The regular monthly meeting of the Board was called to order by the Chairman at 9:30 a.m. in the Conference Room of the Board’s offices, Baton Rouge, Louisiana. Members of the Board present:

Finding a quorum present, the regular order of business began.
Also attending the meeting were: Michael B. Judge Darrell White gave the invocation.
Judge Darrell White then introduced himself, and advised those present of his duties.
A Motion was made by Mr. Weston and seconded by Mr. Stuart to accept the Minutes of the March 17th, 2011 regular meeting. The Motion passed.
Mr. McDuff introduced special guests, Mr. Ken Naquin with the Louisiana AGC, Mr. Jonathan Holloway, Mr. Mike Pin and Mr. Billy Ward.

Administrative Hearing - Consider suspending or revoking Louisiana Contractor’s License number 54063, held by Abeja Enterprises, LLC, for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.
Ms. Fitch read the allegations and asked if a representative was present. No representative was present.
A Motion was made by Mr. Clouatre and seconded by Mr. Dupuy to revoke License number 54063.

Administrative Hearing - Consider suspending or revoking your Louisiana Contractor’s License number 39068, held by Contech Control Services, Inc., for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.
Ms. Fitch read the allegations and asked if a representative was present. No representative was present.
A Motion was made by Mr. Clouatre and seconded by Mr. Dupuy to revoke License number 39068.

Ms. Fitch read the allegations and asked if a representative was present. No representative was present.

JUDGMENT HEARING(S):
C&S Builders of Baton Rouge, LLC
Administrative Hearing – Consider an alleged violation by C&S Builders of Baton Rouge, LLC of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a consent judgment which was rendered by the 19th Judicial District Court, No. 548-439 “24”, Parish of East Baton Rouge, State of Louisiana, on the 29th day of November, 2007, in which Schowanda Michael, Cardell A. Michael, and C&S Builders of Baton Rouge, LLC, holder of Commercial Contractor’s License number 43613, were ordered jointly, severally, and in solido to pay in the principal amount of SIX THOUSAND SEVEN HUNDRED THIRTY ONE DOLLARS AND 05/100 ($6,731.05) with interest at the legal rate on each unpaid invoice commencing twenty days after the date of the invoice until paid, attorney’s fees of $1,250.00, and all costs of court in favor of The Sherwin-Williams Company.
Ms. Fitch read the allegations and asked if a representative was present. Ms. Schowanda Michael, wife of Cardell A. Michael, appeared on behalf of C&S BUILDERS OF BATON ROUGE, LLC. Mr. Frank White, attorney, appeared on behalf of Sherwin Williams. Ms. Michael told the Board she wished to dissolve the company and would be surrender her license.
A Motion was made by Mr. Weston and seconded by Mr. Dupuy to accept the surrendering of License number 43613. The Motion passed.
Keyt Builders & Development, LLC
Administrative Hearing – Consider an alleged violation by Keyt Builders & Development, LLC of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the 22nd Judicial District Court, No. 2009-17167, Division “B”, Parish of St. Tammany, State of Louisiana, on the 10th day of February 2010, in which Justin L. Tice, Jason Keyt, and Keyt Builders & Development, LLC, holder of Commercial Contractor’s License number 50164 and Residential Contractor’s License number 880052, were ordered to pay jointly, severally, and in solido in the principal amount of FOUR THOUSAND FOUR HUNDRED NINETY-FOUR DOLLARS AND 68/100 ($4,494.68) plus interest at the per annum rate of 18% on each unpaid invoice commencing from the twentieth day of the month following the month of the invoice until paid, attorney’s fees the amount of $1,000.00, and all costs of court in favor of The Sherwin-Williams Company.
Ms. Fitch read the allegations and asked if a representative was present. Todd Reeves, attorney, and Jason Keyt of KEYT BUILDERS & DEVELOPMENT, LLC were present. Mr. Frank White, attorney, appeared on behalf of Sherwin Williams. Mr. Reeves stated that his client wished to resolve the matter.
A Motion was made by Mr. Weston and seconded by Mr. Dupuy to give Mr. Keyt 60 days to resolve the outstanding matter with the debtor. The Motion passed.
Narco Construction, LLC
Administrative Hearing – Consider an alleged violation by Narco Construction, LLC of the provisions of Louisiana R.S. 37:2150 - 2192, The Contractors’ Licensing Law, and in particular Section 2158, Paragraph A (9), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you, Mr. Tice, have failed to properly engage in the business of contracting as demonstrated by your prior contracting business experience due to an alleged violation by you of the above statutes. This violation is based on the fact that you, Mr. Tice as one of the Members of Narco Construction, LLC, holder of Commercial Contractor’s License number 51358 and Residential Contractor’s License number 880353, (both of which can still be renewed) have a judgment which was rendered by the 22nd Judicial District Court, No. 2009-17167, Division “B”, Parish of St. Tammany, State of Louisiana, on the 10th day of February 2010, in which Justin L. Tice, Jason Keyt, and Keyt Builders & Development, LLC, holder of Commercial Contractor’s License number 50164 and Residential Contractor’s License number 880052, were ordered to pay jointly, severally, and in solido in the principal amount of FOUR THOUSAND FOUR HUNDRED NINETY-FOUR DOLLARS AND 68/100 ($4,494.68) plus interest at the per annum rate of 18% on each unpaid invoice commencing from the twentieth day of the month following the month of the invoice until paid, attorney’s fees the amount of $1,000.00, and all costs of court in favor of The Sherwin-Williams Company.

