DELTA DELTA CHAPTER OF THE DELTA SIGMA PHI FRATERNITYHOUSING AGREEMENTThis HOUSING AGREEMENT (the “Agreement”) is entered into among:The Delta Delta Chapter of the Delta Sigma Phi Fraternity, with its principal place of business in the City of West Lafayette, County of Tippecanoe, State of Indiana (hereinafter referred to as the "Fraternity");The Delta Delta of Delta Sigma Phi House Corporation, a not-for-profit corporation organized and existing under the laws of the State of Indiana (hereinafter referred to as the "Housing Corporation");_______________________________________________, (Print Full Name) a boarder, Pledge, Alumni Member or initiated Member of the Fraternity (hereinafter referred to as the "Member"); and_______________________________________________, (Print Full Name) the parent or legal guardian of Member (hereinafter referred to as the "Parent/Guardian").DESCRIPTION OF THE TERMS OF AGREEMENTThis Agreement shall be governed by the Laws of the State of Indiana.By signing this Contract, Member acknowledges that he has read it completely and understands that he is liable for any debt that he incurs when he is under the provisions of this Contract. MEMBER PRIVILEGES AND OBLIGATIONSThe Delta Delta Chapter of Delta Sigma Phi Fraternity agrees to lease to the Member room accommodations and to furnish food services for the 2017/2018 school year, in the Delta Sigma Phi Chapter house located at 341 Northwestern Avenue, West Lafayette, Indiana 47906. Room accommodations and food service will be provided for two (2) succeeding semesters (hereafter identified as Fall semester and Spring semester), with specific room occupancy and food service dates defined in Sections V - VII of this contract. Member must be enrolled at Purdue University West Lafayette campus to enter into this Agreement, otherwise this Agreement is void. However, the Housing Corporation can allow non-Purdue University students to enter into this Agreement by communicating that fact in writing to the Member, which will allow the Agreement to be valid and not voided. ROOM AVAILABILITY To accommodate an orderly move-in process, the Member may occupy his room for the Fall semester at any time on or after August 14, 2017 through noon on the Sunday following the last day of Fall semester finals. Food services will begin with the first day of classes in the Fall semester and end on the last day of Fall semester finals. The Member may occupy his room for the Spring semester at any time on or after January 6, 2018 through noon on the Sunday following the last day of Spring semester finals. Food services will begin with the first day of classes in the Spring semester and end on the last day of Spring semester finals.The Member agrees that the Housing Corporation has the right to change the dates and times of opening or closing of the Chapter house in the event of weather issues or other urgent conditions that cause a change to occur. Room availability and food service will be continuous from the start to end dates noted in this section above, with the exception of vacation periods as stated by the Purdue University calendar, and other specific occasions as determined by the Fraternity. When vacation periods are specified by Purdue University during the Fall and Spring semester, rooms will be unavailable (except for personal storage) from the start of the vacation period until 24 hours prior to the end of the vacation period. Food service will be unavailable during the entire vacation period.RULES AND REGULATIONS Member understands that this association to the Fraternity and living in the Chapter House while a Student of Purdue University (or a non-Purdue student if agreed to in writing by the Housing Corporation) is a matter of privilege which is not extended to everyone. Member agrees that he will abide by all present and future constitutions, by-laws, rules and regulations which the Fraternity and its Housing Corporation enact in order to be associated with this Fraternity under this contract. Fraternity also reserves the right to fix, modify or change such regulations applicable to use by Member associated with such items as room space and dining facilities and to determine times, methods and kinds of food to be served and other administrative matters. Any violation of the Fraternity’s rules and regulations is subject to a fine or other disciplinary measure as stated within the Fraternity Constitution and By-Laws. In addition, at the discretion of the Executive Board of the Fraternity, this contract may be called for review if the actions of the Member so warrant. The Executive Board of the Fraternity, upon review, may elect to recommend to the Fraternity the termination of this contract. Upon that decision, the Fraternity must notify the Member, in writing, of the date that the matter will be brought before the Fraternity. The Member will be allowed to attend the chapter meeting, plead his case and then leave the meeting. The Fraternity will then make its decision in that meeting, per Section IV of this contract.Any violation of the Housing Corporation policies will be subject to the fine or disciplinary measure that is stated as a part of that policy. Fines levied by the Housing Corporation become a debt of this contract. Disciplinary measures can be up to and including termination of this contract, handled according to the terms of Section VIII of this contract.The Fraternity and the Housing Corporation shall have no responsibility for the theft, destruction, or loss of moneys, valuables, or other personal belongings to or in the custody of the