Big Chief Mobile Home Park is a designated seniors' park, age 55 and older.

Our Park Rules are designed to contribute to everyone's safety, property protection and privacy, and to ensure that your residency is pleasant and enjoyable.

All tenants and occupants of the Park are subject to all of the terms and conditions of the Park Rules set forth herein. Additionally, rules which are posted in the Park form part of these Park Rules, and must be observed by all residents and their guests.

These Park Rules are subject to revision and change by the Landlord with two weeks written notice to the Tenant, in accordance with the Manufactured Home Park Tenancy Act.

1. MANUFACTURED HOME AND SITE OF EACH TENANT. The manufactured home and Site shall be attractively maintained by the Tenant and shall comply with all applicable laws, ordinances and regulations of the Province, District, and Municipality as from time to time amended. Any additions or alterations to the manufactured home require a building permit and the written permission of Park Management before commencement of any work. No alterations or changes by the Tenant to the Site's ground level are permitted.

(a) Landscaping & Fencing: Any fencing, plants, shrubs or trees that are present now or are added in the future are and remain the responsibility of the Tenant and must be maintained by the Tenant at the Tenant's cost, in good condition. Removing or adding to the fencing, shrubs and trees on the site requires the prior written permission of Park Management. Any tree pruning by the Tenant must be first approved by Park Management. Park Management reserves the right to remove or prune any tree or shrub on the Site or in the Park. All fencing must be stained or painted to prevent deterioration, and be maintained annually.

(b) Clothes's drying is permitted on the Site only on an umbrella type clothes line/dryer in an inconspicuous location at the rear of the home.

(c) Services: Tenants must ensure that water lines, pipes and taps have thermostatically controlled electric heat tape strapped securely in place over the entire exposed length. Tenants are responsible for the expense of replacing or servicing water, sewer, electrical or television connections, if required, due to negligent or improper use by Tenant.

(d) Sewer & Water Lines: Tenants must protect and maintain the sewer and water lines between the Park service and their home. Sewer line leaks on the home side past the first connection to the park sewer main are the responsibility of the Tenant to repair. Water leaks on the home side past the first connection to the pressure reducer valve are the responsibility of the Tenant to repair. If you are unsure, please contact Park Management.

(e) Sewer & water lines under Tenants' homes must be prepared for winter to prevent damage by broken pipes or frozen lines. Lines must be adequately insulated with electrical tape and other means if necessary. Park Management is not responsible for water and sewer lines which freeze past Park fittings on the home side.

(f) Sewage Pumps: The Park operates on two pumps that pump all sewage to the City sewage lines. Nothing other than human waste and toilet paper may be flushed, including, but not limited to, plastic, food scraps, grease, sanitary wipes, feminine hygiene products, or any other trash. These items can clog sewer lines and damage the pumps.

(g) All homes must have a water pressure reducer valve in order to prevent problems caused by high water pressure.

(h) To protect underground utilities, check with management prior to digging any holes, planting trees/shrubs, putting in stakes and posts, or erecting garden sheds and other structures.( There are many irrigation lines 8 inches deep and less any damage to these by the tenant or a contractor hired by the tenant are at the tenants monetary responsibility)

(i) Water Usage: Please use water responsibly. Domestic water may not be used for outdoor purposes. The irrigation (creek) water may be used for garden/lawn watering, washing vehicles, and other outside uses.

Irrigation water is available during the watering season, with availability depending upon the time of year, weather, and maintenance and repairs.

Excessive use of water is not permitted, such as washing of streets, commercial vehicles, guest vehicles, or overnight watering of lawns (please hand water flower gardens and shrubs).

Watering of lawns during the summer must be in compliance with municipal water restriction bylaws. Oddnumbered homes may water on odd days of the month; even-numbered homes may water on even days. Sprinklers must not be left on while you are away from the Park. Should the irrigation system be down for repairs please turn off any sprinklers as it taxes the system when the pump starts again.

