VANDLING - Borough council scrapped a sweeping proposed ordinance that would have allowed the code enforcement officer to close nuisance residences to tenants or revoke rental licenses after multiple violations.

agent" within 10 miles of the property.

Council made the decision at Monday's meeting after the proposal drew scrutiny from the American Civil Liberties Union, which took issue with classifying homes as nuisances after police are called there three times in a year.

"The proposed ordinance would also have a detrimental impact on victims of domestic violence by deterring them from seeking assistance during times of abuse due to a fear of losing their homes," said a letter to council signed by ACLU-PA attorney Sara Rose, Scranton's Barbara J. Hart Justice Center legal director Judith Lewis and Pennsylvania Coalition Against Domestic Violence legal director Ellen Kramer.

The organizations also argued the proposed ordinance, modeled after Carbondale's nuisance law, was unconstitutional and violated federal and state fair housing laws.

Council President Fran Pantzar said the organizations raised some valid concerns, and council's intention was really to make absentee landlords responsible for continuing problems.

Council instead planned to add two sections to the existing nuisance law, including one requiring all rental properties to be owned and operated by a person living in the borough unless the owner provides the code enforcement officer with the name, address and 24-hour phone number of a "responsible