The ARC Group Inc. of Tennessee
Administrative Hearing – Consider an alleged violation by The ARC Group Inc. of Tennessee of the provisions of Louisiana R.S. 37:2150 - 2192, The Contractors’ Licensing Law, and in particular Section 2158, Paragraph A (9), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you, Mr. Tice, have failed to properly engage in the business of contracting as demonstrated by your prior contracting business experience due to an alleged violation by you of the above statutes. This violation is based on the fact that you, Mr. Tice as the only officer of The ARC Group Inc. of Tennessee, holder of Home Improvement Registration Number 554229, have a judgment which was rendered by the 22nd Judicial District Court, No. 2009-17167, Division “B”, Parish of St. Tammany, State of Louisiana, on the 10th day of February 2010, in which Justin L. Tice, Jason Keyt, and Keyt Builders & Development, LLC, holder of Commercial Contractor’s License number 50164 and Residential Contractor’s License number 880052, were ordered to pay jointly, severally, and in solido in the principal amount of FOUR THOUSAND FOUR HUNDRED NINETY-FOUR DOLLARS AND 68/100 ($4,494.68) plus interest at the per annum rate of 18% on each unpaid invoice commencing from the twentieth day of the month following the month of the invoice until paid, attorney’s fees the amount of $1,000.00, and all costs of court in favor of The Sherwin-Williams Company.
This matter was consolidated with the NARCO CONSTRUCTION, LLC, above.
REEVES DEVELOPMENT, LLC
Administrative Hearing – Consider an alleged violation by REEVES DEVELOPMENT, LLC of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the 22nd Judicial District Court, No. 2010-13851, Division “H”, Parish of St. Tammany, State of Louisiana, on the 6th day of October, 2010, in which Houma Dollar Partners, L.L.C., Charles Reeves, Jr., and Reeves Development, L.L.C., holder of Commercial Contractor’s License number 35239 were ordered to pay in the principal amount of TWENTY-EIGHT THOUSAND ONE HUNDRED THIRTY-ONE DOLLARS AND 54/100, ($28,131.54) plus interest at the per annum rate of 18% on each unpaid invoice starting thirty days from the invoice date, attorney’s fees in the amount of $2,500.00, and all costs of court, including the costs of filing the Statement of Claim or Privilege Under the Private Works Act in favor of Standard Materials, LLC.
IT IS FURTHER ADJUDGED AND DECREED THAT JUDGMENT BE RENDERED AND ENTERED IN FAVOR OF Standard Materials, LLC and against Houma Dollar Partners, L.L.C., in the principal amount of TWENTY-EIGHT THOUSAND ONE HUNDRED THIRTY-ONE DOLLARS AND 54/100 (28,131.54 plus interest at the legal rate from the date of judicial demand, and all costs of court, including the costs of filing the Statement of Claim or Privilege Under the Private Works Act. This award is joint, several, and in solido with that in the preceding paragraph.
IT IS FURTHER ADJUDGED AND DECREED that judgment be rendered and entered in favor of Standard Materials, LLC and against Charles Reeves, Jr. in the principal amount of TWENTY- EIGHT THOUSAND ONE HUNDRED THIRTY-ONE DOLLAARS AND 54/100 ($28,131.54) plus interest on the principal award at the per annum rate of 18% on each unpaid invoice starting thirty days from the invoice date, plus a penalty in the amount of ELEVEN THOUSAND THREE HUNDRED DOLLARS AND 76/100 ($11,300.76), plus interest on this penalty at the legal rate from the date of judicial demand until paid, plus attorney’s fees in the amount of $500.00, and all costs of court including the cost of preparing and filing the Statement of Claim of Privilege Under the Private Works Act. This award is joint, several, and in solido with that against Reeves Development, L.L.C.
IT IS FURTHER ADJUDGED AND DECREED that the privilege Standard Materials, LLC has in the following property in the amount of the award against Houma Dollar Partners, L.L.C. be recognized: A certain parcel of land, lying and situated in Section 44, Township 9 South, Range 14 East, Saint Tammany Parish, Louisiana and more fully described as follows: Commence at the intersection of the South right-of-way line of Markham Drive and the East right-of-way line of Pontchartrain Drive a/k/a U.S. Highway 11 and measure S26’37’00”W along the East right-of-way line of Pontchartrain Drive a/k/a U.S. Highway 11 a distance of 300.00 to a 5/8 iron rod being the point of beginning. Thence N26’37’00”E – 155.00’ along the east right-of-way line of Pontchartrain Drive a/k/a U.S. Highway 11 to a /12/ iron rod; thence S63’23’00”E 240.27” to a ½ iron rod; thence S26’39’38‘ W (actual) 26’37’00W (record) – 155.00’ to a ½ pipe; thence N63’23’00 ‘‘W –240.15’ (actual) 240.00’ (record) to the East right-of-way line of Pontchartrain Drive a/k/a U.S. Highway 11 being the point of beginning and containing 37.232 square feet or 0.855 acre.”
Ms. Fitch read the allegations and asked if a representative was present. Mr. Charles Reeves appeared on behalf of REEVES DEVELOPMENT, LLC. Mr. Frank White, attorney, appeared on behalf of Sherwin Williams.
A Motion was made by Mr. Weston and seconded by Mr. Clouatre to give Mr. Reeves 60 days to resolve the outstanding matter with the debtor. The Motion passed.
Compliance Hearing(S):