The clarity of the water is not in the parks control .. we do filter the water to protect the irrigation equipment but do to high water levels periodically through-out the year we have no control over the clarity of the irrigation water

Do not drink or cook with the irrigation water.

Maintenance and repair of the irrigation system occurs throughout the year... Sometimes the water may be down for up to 72 hours .We are always endeavoring to have seamless service

(j) Wood fireplaces and wood or pellet heating stoves are not permitted in the Park.

(k) Inspection and repairs: Park Management may enter the Site during reasonable hours with at least 24 hours notice, or at any time during an emergency, to inspect with regard to compliance with these Rules and with the law, or to erect, use and maintain pipes and conduits in and through the Site, as Park Management may deem necessary or desirable, and to take all material onto the Site as may be required.

(l) Snow clearing: The Park provides snow clearing for Park roadways and common areas only. Tenants must clear their own driveways, walkways or other areas located on their Site. We will make the roadways safe in a timely fashion. Be aware that sometimes damage occurs this will be repaired in the spring

2. ADDITIONS & ALTERATIONS.

(a) Any and all additions and alterations to Home or attachments thereto must be first approved in writing by the Landlord and any building permits from the City of Vernon must be obtained. Save as described in this section ("Additions & Alterations"), there shall be no additions or alterations to the Site by the Tenant. Additions and alterations include, but are not limited to, porches, decks, carports, storage sheds, awnings, fences, and any other structure on the Site.

(b) Any structure or addition to the home must be at least 10 feet from any other mobile home or such distance as may from time to time be required by local authorities, or approved by Park Management.

(c) In the event that the Tenant makes any repairs, alterations or additions, he/she must permit Park Management to enter the Site at all reasonable times for the purpose of inspection of such repair, alteration or addition.

(d) Any landscaping to the Site must be first approved in writing by Park Management, and any such plants, shrubs, trees or grass planted by the Tenant, become, upon planting, fixtures and shall not be removed without prior written consent of Park Management.

3. GUESTS. The Tenant assumes full responsibility for their guests' conduct and behavior, and will be held liable for any and all damages caused by him/her, all guests or servants or others that occur within the Park.

(a) Subject to 2(b), no person other than those named in the lease agreement as a tenant may reside in a home for more than two weeks in a calendar year.

(b) A person, not registered as a tenant, may reside in a home as a registered guest for a period in excess of two weeks, but such person must have prior written consent of Park Management for this purpose and must be formally registered.

(c) No more than four persons may temporarily reside in a home at any time.

(d) Any person under the age of 19 years is considered to be a "child" and is not allowed to reside either as a tenant or registered guest in a senior-designated lot, without prior written consent of Park Management.

(e) Persons under 19 are not allowed in the recreational areas without an accompanying adult.

4. GARBAGE (a) Park provides garbage pick-up ? Garbage is picked up once a week on Wednesday mornings. Garbage must

be securely tied in green or black garbage bags, and placed curbside no earlier than the morning of collection day. Homes are limited to two garbage bags. Additional garbage may be taken to the dumpster bin.(delete) (b) The Park participates in local recycling. Recycling is picked up by the municipality every second Friday. Recyclables and cardboard are banned from the landfills, and therefore, are not permitted in the Park dumpster bin or with weekly garbage pickup. (c) Collection is for regular household garbage/recyclables, for Park residents' use only. Importing garbage/recyclables from outside the Park is not permitted. Tenants must make their own arrangements for disposal of other unwanted items (e.g. old furniture). (d) Grass clippings and other yard waste is not permitted in the Park dumpster bin, but may be disposed of in the area provided for yard waste. (e) No burning of trash, leaves or other materials is allowed in the Park or on home sites.

