To all parties and their attorneys of record, please take notice that on

2 November 28, 2016 at 9:30 a.m. in Courtroom 650, or as soon thereafter as may be

3 heard, Plaintiffs Enzo Forcellati and Lisa Roemmich, on behalf of themselves and all

4 others similarly situated will, and hereby do, respectfully move for an order:

5

1. granting preliminary approval of the parties' proposed class action

6

settlement;

7

2. finding that the settlement is within the range of reasonableness and

8

possible final approval such that class notice should be provided;

9

3. approving the form and manner of class notice;

10

4. finding that the requirements for certification of the settlement class for

11

settlement purposes have been satisfied;

12

5. appointing Plaintiffs as the class representatives

13

6. appointing Plaintiffs' counsel as class counsel;

14

7. scheduling the Fairness Hearing;

15

8. determining that the notice of the settlement and Fairness Hearing

16

complies with all legal requirements;

17

9. directing that notice should be provided to class members;

18

10. appointing KCC Class Action Services, LLC as the Settlement

19

Administrator; and

20

11. staying all proceedings other than those related to the settlement pending

21

the Fairness Hearing.

This motion is based on this Notice, Plaintiffs' Memorandum in Support of

23 Motion for Preliminary Approval, the parties' Stipulation of Settlement, the

24 Declaration of L. Timothy Fisher in Support of Preliminary Approval, the

25 Declaration of Enzo Forcellati in Support of Preliminary Approval, the Declaration

26 of Lisa Roemmich in Support of Preliminary Approval, and the Declaration of

27 Patrick M. Passarella Regarding Notice and Settlement Administration.