Englobal Construction Resources, Inc.
Administrative Hearing – Consider an alleged violation by Englobal Construction Resources, Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Englobal Construction Resources, Inc., acted as a contractor to perform work on the South Louisiana Ethanol Plant project in Belle Chasse, Louisiana in the amount $8,620,336.39 without possessing a Louisiana State contractor’s license.
Ms. Laborde informed the Board that Mr. Bruce Shreves, an attorney for ENGLOBAL CONSTRUCTION RESOURCES, INC. was present and was prepared to present a settlement offer to the Board.
A Motion was made by Mr. Clouatre and seconded by Mr. Stuart to accept the settlement offer, constituting an admission of guilt, payment of a $10,000 fine, and court costs. The Motion passed.
Sunset Solutions, LLC,
Administrative Hearing – Consider an alleged violation by Sunset Solutions, LLC, holder of State Commercial License number 51091, of the provisions of Louisiana R.S. 37: 2158 (A) of the State of Louisiana Contractors’ Licensing Law, and in particular Paragraph 9, problems relating to the ability of the contractor, its qualifying party, or any of its principal owners or principal shareholders to engage in the business of contracting, as demonstrated by their prior contracting business experience, at but not limited to the Family Dollar Project in Baton Rouge, Louisiana.
Ms. Bobbie Hughes read the allegations against SUNSET SOLUTIONS, LLC., and informed the Board that an attorney was present. Ms. Laborde informed the Board that Mr. Dejean would be presenting the Board with a settlement offer. Mr. Andy Dejean informed the Board that he was representing Mr. Shane Grimmett. Mr. Grimmett was sworn in. Ms. Laborde summarized the terms of the settlement offer for the Board.
A Motion was made by Mr. Clouatre and seconded by Mr. Stuart to accept the settlement of 15 months of supervised probation, payment of a $1,000 fine and court costs, payment of a $150.00 per month supervision fee, and submission of monthly reports of his company and the company owned by Mr. Grimmett and his father, including copies of all contracts, bids and financial statements. The Motion passed.
B & T Construction, LLC
Administrative Hearing – Consider an alleged violation by B & T Construction, LLC of the provisions of Louisiana R.S. 37:2158 (A,5) of the State of Louisiana Contractors’ Licensing Law, in that B & T Construction, LLC. has permitted its State contractor’s license number 44720 to be used by another when the other contractor does not hold a license for the classification of work for which the contract is entered for apartment complex renovations at 3223 3rd Street in New Orleans, Louisiana.
Ms. Bobbie Hughes read the allegations against B & T Construction, LLC, and asked if a representative was present. Mr. Brian Porche was present on behalf of B & T CONSTRUCTION, LLC. Mr. Porche was sworn in and admitted the allegations.
A Motion was made by Mr. Lambert and seconded by Mr. Clouatre and Mr. Gallo to accept the plea.
The Motion passed.
A Motion was made by Mr. Lambert and seconded by Mr. Dupuy to fine Mr. Porche $1,000.00 plus court costs. The Motion passed.
Jennings Builders, LLC
Administrative Hearing – Consider an alleged violation by Jennings Builders, LLC of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Jennings Builders, LLC, acted as a contractor to perform apartment complex renovations at 3223 3rd Street in New Orleans, Louisiana, in the amount of $302,686.00 without possessing a Louisiana State contractor’s license.
Ms. Bobbie Hughes read the allegations against JENNINGS BUILDINGS, LLC, and asked if a representative was present. No representative was present. Ms. Laborde called Mr. Lynwood Allemore to the stand and he was sworn in. Ms. Laborde asked Mr. Allemore, Investigator, to review and identify the documents in the exhibit package. Ms. Laborde asked that the exhibit package be introduced into the record. Judge White admitted the package.
A Motion was made by Mr. Meredith and seconded by Mr. Clouatre to find JENNING BUILDERS, LLC, in violation. The Motion passed.
A Motion was made by Mr. Meredith and seconded by Mr. Gallo to fine JENNING BUILDERS, LLC, $30,200 plus court costs. The Motion passed.
EnergyWise Products, LLC.,
Administrative Hearing – Consider an alleged violation by EnergyWise Products, LLC., of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, EnergyWise Products, LLC, acted as a contractor by bidding and/or contracting to perform work at The Mitchell’s Residence located at 4424 Ihles Road in Lake Charles, Louisiana, in the amount of $470,644.08 without possessing a Louisiana State contractor’s license.
Ms. Bobbie Hughes read the allegations against ENERGYWISE PRODUCTS, LLC, and asked if a representative was present. No representative was present. Ms. Laborde asked that the evidentiary portion of this matter be combined with item 6 on the agenda. Judge White approved. Ms. Laborde called Mr. Mark Mary, Investigator, to the stand and he was sworn in. Ms. Laborde asked Mr. Mary to review and identify the documents in the exhibit package. Ms. Laborde asked that the exhibit package be introduced into the record. Judge White admitted the package.