5. PETS. (a) Dogs are not permitted in the Park as pets. No pet, whether mammal, bird, reptile, insect or arachnid, may be

brought into the Park or acquired after occupancy commences unless a Pet Agreement is completed and approved by Park Management in advance, except fish and small caged indoor creatures, such as hamsters or small birds. (b) Banned Breeds: Breeds of animals that are considered to be vicious or are restricted by any bylaw or regulatory agency will not be permitted to be in the Park or on the Site under any circumstances. (c) Exotic pets are not allowed for the protection of all park residents. (d) Written approval: Every pet requires prior written approval by Park Management before occupying the home. ***Pet restrictions do not apply to those pets currently residing with the tenant at the time these rules come into effect ("grandfathered"). However, the restriction will apply to any new or replacement pets and the tenant must complete a Pet Agreement Form. *** (e) Complaints: Pets that are noisy, unruly or who cause complaints must be removed from the Park within two weeks of receiving written notice from Park Management to do so. (f) Park buildings: Absolutely no pets are allowed in Park buildings except animals certified under the Guide Animal Act. (g) Breeding of pets or keeping of livestock or poultry are not permitted. (h) Wild animals: Considering the potential disturbance and mess, the Tenant agrees not to encourage or feed wild animals in or near the Park.

6. EXTENDED ABSENCES. For the security of your home during extended absences, we encourage you to: (a) notify the Park Management of expected departure and return dates; (b) provide post-dated rental cheques for the period, or sign up for pre-authorized debits (PAD); (c) arrange for maintenance of your lawn and home site, and advise the neighbors; (d) Provide emergency contact information to Park Management.

7. VEHICLES. (a) Speed limit in the Park is 20 km per hour. Pedestrians and bicycles have the right of way.

(b) Noisy vehicles, snowmobiles, hot rods, off-road motor bikes or other disturbing conveyances may not be driven or ridden in the Park.

(c) Only 2 licensed vehicles shall be permitted per site.

(d) All vehicles in the Park or on the Site must be currently licensed and insured for use on public roads and be in operating condition. Vehicles that are not operable, in disrepair, unsafe and/or considered unsightly (e.g. excessive rust, flat tires, missing/broken lights or windows, leaking fluids, etc.) are not permitted in the Park, except in designated storage areas. Contact Park Management for available space and storage fees.

(e) Automobile, motorcycle, or boat repairs & servicing are not allowed on home sites.

(f) No parking on lawns or Park roadways at any time. Vehicles on lawns can damage underground services. Vehicles parked on roadways can block emergency access and other drivers, and can also be damaged by the snowplow.

(g) The Park provides visitors' parking, which is intended for short-term visitors only. Visitors needing to leave their vehicles longer than a few days must obtain permission from Park Management before doing so. Tenants may not park in the visitors' parking without permission from Park Management.

(h) Boats, trailers, motor homes, campers, recreational vehicles, large trucks (over 3/4 ton) or commercial vehicles may not be parked in the Park longer than 24 hours, except in designated storage areas. Contact Park Management for available space and storage fees.

(i) Overnight use of tents, trailers, motor homes, campers, vans, or recreational vehicles is not permitted in the Park, except in designated camping areas. Contact Park Management for available sites.

(j) Restriction on max size of vehicle allowed on home site??? 24 feet

8. GENERAL CONDUCT.

(a) The rights and privacy of each Tenant must be respected by other tenants at all times. The Tenant shall not do, or permit to be done, on their home site or home, anything which may cause the justifiable & reasonable annoyance of other tenants. The Landlord shall have the right to terminate the Tenancy Agreement for repeated violations.

(b) The Park maintains quiet hours from 11:00pm to 9:00am. All noise, in particular noise from entertainment equipment or machinery, must be curtailed during these hours so as not to disturb neighbors.

(c) Loud and annoying parties are not allowed at any time, and tenants are responsible for the conduct of their guests at all times while they are in the Park.

(d) Abusive or offensive language is prohibited in the Park.

(e) No person is allowed to trespass on another tenant's site without that tenant's permission, except in an emergency.