Member, from any cause whatsoever, whether such losses occur from the Member's room, storage areas, common areas, or elsewhere in the Chapter House. Member is encouraged to carry his own personal property insurance.ROOM ASSIGNMENTS Room assignments shall be made according to the by-laws of the Fraternity, through Power of the Vice-President of the Fraternity. By policy of the Housing Corporation, no single room assignments can be made. Member acknowledges that he will reside in either a 2 man or 3 person room by default. However, those individuals who have already lived in the chapter house for 4 semesters will be exempted in the Housing Corporation policy and be able to reside in 1 person rooms. ROOM RENT AND BOARD Room and Board shall be payable on one of three plans at the choice of Member as set forth below. All monthly rent payments (i.e. Plan 1) are due before the 15th of each month and any remaining balance not received before the 15th of each month shall be automatically subject to a 2% late fee for the balance due on the Account. This shall be added to Members house bill and considered to be a part of room and board. Semester plans (i.e. Plan 2) must be paid before the 15th of the first full month of the start of the semester that is being paid to be eligible for the Plan 2 discount. If the semester plan is not paid within this timeframe, the contract automatically reverts to Plan 1, with no pro-ration. Yearly plans (i.e. Plan 3) must be paid before the 15th of the first full month of the Fall semester to be eligible for the Plan 3 discount. If the yearly plan is not paid within this timeframe, the contract automatically reverts to Plan 1, with no pro-ration. If actual invoicing date differs from the dates listed in this contract, the due date of the invoice will supersede the date set in this document. Room and Board plan choice must be done at contract signing. This choice is made on the Signature page of this contract. Failure to mark the plan of choice assumes that Plan 1 (monthly plan) is selected. Member or Guarantor can petition the Housing Corporation in writing to change the plan for the second semester. However, Plan 1 will be in place for first semester. Also, if Member or Guarantor select a payment plan other than the one desired, then Member or Guarantor can petition the Housing Corporation in writing to change the plan for the second semester. However, the Plan selected will be in place for first semester.It is the intention of the parties to this Contract to obligate Member and Fraternity to the terms of the Contract at the time that the Contract is signed which will generally be in the spring of the year prior to commencement of school the following Fall. Because the final budget cannot be established prior to knowing the exact number of persons who will be living in the fraternity house in the Fall (living in the fraternity house being defined as the Fraternity having a signed and guaranteed contract), the anticipated Room and Board set forth below is the best estimate possible as to the anticipated cost. If the member reaches their 4th semester during the fall semester of an academic year, this discount will take effect at the start of the next full academic year. It is specifically agreed by the parties to this Contract that the appropriate scenario and the Final Room Rent and Board will be established on the second day of classes of the Fall Semester by a three-quarter vote of the Active Chapter subject to the approval of the Housing Corporation. Member and Guarantors by execution of this Contract are reserving a place for Member in the Chapter House for the school year indicated in this agreement. Member and Guarantor hereby agree to pay the Room Rent and Board established by the Fraternity for that school year in the amount so established pursuant to the procedure set forth above. Guarantors understand that an Addendum (if needed) will be executed solely by Member at such time as Member moves into the Chapter House and that that Addendum (if needed), executed solely by Member, will bind both Member and Guarantors.In the event that after execution of this Contract the Member fails to move into the Chapter House, the Member fails to execute the required Addendum (if needed), or the Guarantors or Member otherwise attempt to revoke the terms of this Contract; it is agreed that the Fraternity will have suffered damage by reason of the fact that a place has been reserved for Member. In the event that one of the above occurrences happens, and Member does not move into the Chapter House, Member agrees to pay Fraternity liquidated damages in the amount of $10,000.00.MEALSRoom and board payments include meals. The number of meals served shall be as follows: Self-serve breakfast will be available Monday through Friday, lunch will be served Monday through Friday, and dinner will be served Monday through Friday and on Sunday. Quantity of food must be proper for the meal being served and at the discretion of the Housing Corporation. Members, parents, and/or guarantors may see a menu for the week and will able to provide input on the healthiness or quality of the meals.Member acknowledges that the kitchen must be kept in a condition of order and cleanliness as deemed proper by the Indiana State Board of Health. It is the responsibility of the Fraternity to keep it in that condition. If at any time the kitchen does not meet the standards for cleanliness as defined by the State Board of Health, the cook has the right to leave the premises and not prepare food until it is brought to an acceptable