64B14-1.005 Public Comment

64B14-1.001 Other Business Involving the Board.

(1) For purposes of board member compensation under section 456.011(4), F.S., “other business involving the board” is defined to include:

(a) Noticed meetings of the Board;

(b) Meetings of committees or workshops of the Board;

(c) Meetings of a Board member with Department staff or contractors of the Department at the Board’s or Department’s request;

(d) Travel days to or from any meeting referenced herein.

(2) Any participation or meeting of members noticed or unnoticed shall be filed at the Board office.

64B14-1.002 Unexcused Absences.

(1) Unexcused absences from regularly scheduled Board meetings are absences for reasons other than court order, subpoena, business with a court which has the sole prerogative of setting the date of such business, death of a family member, illness of the Board member, hospitalization of the member’s immediate family, hurricane or natural disaster.

(2) An otherwise excused absence is not excused if the Board member fails to notify the Board office of the impending absence prior to the regularly-scheduled Board meeting at which the absence will occur or unless the failure to notify the Board office is the result of circumstances surrounding the reason for the absence which the Board itself excuses after the absence has occurred.

(3) “Family” consists of immediate family, nieces, nephews, cousins, and in-laws.

(4) “Immediate family” consists of spouse, children, parents, parents-in-law, siblings, grandchildren, and grandparents.

64B14-1.003 Probable Cause Determination.

(1) The determination of whether probable cause exists that a violation of chapters 456 and 468, part XIV, F.S., and/or the rules promulgated pursuant thereto, has occurred shall be made by a majority vote of a probable cause panel of the Board.

(2) The Chair of the Board shall appoint no more than three people to the probable cause panel and shall designate its chair. The appointed members shall be either current members of the Board or a former member of the Board pursuant to section 456.073(4), F.S. No more than one member of the panel may be a former board member.

(3) The Chair of the Board may make temporary appointments to the panel as necessary to conduct the business of the panel in the absence or unavailability of a regularly appointed panel member.

64B14-1.004 Address of Record and Place of Practice.

(1) Each person holding a license or registration issued pursuant to chapter 468, part XIV, F.S., must maintain on file with the Board of Orthotists and Prosthetists the current address at which any notice required by law may be served by the Board or its agent. Within 30 days of changing this address, whether or not within this state, the licensee shall change his or her address at the Board's website [doh.state.fl.us/mqa/OrthPros/index.html] or notify the Board by email or in writing of the new address at which the licensee may be served with notices or other documents.

(2) Each person holding a license or registration issued pursuant to chapter 468, part XIV, F.S., must maintain on file with the Board of Orthotists and Prosthetists the current primary place of practice, to include the practice name, address, and phone number. Within 30 days of changing this address, whether or not within this state, the licensee or registrant shall notify the Board by email or in writing of the new practice information.

64B14-1.005 Public Comment.

The Board of Orthotists and Prosthetists invites and encourages all members of the public to provide comment on matters or propositions before the Board or a committee of the Board. The opportunity to provide comment shall be subject to the following:

(1) Members of the public will be given an opportunity to provide comment on subject matters before the Board after an agenda item is introduced at a properly noticed board meeting.

(2) Members of the public shall be limited to five (5) minutes to provide comment. This time shall not include time spent by the presenter responding to questions posed by Board members, staff or Board counsel. The chair of the Board may extend the time to provide comment if time permits.

(3) Members of the public shall notify Board staff in writing of their interest to be heard on a proposition or matter before the Board. The notification shall identify the person or entity, indicate support, opposition, or neutrality, and identify who will speak on behalf of a group or faction of persons consisting of five (5) or more persons. Any person or entity appearing before the Board may use a pseudonym if he or she does not wish to be identified.
