A MANDATORY JOB WALK HELD ON FEBRUARY 18, 20 10 AT THE ROBERT A. SKINNER WATER TREATMENT PLANT LOCATED AT 33740 BOREL ROAD. WINCHESTER, CA. 92596. BIDDERS MUST HAVE ATTENDED THE MANDATORY JOB WALK TO BE ELIGIBLE FOR BIDDING.

1. Request for Bid (RFB) No. 208733. Landscape Maintenance Services for Robert A. Skinner Treatment Plant: Ozone Facility and Surrounding Areas are hereby amended. The information given in Addendum No. 2 is official clarification and is hereafter incorporated into RFB-MD-208733.

2. Additional requirements as a result of the Pre-Bid Meeting and Job walk held on February 18, 2010:

Bonds

The successful bidder shall furnish and maintain a labor and material payment bond issued by a surety approved by Metropolitan, if required by law.

The bonds shall be submitted in the form of “Bond for Faithful Performance” and “Payment Bond,” furnished by Metropolitan, and in amounts each equal to 100 percent of the bid.

The bidder shall be required to furnish the specified payment bond and performance bonds within 10 calendar days from the date that Metropolitan informs a bidder of the acceptance of the bidder’s proposal. Bidder’s failure to submit the bond within this time period shall be considered a material breach and Metropolitan may immediately terminate the Contract without penalty.

A surety authorized to issue bonds in California and in other states where work is to be performed, and whose bonding limitation is sufficient to provide bonds in the amount herein required shall be deemed to be approved unless specifically rejected by Metropolitan. Bonds from other sureties shall be accompanied by the documents enumerated in California Code of Civil Procedure section 995.660.

Prevailing Wages

a) In accordance with the provisions of the California Labor Code, the Board of Directors of Metropolitan has obtained from the Director of Industrial Relations of the State of California his determination of the general prevailing rates of per diem wages in the locality in which the work is to be performed. A copy of this determination will be made available to the Contractor, and he shall post said copy at the jobsite.

A copy of the general prevailing rates of per diem wages in the locality in which the work is to be performed as determined by the Director of Industrial Relations (DIR) of the State of California may be obtained by contacting the DIR Division of Labor Statistics and Research at 415-703-4774 or dir.. A copy of the general prevailing rates of per diem wages are also on file at Metropolitan’s office and shall be made available upon request.

b) The prevailing wage rates shall be paid for all work performed under the Contract. When any craft or classification is omitted from the general prevailing wage determinations, the Contractor shall pay the wage rate of the craft or classification most closely related to the omitted classification. The Contractor shall forfeit as a penalty to Metropolitan $50.00 for each calendar day, or portion thereof, for each worker paid less than the prevailing rates for any work done under the Contract by him, or by any subcontractor under him, in violation of the provisions of the California Labor Code. In addition, the difference between such prevailing wage rates and the amount paid to each worker for each calendar day, or portion thereof, for which each worker was paid less than the prevailing wage rate shall be paid to each worker by the Contractor.

 

(c) The Contractor shall make payment of travel and subsistence payments to each worker needed to execute the work, as such travel and subsistence payments are defined in the applicable collective bargaining agreements filed in accordance with Section 1773.8 of the California Labor Code.

Portable Toilets

Contractor shall provide, at their expense, portable toilets for staff. These portable toilets are to be placed in an area easily accessible to their staff. The on-site portable toilet is to be fixed firmly in place; the portable toilet for offsite locations is to be trailer mounted.

4. “Areas to be maintained” between Skinner Ozone Plant – Plaza Area and Wash Water Reclamation Plant area. Roads to be free of trash, debris, dirt and weeds.

5. Revised Lake Skinner Landscape “ORP” Job Walk Preliminary Information (Attached).

6. All other terms and conditions remain unchanged.
