COUNTY OF YORK ) RULES AND REGULATIONS

WHEREAS, pursuant to Article VIII, Section 1 of the Bylaws of the Rawlinson Road Homeowners Association, Inc. (“homeowners association” or the “Association”), which reads, “The Board shall have power to: (a) Adopt, formulate, amend and publish rules and regulations governing the use of the Common Area, Amenities, and improvements thereon, and the personal conduct of the Members and their guests thereon, and to establish penalties for the infraction thereof;”

WHEREAS, pursuant to #21 of the Declaration of Restrictive Covenants for Reflection Park, Mabry Park, Brewington Park, and Alexandria Park, and pursuant to certain Amendments to each Declaration applicable to each of the foregoing communities which have been filed with the York County Clerk of Court, “Each lot owner shall be a member of the Rawlinson Road Homeowners Association (homeowners association), and shall abide by such rules and regulations as may be promulgated by said homeowners association for holding, maintaining and upkeeping the amenities and common areas conveyed to the homeowners association;”

WHEREAS, two very important duties of the Rawlinson Road Homeowners Association (RRHOA) are to ensure that our community remains a desirable place to live and to protect the financial investment of each homeowner.

WHEREAS, general standards are specified in the recorded Covenants, Conditions and Restrictions; and

WHEREAS, the Board of Directors of the Association, pursuant to the powers granted in the foregoing sections, adopted the following rules and regulations according to those standards.

NOW, THEREFORE, the following Rules and Regulations, upon proper vote at a duly called meeting of the Association’s Board of Directors, are hereby adopted as the Rules and Regulations of the Association:

1. Complaints, Suggestions and/or Recommendations:

Complaints, suggestions and recommendations must be in writing either by e-mail or regular mail. See addresses below. Writer must include his or her name, address, and phone number on all correspondence. All letters will be held in the strictest confidence.

2. Tenants and Guests:

Owners are responsible for the actions of their tenants and guests and for adherence to the Rules and Regulations, Declarations and By-laws. The homeowner is responsible for any damage or breaking of any of the aforementioned rules by a tenant and is subject to any or all fines as established by these rules and regulations.

3. Fences

The Architectural Review Committee must approve all fences prior to the start of construction. Chain link fences are not allowed on any property. Privacy fencing and its placement within a yard is subject to the approval of the Architectural Review Committee.

4. Sheds/Accessory buildings

The Architectural Review Committee must approve all sheds/accessory buildings prior to the start of construction. As per the covenants, steel or metal accessory buildings are prohibited. Sheds/accessory buildings must be as close in color as possible to the main color of the home.

*5. Noise:

Noise that precludes the peaceful and quiet enjoyment of an owner’s property is prohibited. Enforcement of this regulation will be in accordance with city ordinance. This will be enforced by the Rock Hill police force, not your HOA officers. Please see the number below.

6. Yards

It is the responsibility of the homeowner to maintain an attractive yard (includes back yard areas that can be seen from the side and front of the lot). This will include the responsibility to mow, water, weed, and fertilize. Untidy yards (to include anything that can be seen from the front or side of lot) are subject to fines until said violation is resolved. Any change to the front yard, such as adding or removing steps, or walkways, requires approval in advance by the Architectural Review Committee.

*7. Open Burning:

No open burning or incineration of trash, refuse, yard waste or scrap of any kind is permitted within the city of Rock Hill. The City of Rock Hill Fire Department will be notified of all violations. Enforcement of this regulation will be in accordance with city ordinance. Please see number below.

8. Parking:

Parking vehicles on the streets of Rawlinson Road Community is prohibited except for guests who will remain for a short time. On-street parking for guests should be temporary—all temporary guests should use the homeowner’s driveway (first) if space is available. Homeowners and their family members must park in their garage and/or driveway. Parking on lawns is expressly prohibited. This rule will be strictly enforced due to the width of our streets and the need for emergency vehicle access at all times.

9. Solicitation:

Door to door solicitation is prohibited. Anyone doing this will be promptly reported to the Rock Hill Police Department. Please see number below. Children/grandchildren of residents selling for school fundraisers are exempt from this regulation.

*10. Vehicles:

No junk vehicles, recreational vehicles (to include ATV or off-road vehicles), house trailers, moving vans, trucks, tractors, trailers, vans, wreckers, hearses, buses, boats, boating equipment (to include boat hitch or trailer), travel trailers or camping equipment shall be parked on a homeowner’s lot, on any common land, on any public streets within the community, or parked within the boundaries of the community. All vehicles must be roadworthy and have current state license plate(s), registration, and insurance. **Work trucks/vans not requiring a “CDL” license for operation and required as a condition of employment are exempted from this restriction but must be parked in the garage and/or driveway and not on the street, and are limited to one per licensed adult driver**.

11. Auto Repairs:

No portion of the property shall be used for the repair of automobiles or vehicles. Repairs and maintenance may be performed only in the garage.