Brandon’s Sheet Metal Co.
Administrative Hearing – Consider an alleged violation by Brandon’s Sheet Metal Co. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Brandon’s Sheet Metal Co. acted as a contractor to perform mechanical work at The Mitchell’s Residence located at 4424 Ihles Road in Lake Charles, Louisiana in the amount of $60,000.00 without possessing a Louisiana State contractor’s license.
Ms. Bobbie Hughes read the allegations against BRANDON’S SHEET METAL CO., and asked if a representative was present. No representative was present. The evidentiary portion of this matter had previously been combined with item 5 on the agenda.
A Motion was made by Mr. Lambert and seconded by Mr. Gallo to find BRANDON’S SHEET METAL CO. in violation. The Motion passed.
A Motion was made by Mr. Lambert and seconded by Mr. Gallo to fine BRANDON’S SHEET METAL CO. the maximum fine of 10% plus court costs. The Motion passed.
Hunter Building Corporation
Administrative Hearing – Consider an alleged violation by Hunter Building Corporation of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Hunter Building Corporation acted as a contractor to renovate the Spencer Gifts Store in Bossier City, Louisiana, in the amount of $56,694.00 without possessing a Louisiana State contractor’s license.
Ms. Bobbie Hughes informed the Board that she had received a settlement offer of $500.00 plus court costs by HUNTER BUILDING CORPORATION and read the allegations.
A Motion was made by Mr. Weston and seconded by Mr. Gallo to accept the settlement offer of HUNTER BUILDING CORPORATION. The Motion passed.
Lakefront Pile Driving, L.L.C.
Administrative Hearing – Consider an alleged violation by Lakefront Pile Driving, L.L.C. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Lakefront Pile Driving, L.L.C. acted as a contractor to perform work on the Marina Entrance Channel Bulkhead Restoration project in Mandeville, Louisiana in the amount of $84,828.00 without possessing a Louisiana State contractor’s license.
Mr. Talbot recused himself. Ms. Bobbie Hughes read the allegations against LAKEFRONT PILE DRIVING, LLC, and asked if a representative was present. No representative was present. Ms. Laborde called Mr. Lynwood Allemore to the stand and he was sworn in. Ms. Laborde asked Mr. Allemore, Investigator, to review and identify the documents in the exhibit package. Ms. Laborde asked that the exhibit package be introduced into the record. Judge White admitted the package.

