Vicki Petersen called the meeting to order at 1:15 p.m.

□ Review of the April 30, 2009 minutes.

□ No corrections or changes.

□ David Valenzuela motioned to approve the minutes, Barbara Chambers seconded the motion.

□ Minutes were approved.

III. LEGISLATIVE UPDATE

Pending bills were discussed.

AB 307; AB 568; AB 724; AB 906; SB 20; SB 106; SB 599; SB 748; SB 767 were all dropped from our tracking list.

AB 827 pertaining to archiving of historical county records was discussed in detail. The committee discussed whether or not we should change our ‘watch’ position to either ‘support’ or ‘oppose’ based on the idea that this bill while affecting County Recorder’s could also at some point affect County Clerk records. The committee discussed whether or not the Recorder had ‘officially’ taken a position on this bill. The information shown in the bill history did not show an official position by CRAC, however Kathie Moran had spoken with Marv Hackett, CRAC Leg Committee Chair and he indicated some liked the bill, some did not and the Recorder ultimately ‘opposed’ the bill, however, Barbara Chambers, Gina Alcomendras, and Karen Varni all of whom sit on the Recorder Legislative Committee said that position had changed to ‘support’ and that Craig Kramer, Sacramento County & Gilbert Carter, Fresno County were working with the author on amendments that would be acceptable to Recorder’s so that they could support the bill. County Clerk’s decided to leave our position as ‘watch’.

SB 115 pertaining to an ‘alternate statement to oath’ for those who decline to take and subscribe the oath required by section 3 of Article XX of the California Constitution based on moral, ethical, or religious beliefs that conflict with their ability to take and subscribe the oath without mental reservation, can instead take and subscribe to the alternate oath provided by California state law was discussed. Gina and Wardell will work on a sample alternate statement and it will be discussed at the next Legislative Committee meeting.

V. CACEO ANNUAL CONFERENCE

Kathie Moran, Colusa County, Julie Bustamante, Lassen County and the Northern CA counties are hosting the CACEO Annual Conference. Kathie advised that attendance was better than anticipated given the difficult budgetary constraints counties are facing, and encouraged all attendees to visit the vendors, participate in the sessions and to have a good time while learning as much as possible.

VI. NEXT MEETING

The next County Clerk Legislative Committee meeting will be September 17, 2009 at the Sacramento County Clerk/Recorder’s Office
