NEW BUSINESS

#67-19: ACCEPT THE RECOMMENDATION OF THE SUPERINTENDENT

TO APPROVE A CONTRACT WITH THE PREBLE COUNTY

EDUCATIONAL SERVICE CENTER FOR THE 2019-2020

SCHOOL YEAR.

Mr. Moyer moved and Mr. Good seconded the motion to accept the recommendation of the Superintendent to approve a contract with the Preble County Educational Service Center for the 2019-2020 school year.

WHEREAS the PCESC and the TCNBOE hereby find and determine the

services for the handicapped provided by the PCESC are in the best

interests of the students and related services from students with handicaps,

and

WHEREAS the PCESC and the TCNBOE hereby find and determine the

services for the handicapped provided by the PCESC are in the best

interests of the students and related services from students with handicaps,

and

WHEREAS through adoption of identical resolutions, under which the

PCESC will provide certain services specified in the agreement;

THEREFORE BE IT RESOLVED that the contract between the PCESC

and the TCNBOE be adopted. (see attachment)

#69-19: AUTHORIZE CONTINUED MEMBERSHIP IN THE OHIO HIGH

SCHOOL ATHLETIC ASSOCIATION FOR THE 2019-2020

SCHOOL YEAR.

Mr. Schaar moved and Mr. Moyer seconded the motion to authorize continued membership in the Ohio High School Athletic Association for the 2019-2020 school year.

WHEREAS Tri-County North Local Schools has satisfied all the requirements

for membership in the Ohio High School Athletic Association, a voluntary

unincorporated association not-for-profit; and

WHEREAS the Board of Education and its Administration desire for the

schools with one or more grades at 7-12 grade level under their jurisdiction to

be voluntary members of the OHSAA;

NOW THEREFORE BE IT RESOLVED by the Board of Education that Tri-

County North do hereby voluntarily renew membership in the OHSAA and

that in doing so, the Constitution, Bylaws, Regulations and Business Rules of

the OHSAA are hereby adopted by this Board as and for its own minimum

student-athlete eligibility requirements. Notwithstanding the foregoing, the

Board reserves the right to raise student-athlete eligibility standards as it

deems appropriate for the schools and students under its jurisdiction; and

BE IT FURTHER RESOLVED that the schools under this Board’s

jurisdiction agree to conduct their athletics programs in accordance with the

Constitution, Bylaws, Regulations, Business Rules, interpretations and

decisions of the OHSAA and cooperate fully and timely with the Executive

Director’s office of the OHSAA in all matters related to the interscholastic

athletic programs of the schools. Furthermore, the schools under this Board’s

jurisdiction shall be the primary enforcers of the OHSAA Constitution,

Bylaws, Regulations, Business Rules and the interpretations and rulings

rendered by the Executive Director’s office. The administrative heads of these

schools understand that failure to discharge the duty of primary enforcement

may result in fines, removal from tournaments, suspension from membership

and/or other such penalties as prescribed in Bylaw 11.

THEREFORE BE IT RESOLVED that the Board authorizes membership and

agrees that all athletics will be conducted according to the Constitution,

Bylaws, Regulations, Interpretations and Decisions of the Ohio High School

Athletic Association. This resolution shall remain in effect for the 2019-2020

school year.

WHEREAS the gift herein described has been unconditionally offered to

the Tri-County North Local School District

WHEREAS the Board has the statutory authorization to accept such

gifts, providing such acceptance does not remove any portion of the

public school from the control of the Board,

NOW THEREFORE BE IT RESOLVED under the provisions of

ORC 3313.47 the Board hereby accepts the gift; and

BE IT FINALLY RESOLVED that the Board is appreciative of the

generosity of this gift and the remembrance of this school district and the

students.

ADMINISTRATIVE PERSONNEL

#73-19: RENEW CONTRACT FOR WILLIAM K. DERRINGER AS

SUPERINTENDENT.

Mr. Seibel moved and Mr. Good seconded the motion to renew the contract for William Derringer as Superintendent.

WHEREAS upon recommendation of the County Superintendent of Schools the following certificated personnel action and/or recommendation is made;

WHEREAS each local, exempted village, city, and joint vocational school district Board of Education shall appoint a Superintendent;

WHEREAS a Board of Education may during the period beginning the first of January of the calendar year immediately preceding the year the contract of employment of a superintendent expires and ending on the first day of March of the year it expires reemploy such superintendent for a succeeding term for not longer than five years, beginning July 1st immediately following the expiration of the current term and ending on June 30th of the year in which such succeeding term expires; and

WHEREAS at the time of making such appointment, the Board shall fix the compensation of the Superintendent.

NOW THEREFORE BE IT RESOLVED under the provisions of ORC 3319.01, the person herein named is hereby reappointed and reemployed Superintendent of Schools and Executive Officer for the Board of Education for the term and at the annual salary indicated: (see attachment)

Mr. Good moved and Mr. Schaar seconded the motion to re-employ Joe Finkbine as Elementary Principal.

WHEREAS upon recommendation of the local Superintendent, the following

recommendation for contract of administrative personnel is made; and

WHEREAS the Board of Education shall employ administrative personnel for

schools as the Board designated; and

WHEREAS the term of re-employment of an administrator shall not exceed

three years; and

WHEREAS the administrator’s effectiveness shall be evaluated according to

the duties included on the position’s job description; and

WHEREAS the administrative position and duties, salary and other

compensation, number of days to be worked, and any paid holidays in the

contractual year shall be included in the employment contract.

NOW THEREFORE BE IT RESOLVED under the provisions of ORC

3319.02, the person herein names is hereby re-employed for the term at the

initial annual salary indicated, with other conditions as set forth herein. (see

certificated persons for supplemental duties; and

WHEREAS the certificated persons listed below are acceptable to the

administration for the supplemental contract duty specified.

Mr. Schaar moved and Mr. Seibel seconded the motion to approve employment of classified extra-curricular personnel for the 2019-2020 school year.

WHEREAS the following extra-curricular positions have been offered to the

certificated employees of this school district with no acceptable responses;

WHEREAS the following extra-curricular positions have been offered to or

advertised to attract certificated persons not currently employed by this school

district with no acceptable responses; and

WHEREAS the non-certified individual(s) herein recommended have been

determined to meet the standard adopted by the State Board.

NOW THEREFORE BE IT RESOLVED that under the provisions of

ORC 3313.53 the following persons are employed for the 2019-2020 school

year at the same salary offered to certified persons for pupil activity program

as indicated.

WHEREAS the below mentioned individuals are being recommended to be

employed as volunteers; and

WHEREAS the individuals are not placed in charge of any class or activity;

NOW THEREFORE BE IT RESOLVED that the individuals mentioned

Mr. Moyer moved and Mr. Seibel seconded the motion to employ Jackie Miller as classified substitute personnel for the 2018-2019 school year.

WHEREAS to prepare for temporary absences of non-teaching personnel for

whom substitutes may be needed to provide support services in conjunction

with the management and control of the school; and

WHEREAS ORC 3313.47, grants authority for the Board of Education to

employ personnel on such a temporary, as needed, substitute basis

NOW THEREFORE BE IT RESOLVED that under the provisions of

ORC 3313.47, the following employment action is taken and such names

shall be listed on an approved list of substitute personnel.
