This request for expressions of interest follows the General Procurement Notice for this project that appeared on-line in dgMarket on November 27, 2008 and in UN Development Business on November 28, 2008, as well as published on National Commission on Financial Markets web-site of free access.

The Republic of Moldova has received financing from the International Bank for Reconstruction and Development toward the cost of implementation of the Financial Sector Reform Project (FSRP), and intends to apply part of the proceeds under the contract for the development of the legislative and normative framework on health compulsory and facultative insurance.

The main objective of the consultancy assignment is to assess the existing regulatory framework in the field of compulsory and facultative health insurance, to establish a platform for development of public-private partnership concept in health insurance coordinated with the concerned institutions, and to develop amendments to the legal framework for public-private partnership development involving private insurance companies.

During the implementation of the assignment, the Consultant is expected to perform the following tasks:

1. Expertise the national legal framework in the field of compulsory and facultative health insurance and identify, based on best international practice and EU Directives of the needs for amendment and completion;

2. Develop the draft Law on amending and completing the legislative framework in the field of compulsory and facultative health insurance;

3. Develop the informative note including inter alia the regulatory impact assessment analysis (RIA) and the impact of the proposed amendments on the fiscal budget;

4. Analyze/review comments and proposal to draft Law to be provided by NCFM, the ministries and institutions and prepare report on the proposals/comments, containing information on the comments, remarks on acceptance or rejection of the proposals and argumentation;

5. Develop, based on the provided comments, the final draft Law on amendment and completion of the legal framework in the field of compulsory and facultative health insurance;

6. Develop the secondary normative framework for development of public-private partnership involving in the health insurance system the private insurance companies.

This assignment is requiring an experienced consultant (international company) with experience in:

• Development and amendment of laws / normative framework for insurance field and at least five years experience of work in the field;

• Experience in transposition / approximation of legislation with EU legislation in Central and Eastern European countries and familiarity with the legal system of CIS countries;

• Good experience of staff in collaboration with non-banking financial market regulators in development / amendment of legislation and normative framework;

• Successful experience with donor-financed projects of similar nature;

• Skills to communicate, analyze, prepare and submit reports and evaluations;

• List of regulations drafted and approved, currently implemented.

The Project Implementation Unit of the World Bank Competitiveness Enhancement Project now invites eligible Consultants (companies) to indicate their interest in providing the services. Interested companies must provide information indicating that they are qualified to perform the services (brochures, description of similar assignments, experience in similar conditions, availability of appropriate skills among staff, CVs of the key staff to be involved in the assignment, etc.). Consultants may associate to enhance their qualifications in form of joint venture (consortium or association), in which case the members will be jointly and severally liable and all members will sign the contract. This Request for Expression of Interest will lead to the preparation of a Short List of consultants. For evaluation of the expressions of interest for this assignment the following criteria will be applied:

• Company’ first hand experience in development and amendment of laws / normative framework in the field of insurance and at least five years experience of work in the field (40 points);

• Company’ first hand experience in transposition / approximation of legislation in Central and Eastern European countries and familiarity with the legal system of CIS countries (30 points);

• Company’ staff with experience in development / amendment of legislation and normative framework in the field of health insurance (20 points);

• Company’ successful prior experience in implementation of donors’ and/or IFIs’ sponsored projects (10 points).

A Consultant will be selected in accordance with the procedures set out in the World Bank’s Guidelines: Selection and Employment of Consultants by World Bank Borrowers, May 2004, Para. 3.7 “Selection Based on Consultants’ Qualification”.

The assignment will be implemented in the period from August to November, 2011 and will require an effort of approximately 60 man/days.