standard. Any meals not prepared during the time that the cook has vacated the premises due to lack of cleanliness are forfeited with no right of Member to ask for any room and board charges rebated to Member.DAMAGE DEPOSIT AND REMODELING Member shall make no modifications to any part of the Chapter House without approval in advance, in writing, by the Housing Corporation or is designated officer. Member agrees that if he violates this contractual provision, the Housing Corporation, at its discretion may at Member's expense, modify, repair, or change any altered room or any other part of the Chapter House to restore it to its original condition at the time the House was built or to otherwise repair any damage or change caused by Member. Any charge assessed under this section shall be considered to be a part of Members room and board under the grade encumbrance rules of Purdue University. Member's obligation to care for and maintain the common areas of the Chapter House shall be joint and several with all other Members living in the Chapter House. This means that Member is responsible for any damage done to the common areas of the Chapter House even though Member may not have had any part in causing the damage.It is the obligation of the Member to leave the room in a condition comparable to that when first occupied. Rooms must be clean and free of debris, trash, etc., at the end of each semester. Each room will be inspected at the beginning and end of each semester and the cost of any damages to the room or its furnishings will be assessed to the occupants.See the New Member Agreement for policies regarding security deposits HOUSING RULES AND POLICIESAlcohol: the possession, use, or consumption of alcoholic beverages must be in compliance with any and all applicable laws of the state, city, county, Purdue University, Delta Sigma Phi, and Delta Delta Chapter. Indiana procession and drinking age is 21Parking spaces: a parking space for an automobile only is provided and assigned based upon seniority system developed and administered by the Chapter Sergeant at Arms. Violators will be towed. All vehicles must have a current parking permit displayed. Motorcycles are permitted if parked on the concrete. Bicycles are to be stored in the racks provided and are not allowed inside the Fraternity House at any time, regardless of value. Bicycles may be impounded by West Lafayette Police if found anywhere except in the bike rack.Refrigerators: only one (1) refrigerator per Member is allowed and must be less than six (6) cubic feet of storage.Furniture: Only freestanding structures will be allowed in each Member room. Room modifications: The window, windowsill, and window head may not be altered in any way. The heating system may not be blocked or altered in any way.No painting or modification may be done to the room door. Additional locks (deadbolts, chains, etc.) are not allowed. Doors cannot be cut, planed or altered in any way. Items cannot be attached to the door with any device that will make holes or create damage of any kind.Carpet may be installed, but may not be permanently attached to the finished floor. Double stick tape may be utilized for this purpose. No other floor finishes may be installed (parquet, linoleum, tile, etc.)Decorating may be in the form of posters, pictures, banners, etc. and may be hung by the use of specially designed anchors that limit unsightly damage. Each Member shall take a mature approach to decorating his room as parents and alumni are frequent visitors to the House.No electrical wiring or alterations of any kind are permitted. Dimmer switches may not be installed and the ceiling light fixture cannot be changed. Member may request electrical modifications be installed by the Property Manager through the Housing Corporation.The use of electric saws and other power tools that create dust and shavings must be confined to the Member room or the outdoors. Construction materials or debris must be taken directly to the Member room or dumpster and may not be stored in the common areas of the House.No independent connection or wiring for Internet, phone or television cable may be brought into a Member’s room for their personal or roommate use. Member must use the wiring and capability already supplied and paid for by the Fraternity.False or elevated floors may not be constructed.Cooking: due to safety and fire codes, there is to be no cooking in the study rooms or bathrooms. No sandwich makers, grills, bread machines, coffee makers, hot plates, etc., are permitted to be in the study rooms, bathrooms or hallways.House dishes/glass/silverware: These items are not to be removed from the dining room and food service area under any circumstances.Tables: library tables and kitchen tables are not to be removed from the chapter house. If any tables are left outside and damaged, these are subject to special assessment and/or deduction from house deposit. Electronics: computers, radios, X-box/VCR/DVD and needed televisions/monitors for use are the only permitted electronic devices allowed in the study rooms. Extension cords are prohibited, however power strips and UPC devices are allowed. Candles and halogen lighting of any kind is prohibited by the fire marshal. Any alteration to the lighting and/or electrical switches within the chapter house is prohibited.Fire safety: The chapter house is a smoke-free facility. Smoking of any substance by any method is prohibited. This includes the use of “Vapes”, “E-cigarettes”, or any other device that emits smoke or water vapor. No burning candles or incense is permitted