I am writing in response to your request that the Treasury Inspector General for Tax Administration (TIGTA) provide you with a replacement photographic identification indicating that you are a retired law enforcement officer. Your request was made pursuant to the Law Enforcement Officers Safety Act of 2004 (Act), which exempts qualified retired law enforcement officers from State laws prohibiting the carrying of concealed firearms. Enclosed is an application for photographic identification.

In order to process your request, please provide the following documents:

1) A signed and dated Application For Retired Law Enforcement Officer Photographic Identification form;

2) A copy of Notification of Personnel Action (Standard Form 50) issued upon retirement;

3) A FBI Criminal Justice Information Services (CJIS) record check. Instructions for obtaining a copy of your record can be found at ;

4) A statement in writing that your previously-issued retired law enforcement officer identification has been lost, stolen, or destroyed;

5) A copy of the police report attesting to such loss or theft described above; and

6) A notarized copy of your certification that you have within the last year been tested or otherwise found by your State of residence to meet standards established by the State for training and qualification for active law enforcement officers to carry a firearm of the same type as the concealed firearm. The TIGTA will not reimburse you for any cost associated with this qualification requirement, and will not provide firearms qualification testing for a personally-owned firearm.

Upon receipt of the above-referenced documents, you will be directed to a local TIGTA office to have a digital photograph taken if necessary.

Please be advised that the Act excludes from the definition of firearm and does not authorize you to carry a machinegun, silencer, or any destructive device defined in section 18 U.S.C. § 921 (including a bomb, grenade, poison gas or mine). Also, the Act does not override state laws that permit private persons or entities to prohibit the possession of a concealed firearm on their property or the possession of firearms on any State or local government property, installation, building, base, or park. In addition, you may not be under the influence of alcohol or another intoxicating or hallucinatory drug or substance while carrying a concealed firearm.

It is important for you to understand that the Act does not convey any law enforcement authority and does not vest you with the power of arrest. Accordingly, you will not be provided representation by the Department of Justice in any suit arising from the carrying of a concealed firearm.