12. Trash Containers and Trash Pick Up:

The City of Rock Hill provides containers – green for general trash or garbage, blue for recycling. Full containers may be put out by the street no earlier than Wednesday evening, and must be brought in no later than Thursday night. Outside of those hours, trash containers must be located on the side or in the back of the house to minimize their visibility from the street.

13. Recreation and Play Equipment:

All basketball hoops shall be placed in the driveway or backyard of the homeowner facing away from the street. All backboards that face the street are subject to fines until such structure is removed from facing into the street. Backboards shall not be attached permanently to the house. Children’s play equipment (i.e. swings, slides, sand boxes, trampolines, etc.) must be located in the rear yard of the property and in a location selected to minimize the impact on neighboring properties. All playground equipment must be maintained in good working order, made of wood or other durable materials, and kept in a painted, rust-free condition.

14. Household Pets and Animals:

No horse, pony, cow, chicken, pig, hog, sheep, goat, or other domestic or wild animal shall be kept or maintained on any lot. Chain link kennels must be approved by the Architectural Review Committee. There are restrictions on their size and placement on the lot. Common household pets such as dogs and cats may be kept or maintained provided they are not kept for breeding. Pet owners may not infringe upon their neighbors or the community as a whole by allowing barking dogs or allowing pets to roam at large while unleashed. Homeowners are limited to two outside pets.

The Association has adopted specific Rules and Regulations governing pets. They are as follows:

A. The Board has requested the York County Animal Control to enforce all applicable portions of the County Code with regard to all animals within the community.

B. No permanent kennels set for breeding purposes are permitted on the property.

C. (*) Owners and custodians of pets shall not allow a pet to run at large. Pets must be on a leash when outside of the owners’ home or fenced yard. A dog or cat shall be deemed to run at large while roaming, running or self-hunting or when not restrained by a leash.

D. (*) It is against the law in York County for animals to become a public nuisance. This includes excessive barking, molesting passersby, chasing vehicles, attacking other domestic animals, damaging property and trespassing on private property. Owners of barking dogs may be in violation of the County’s noise ordinance.

E. All pets must have appropriate inoculations, licenses and tags as required by the City of Rock Hill or York County.

F. Pet owners shall be responsible for the immediate clean-up and proper disposal of pet waste. Pet owners shall be responsible for any and all costs incurred for the repair of damages to the common areas caused by their pet(s).

G. Residents or guests who own pets shall ensure their pets do not become a nuisance to other residents in the community. Actions, which may constitute a nuisance, include, but are not limited to, barking, crying and scratching.

H. Pets shall not be chained or confined in any common area.

I. Residents should report any violations of the above noted items to the York County Animal Control.

*15. Playing in the Street

The streets within the community are not play areas. Therefore, playing basketball, kick ball, soccer, football, baseball or any other sport is prohibited in the street. Children are not allowed to congregate in the street. The streets are limited to vehicular traffic. As per Rock Hill City ordinance, no signs put up by residents such as “children playing” shall remain on any street. Enforcement of this regulation will be in accordance with city ordinance.

16. Violations

The process for handling violations is as follows:

A. Complaint received from a member of the association in writing to the RRHOA Secretary.

B. Complaint will be investigated, and if verifiable and viable according to any or all of the covenants or restrictions, or rules and regulations that govern our community, a letter of violation will be sent immediately.

C. The letter will address the violation and give a timeframe for correction (a grace period of 7 to 30 days, depending on the nature of the violation).

D. Non-compliance will result in a fine(s) being implemented as follows:

1. A $50.00 fine will be assessed on the 1st day following the end of the grace period.

2. For succeeding each week thereafter for which a violation is not cured, an additional $25.00 fine will be assessed until the violation is corrected.

3. Non-payment of these accrued fines will result in a lien placed on the homeowner’s property (just as any lien may be placed on an owner’s property for nonpayment of assessments as set forth in the Declaration), which will be enforced through foreclosure in the same manner as a mortgage after fines are thirty (30) days late.

17. Non-Payment of Association Assessments (Dues):

The annual assessment is due on June 1st of each year and payable no later than June 30th of each year. Payments postmarked or received in person after June 30th shall be assessed a late penalty of $25. Late fees will NOT be waived unless an error in accounting can be shown, for which the owner is not to blame. All unpaid accounts will be referred to our attorney for collection and appropriate legal action on September 1st of each year. A lien may be placed on the homeowner’s property and enforced through foreclosure in the same manner as a mortgage on real property.

18. Amenities

The pool and clubhouse will be regulated by its own set of rules and regulations, which have been approved by the Board of Directors and this document will posted annually on our website and in a central location at the pool and clubhouse.

(*) All rules and regulations marked with this symbol (*) are enforced by city officials. The homeowner initiating the complaint should contact either the city police department, fire department, or animal control with their complaint first and follow-up with a written complaint to RRHOA second.

NOTE: These rules and regulations may be modified from time to time by vote of your Board of Directors, or by changes in City, State, or Federal law.