in the House. Members are prohibited from tampering or using the fireplace. Any attempt to disable or defeat the smoke detectors is a violation of the house rules, and will be subject to Fines. Security: It is the Member’s responsibility to keep the house secure. Doors should be locked and shut at all times. Member shall not provide the door code to any other member. Locks/doors/keys: all of the following is strictly prohibited: Tampering with a lock such that it interferes with or prevents the locking/unlocking of a door. Adding, changing or replacing a lock within the House without the authorization of the Board of Control. Duplicating a key for any of the doors or locks in the Fraternity House. Loaning a key that has been assigned by the House Corporation to another person.Cleanliness: Member’s rooms must be regularly maintained in a clean and sanitary manner. Hallways and stairwells must be kept clear. Cleaning duties, as assigned by the House Manager, are to be completed in a timely fashion or else fines can be enforced. Guests: Subleasing or renting out any portion of an assigned room is prohibited. Only those registered as occupants with the Housing Corporation and the University are allowed to live in the House. “Occupant” is defined as someone who normally is residing in the Fraternity House, and paying rent. Members and/or tenants assume full responsibility for their guests’ conduct in the Fraternity House. This includes ensuring that guests in the Delta Sigma Phi House abide by these Rules and Regulations, as well as Delta Sigma Phi’s Member code of standards. Guests are not permitted to use the laundry facilities or eat meals. Fighting/weapons/drugs: Fighting and violence by members and guests on the property is prohibited and against Delta Sigma Phi policy. Weapons (including, but not limited to, guns and knives) and illegal drugs are not permitted in the House at any time. Violations of any of these may include fines, disciplinary actions, up to and including immediate expulsion from the Fraternity, and possibly turning over the incident to the local authorities for criminal prosecution.Pets: Pets are not allowed in the Fraternity, pursuant to National Fraternity Policy Severe damage: The National Fraternity Policy explicitly forbids the construction and/or use of a swimming pool on any Chapter property. This includes paint parties, or any similar damageFEES FOR DAMAGESFees for damages will be assessed by the Housing Corporation and reviewed with the House Manager. Standard charges are included in Appendix A: Damage Charges. The Member will be provided a detailed inventory of fines by the Housing Corporation. The House Manager will execute a check-in and check-out process to ensure that a satisfactory room was provided at the time of move-in, and will verify any potential fines during the check-out process SUMMER STORAGE Member and Guarantors understand that using the Fraternity for storage of personal property is allowed, but all risk of loss for theft, damage or destruction of any personal property owned by Member and located in the Chapter House is upon Member. Maintenance and repairs of the Chapter house occur every summer. Maintenance personnel must have easy access to all locations of the building. Thus, Members may not keep any furniture in any room. Large furniture storage will be discussed each year by the Chapter executive board and the Housing Corporation. Member and Guarantor give the Fraternity the right to discard any personal property items that do not abide by this Section, with the cost of clean-up applied to the Member’s Damage Deposit.CONTRACT SIGNING DEADLINE Member understands that this contract must be signed electronically by the Member, guaranteed by at least one guarantors over the age of 25 electronically, and a check or money order sent for the Damage Deposit applicable to this contract, to the Treasurer of the Purdue Delta Sigma Phi Alumni Corporation by Dec. 1, 2016.If all items are not included, or if the check or money order are not postmarked by the specified deadline date, the Member will be assessed a $300.00 deadline penalty and potentially will lose all room assignment privileges, as defined by the Chapter House’s By-Laws, even if the Member has already invested in that room. Delivery of these three items to any person or location other than the President of the Purdue Delta Sigma Phi Alumni Corporation or to the Chapter House in West Lafayette will constitute non-delivery. TERMINATION OF THIS AGREEMENT The Fraternity may immediately terminate this contract through the various actions specified in this contract. Immediate terminations require no vote of the Fraternity.The Fraternity may terminate this Agreement, at any time for cause, according to the Constitutional process for removal of a New Member from the New Member program and written approval of the Housing Corporation. All of the privileges under this Agreement terminate immediately upon the decision of the Active Chapter. Once the Agreement has been terminated, the Fraternity will have no responsibilities to the Member. Termination of this Agreement does not waive any responsibility of the Member to fully pay all debts owed to the Fraternity. The Fraternity may terminate this Agreement, at any time for cause, on a majority vote of the Active Chapter and written approval of the Housing Corporation. All of the privileges under this contract terminate after 10 days of the decision. Once the contract has been terminated, the Fraternity will have no responsibilities to the Member. Termination of this contract