Carroll Voisin
Administrative Hearing – Consider an alleged violation by Carroll Voisin of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Carroll Voisin acted as a contractor to perform work on the Council on Aging project in Houma, Louisiana in the amount of $182,595.00 without possessing a Louisiana State contractor’s license.
Mr. Talbot recused himself. Ms. Bobbie Hughes read the allegations against CARROLL VOISIN, and asked if a representative was present. Mr. Carroll Voisin was present, approached the stand and was sworn in. Mr. Voisin entered a no contest plea.
A Motion was made by Mr. Lambert and seconded by Mr. Clouatre to accept the plea. The Motion passed.
A Motion was made by Mr. Lambert and seconded by Mr. Fenet to suspend any fine if within 6 months a license is obtained; if not, a fine of $1,000.00 will be imposed. The Motion passed.

Administrative Hearing – Consider an alleged violation by, SIMS, L.L.C. of the provisions of Louisiana R.S. 37:2150-2192, of the Contractors’ Licensing Law, and in particular Section 2158 (A)(5). This hearing is being called for reason that, on information and belief, Sims, L.L.C., permitted the use of its license by another when the other contractor does not hold a license for the classification of work for which the contract is entered at, but not limited to, 776 Highway 3005, Ruston, Louisiana.
The request for delegation of authority to hear this violation by the Residential Building Committee, in connection with the alleged violation on behalf of Fisher & Fisher Home Improvement, L.L.C.
