Call to Order

The meeting was called to order at 6:45 PM.

Roll Call

Present: Town Attorney Brandon Dittman, Mayor Sue Hauser, Trustee Wendy Koch, Trustee Richard McClellan, Trustee Dave Jakobik, Police Chief John Stein, Town Clerk Jeannette Piel.

Absent: Trustee Shawn McElroy, Trustee Denise Tennant.

Approval of Agenda

Changes: We removed #7 from the agenda, donation to KGOAT Radio.

We added two items to the agenda, Resolution 19-05 – Supplemental Budget and Appropriation – General Fund, and Resolution 19-07 – Supplemental Budget and Appropriation – Centennial Fund.

TRUSTEE KOCH MOTIONED TO APPROVE THE AGENDA, FOR DECEMBER 10, 2019, WITH THE ABOVE CHANGES, TRUSTEE MCLELLAN PROVIDED THE SECOND AND ALL WERE IN FAVOR.

Approval of Minutes

Corrections: One typo, correct the spelling of Brandon.

TRUSTEE KOCH MOTIONED TO APPROVE THE MINUTES FOR NOVEMBER 19, 2019, WITH THE ABOVE CORRECTION, TRUSTEE MCELROY PROVIDED THE SECOND AND ALL WERE IN FAVOR.

Appointment of Trustee

Mayor Hauser read the letter of intent to be on the Board of Trustees from Linda Robertson.

TRUSTEE JAKOBIK MOTIONED TO APPOINT LINDA ROBERTSON AS A MEMBER OF THE BOARD OF TRUSTEES FOR THE TOWN OF EMPIRE, TRUSTEE KOCH PROVIDED THE SECOND AND ALL WERE IN FAVOR.

Resolution 19-05 – Supplemental Budget and Appropriation – General Fund

TRUSTEE KOCH MOTIONED TO APPROVE RESOLUTION 19-05: A RESOLUTION FOR SUPPLEMENTAL BUDGET AND APPROPRIATION – GENERAL FUND, TRUSTEE MCCLELLAN PROVIDED THE SECOND AND ALL WERE IN FAVOR. Effective immediately.

Resolution 19-06 – Supplemental Budget and Appropriation – Water Fund

Resolution 19-09 – Levying General Property Taxes for the Year 2020 to Help Defray the Costs of Government for the Town of Empire, Colorado for the 2020 Budget Year

TRUSTEE KOCH MOTIONED TO APPROVE RESOLUTION 19-09: A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF EMPIRE, LEVYING GENERAL PROPERTY TAXES FOR THE YEAR 2020 TO HELP DEFRAY THE COSTS OF GOVERNMENT FOR THE TOWN OF EMPIRE, COLORADO FOR THE 2020 BUDGET YEAR, TRUSTEE MCCLELLAN PROVIDED THE SECOND AND ALL WERE IN FAVOR. Effective immediately.

Resolution 19-10 – Appropriate Sums of Money

TRUSTEE MCCLELLAN MOTIONED TO APPROVE RESOLUTION 19-10: A RESOLUTION TO APPROPRIATE SUMS OF MONEY, TRUSTEE JAKOBIK PROVIDED THE SECOND AND ALL WERE IN FAVOR. Effective immediately.

Resolution 19-11 – Summarizing Expenditures and Revenues for Each Fund and Adopting the Budget for the Town of Empire, Colorado for the Calendar Year 2020

TRUSTEE MCCLELLAN MOTIONED TO APPROVE RESOLUTION 19-11: A RESOLUTION SUMMARIZING EXPENDITURES AND REVENUES FOR EACH FUND AND ADOPTING THE BUDGET FOR THE TOWN OF EMPIRE, COLORADO FOR THE CALENDAR YEAR 2020, TRUSTEE KOCH PROVIDED THE SECOND AND ALL WERE IN FAVOR. Effective immediately.

The above-named Resolutions will all be sent to Clear Creek County and to DOLA.

Follow-up on Zoning Officer

TRUSTEE KOCH MOTIONED TO CONTINUE THE APPOINTMENT OF POLICE CHIEF JOHN STEIN AS INTERIM ZONING OFFICER UNTIL SOMEONE IS APPOINTED TO THE POSITION, TRUSTEE MCCLELLAN PROVIDED THE SECOND AND ALL WERE IN FAVOR.

The Zoning Officer checks to see if plans meet setbacks, offsets, open space, and zoning requirements. They do not handle building permits. It is a volunteer position. We will continue to advertise in town to fill the position.

Reports

• Police – Chief Stein provided a monthly report. The department bought three new radios. Roads will be closed periodically for rock blasting; the police department will keep everyone informed of upcoming dates.

• IT – Trustee Jakobik was asked to get the projector hooked up and running again. Also, we need admin passwords for the computers, and to get the laptop running again.

• Mayor –

SCADA – The system that monitors the water system radio signal is not working. We need to use a PLC, estimate is $5000.00. Trustee Jakobik will call Jeff at SCADA to get clarification on the repair.

Trustee Robertson asked about the status of the water meters. We are still working on getting the system running at 100%. We have an appointment with Stan Wells to evaluate our system.

Trustee Jakobik will help Terry Gray mount and plug in the Christmas wreath on the side of Town Hall.

• Fire Authority – No report.

• Attorney – The Police can handle legal duties at court such as standardized plea agreements and can approach and speak with the judge during court. A meeting was held December 13th, 2019, with our Attorneys, Municipal Judges, Police Officers, and Municipal Clerk, to discuss the change.

• Town Hall – Clerk Piel gave a report on the Christmas Party, including upcoming dates, donations, door prizes, and RSVP’s.

• Parks and Recreation – No Report.

• Streets and Maintenance – No Report.

• Water/Wastewater – Following a meeting with DOLA, our water engineer, Rob Anderson from JVA, is writing a recommendation for improvements to our water treatment system.

• CDOT – No Report.

• CCEDC – No Report.
