Introduction: Detailed description of family of six living a life of poverty, illness and hunger, while moving from one homeless shelter to another and/or having to utilize public support services to survive due to lack of sufficient income and employment.

Statement of Background: 1973 Roe v. Wade Supreme Court Decision

Attempts to pass legislation restricting/rescinding abortion rights

Current climate in America on this polarizing issue

History of Partial Birth Abortion ban in Congress

Federal judges at state levels rule the ban unconstitutional

Proposition: The national legislation banning partial birth abortion is unconstitutional. It protects the right of women to choose whether to have an unwanted or unsupportable child, and it places an undue burden on women seeking abortions. Furthermore, if the Supreme Court decision Roe v. Wade is somehow violated by this ban, then the Partial Ban Abortion Act is a bad law and needs to be overturned.

Proof: Argument 1: Women possess the right to choose

R1: Why should that right be limited?

Argument 2: Women’s health and right of choice are endangered by the ban

R2: Partial birth abortions can solve many medical situations

Argument 3: The ban violates Roe v. Wade

R3: Like other legal constitutional changes in American history, (Emancipation

Proclamation, Restitution to Native American tribes, Women’s Suffrage, etc.), Roe v. Wade is an important law and should be upheld.

Argument 4: Abortion is a secular, not a religious issue. Those seeking to restrict

abortion are imposing their religious beliefs on others.

R4: Abortion is a human rights issue that is invalidated by the religious faith of

those who seek to protect the unborn. Subsequently, the ban on partial birth

abortions goes against the Constitutional tenet of Separation of Church and State.

Many other issues (Prohibition, Women’s right to vote) have been driven by those

motivated by their religious faith.

Argument 5: Restricting this type of abortion will lead to other restrictions based on

religious groups’ beliefs.

R5: There should not be restrictions on a woman’s choice. The ban on partial

birth abortions must be overturned or other restrictions will occur in other

Constitutionally mandated areas.

Refutation: Argument 1: The Constitution protects the right to life of every human being. Life,

liberty and the pursuit of happiness: Why life is fundamental.

Argument 2: Unborn children are human.

Conclusion: Citations from Declaration of Independence, National Organization for Women,

and Planned Parenthood. Final appeal to overturn Ban on Partial Birth Abortion

and continue to work for the continuation of Roe v. Wade and Constitutionally

guaranteed rights.
