a DAS licensed site must have a State-level criminal history record background check supported by fingerprints.Candidates must pay for the cost of the State-level background check with fingerprinting upfront.