(f) Skateboarding or roller skating is not permitted in the Park.

(g) Except for charcoal or propane/gas barbeque grills, open fires (e.g., leaf burning, fire pits, bonfires, etc.) are not permitted anywhere in the Park

9. RENTING Renting and subletting of homes in the Park by tenants is not permitted.

10. COMMERCIAL ENTERPRISES

(a) No selling, soliciting, peddling or commercial enterprises are allowed within the Park without first obtaining written consent from the Park Management.

(b) No signs or advertisements of any nature may be displayed by the Tenant within the site area or on any area of the Park except as designated by Park Management. Small realtor or elections signage may be permitted on the Tenant's home site.

11. MAINTENANCE OF THE SITE AND LANDSCAPING

The Tenant must maintain the Site, the landscaping and the home in good repair and in a neat, clean and sanitary condition. Maintenance of improvements, including, but not limited to, additions, decks, sheds, and carports, is entirely the responsibility of the Tenant. Neither the Landlord nor Park Management is responsible or liable in any way for their repair, safety, construction standards, or future condition. Unless otherwise specified in a written agreement between the Tenant and the Landlord, the Tenant is responsible for expenses and maintenance of (a) the Tenant's dwelling unit, skirting and additions; (b) the utility connection lines from the Park's service points to the manufactured home; (c) setup, blocking and periodic leveling of the manufactured home and additions; (d) the Site's landscaping, fencing, rock walls, driveways, or other improvements.

In order to protect the property values of the other homes in the Park, maintenance work not completed by the Tenant within 15 days of receipt of a final notice from the Park Management to do so may be completed by the Landlord or their delegate, and the Tenant shall reimburse the Landlord for the actual cost of such work plus 20% administration fee.

12. MOVING INTO THE PARK

(a) Homes must meet CSAZ-240 or CMHC-NHA standards.

(b) Home must be moved into park by professional movers. The cost of moving and service connection set up is the responsibility of the Tenant. Where water pressure is above 60 P.S.I., the set up must include a water pressure reducer, which either conforms to Municipal standards or is approved in writing by Park Management. A backflow valve must be installed to prevent drain of water tank when water service is disrupted due to repair.

(c) Home must be set up as low as possible, but ensure adequate crawl space for repairs.

(d) Tenant must remove all hitches on the Home and install skirting acceptable to Park Management, within thirty (30) days of occupancy. Homes shall not be permanently attached to a foundation. Stabilizing devices, piers, blocking or other types of support acceptable to Park Management may be used.

(e) Tenant must install permanent steps with railing at the front and rear of the Home within ninety (90) days of occupancy.

(f) Tenant must affix the Site number to the front of the Home in 4-6 inch numbers.

13. VIOLATIONS OF PARK RULES, COMPLAINTS, SUGGESTIONS ETC.

The Landlord and Park Management encourage the direct communication of violations of any of the Park Rules between the tenants themselves. The majority of the park residents support these rules, and reasonable people will adhere to them for the common good.

Complaints, requests and suggestions must be made in writing to Park Management on the "Requests" form. Your suggestions and input are welcome.

Any breach of these Park Rules by the Tenant will be considered a breach of a material term of the Tenancy Agreement, and may result in a Notice to End Tenancy or other penalty as provided by the Manufactured Home Park Tenancy Act and MHPT Regulations.

14. LIABILITY.

The Tenant acknowledges that the use of common areas by himself and his guests are entirely at their own risk. Furthermore, the Landlord and Park Management are not responsible or liable for damage, injury, or loss by accident, theft or fire to either the property or person of residents or their guests. This will be considered full notification that the Tenant will be held liable for any and all damage caused by him/herself, guests or others, and that the Tenant assumes all such responsibility. It is highly recommended that any contractor hired by the tenant have Valid WCB and liability coverage ant reputable contractor will have these papers available immediately upon request

15. HOME SALES.