does not waive any responsibility of the Member to fully pay all debts owed to the Fraternity. Member shall have ten (10) days from the date of the termination of this Contract to vacate his room in the Chapter House and will be obligated to fully pay all debts incurred up to and including the day of vacating the premises. Fraternity shall be obligated to refund to Member following any termination all unused room and board payments after first deducting any charges owed by Member which will not be satisfied out of the damage deposit.Housing Corporation may terminate this Agreement upon a majority vote of the Housing Corporation establishing that one or more of the following circumstances have occurred: (a) The Chapter House has become uninhabitable due to fire, storm, natural disaster or other unforeseen circumstances; (b) Housing Corporation has determined that the Chapter House will be closed for renovation or repairs; (c) Housing Corporation has decided to close the Chapter House for other reasons determined by the Board to be for the good of the Fraternity. No advance notice shall be required for a termination of this Agreement under alternative (a) above. In all other circumstances, Housing Corporation shall provide a 30 day notice of termination of this Agreement to Member. Notice by hand delivery or email shall be sufficient. In the event of termination pursuant to this paragraph by Housing Corporation, Member shall be entitled to receive from Fraternity a pro-rata refund of any unearned rent.Housing Corporation may terminate this Agreement, at any time for cause, on a majority vote of the Housing Corporation. Said action may be taken by the Housing Corporation with or without notice to or approval of the Active Chapter. In the event that the Housing Corporation does vote to terminate this Contract, an immediate written notice shall be delivered in person or by certified mail return receipt requested to Member, Guarantor and to Fraternity advising each of the action that has been taken. Further, that notice shall state the specific factual reasons relied upon by the Housing Corporation in terminating the Contract. Member shall have ten (10) days from the date of receipt of the notice of termination of this Contract to vacate his room in the Chapter House and will be obligated to fully pay all debts incurred up to and including the day of vacating the premises. Fraternity shall be obligated to refund to Member following any termination all unused room and board payments after first deducting any charges owed by Member which will not be satisfied out of the damage deposit. Once this contract has been terminated, the Fraternity will have no further responsibilities to the Member. The Housing Corporation will then recommend to the Active Chapter and the CEO of the National Fraternity that the Member’s status be rendered INACTIVE with the National Fraternity of Delta Sigma Phi. BREACH OF AGREEMENT In the event that Member is more than forty-five (45) days overdue in the payment of any rent obligation of this Contract, or breaches any of the other material obligations contained within this Contract, Fraternity may evict Member from the Chapter House on a notice of no less than forty-eight (48) hours. Member may extend the notice period to two (2) weeks in the event that Member deposits with the Fraternity a payment in an amount determined by the Judicial Board of the Fraternity (or, the Judicial Board refuses, then the Housing Corporation), to cover all room and board, charges and other expenses which might be incurred by Member during the two (2) week notice period. Eviction from the Chapter House and/or the Fraternity shall not relieve Member of any of his financial obligations to Fraternity other than that portion of the room and board attributable to food. If the Member clears his debt completely, he may petition the Fraternity and Housing Corporation for a new contract (which may have additional stipulations) so that he may continue to reside in the Chapter House. If all parties agree to the new housing contract, he will be able to move into the Chapter House.Exceptions to Members living out of House are referenced in the New Member Agreement.OTHER TERMS AND CONDITIONSMember agrees to be bound by any modification to this Contract made by a majority vote of the Active Chapter and the Housing Corporation and any modification shall not be considered to be a breach of contract by Fraternity. No purported modification, cancellation or revision of any Contract, whether by Member, Guarantor or by vote of the Fraternity, shall be effective without the written approval of the Housing Corporation.This Contract, and any additions thereto, may be freely assigned by Fraternity to the Purdue Delta Sigma Phi Alumni Corporation for the purpose of collection of any sums due thereunder to Fraternity. Member shall not have the right to assign his interest in this Contract.Member understands by his signature below that all risk of loss for theft, damage or destruction of any personal property owned by Member and located in the Chapter House is upon Member. Fraternity is under no obligation to insure nor is it a guarantor of the safety of Member's personal property. Fraternity recommends that Member obtain a renter's policy insuring his personal property in an amount that Member decides is adequate to protect him. Failure of any Member to remove all personal furniture and/or belongings by the Housing Lease expiration date will result in a charge of $50.00 per person, per labor hour of time spent to have such items removed.
