MINUTES OF THE REGULAR MEETING OF THE GOVERNING BOARDSchool District No. 40 of Maricopa County, ArizonaDistrict Office Governing Board RoomApril 12, 2018Present:Ms. Mary Ann Wilson, President Ms. Monica Pimentel, Clerk Mr. Jamie Aldama, Member Ms. Brenda Bartels, Member Ms. Sara Smith, MemberCALL TO ORDER AND ROLL CALLThe meeting was called to order by Ms. Wilson at 5:30 p.m. She noted the presence of all five Board members, constituting a quorum. OPENING EXERCISES Ms. Wilson welcomed everyone and thanked them for coming. She called for a moment of silence followed by the Pledge of Allegiance. Ms. Wilson noted the Board would begin with Special recognition, followed by the call to the public and discussion of item 7.A. Ms. Smith moved to adopt the meeting agenda and Ms. Bartels seconded the motion. Upon call to vote, the motion carried.RECOGNITIONStudent PerformanceThird through sixth grade choir students from Glenn F. Burton School performed under the direction of Mr. David Farmer.Partner RecognitionThe Governing Board recognized Glendale Kiwanis for its contributions and partnership with Glendale Elementary School District. Administration presented a video highlighting the many contributions the club makes to Glendale Elementary School District. Employee RecognitionThe Governing Board recognized Ms. Davita Solter, District Wellness Coordinator, and Glendale Elementary School District Employees for receiving United Blood Services’ Valentine for Life Award for participation in the Community Blood Program.School RecognitionThe Governing Board recognized the school with the highest teacher attendance rate from March 5, 2018, through April 6, 2018. Mr. Quintana announced Discovery to be the school honored this month. School RecognitionThe Governing Board recognized the school with the highest student attendance rate from March 5, 2018, through April 6, 2018. Mr. Quintana announced Bicentennial North to be the school honored this month. CALL TO THE PUBLICMs. Alicia Kozimor addressed the Governing Board to thank them for their support of the #RedforEd movement, and asked for their continued support.Ms. Jenny Paperman addressed the Governing Board express support for the #RedforEd movement and encourage all to join in supporting the Arizona Educators United.Ms. Raini Goatson addressed the Governing Board to share her story of why support for #RedforEd is important for students to be able to have opportunities for success.Ms. Megan McCave addressed the Governing Board to thank them for their support of the recent walk-ins. She also asked the Board to adopt the Arizona Educators United version of the resolution being considered this evening.Ms. Sherilyn Kisselbach addressed the Governing Board to urge them to continue supporting the #RedforEd movement and not accept small incremental amounts for settlement.Ms. Nicole Rider addressed the Governing Board to explain why she supports #RedforEd and the conditions she teaches in requiring action from the State.Ms. Stephanie Birnbaum addressed the Governing Board to share concerns about the lack of resources and funding available to support classrooms and teaching, and encourage support for #RedforEd.Ms. Jessica Peck addressed the Governing Board to encourage them to adopt the Arizona Educators United version of the resolution in support of the #RedforEd movement.Mr. Matt Schock addressed the Governing Board to urge them to support the resolution that includes support staff along with certified staff, and failure to do so will be sending a message that the District does not value all staff members equally. Ms. Alicia Bender addressed the Governing Board regarding the financial challenges faced by teachers and the District and thanked the District for its support for employees despite the lack of funding received from the State. She shared her vision of what our students and staff deserve.ACTION ITEMResolutionThe Governing Board discussed and considered taking action to adopt a Resolution in support of educators and the #RedforEd movement. Mr. Quintana noted two versions of a resolution have been provided, and that ultimately the language in the resolution is completely up to the Governing Board and is its discretion. The first version was requested by Arizona Educators United and Glendale Education Association, and the second was created by members of the Udall Shumway PLC Law firm and recommended by legal counsel. He noted the presence of Jennifer MacLennan, District Legal Counsel, to answer any legal questions the Board may have regarding the resolution.Ms. Bartels commented she felt support staff should be included in the resolution, but felt the rest of the language in the second resolution was less open ended. Mr. Aldama inquired which Board Member requested to have the second version of the resolution included on the agenda. Mr. Quintana explained Ms. Bartels made the inquiry leading to the second resolution added to the agenda.Ms. Wilson asked why support staff had been omitted from the resolution. Ms. MacLennan stated she did not see any reason support staff could not be added to the resolution.Ms. Pimentel stated she finds the second resolution insulting due to its lack of acknowledgement of support staff.Ms. Smith noted previous advice from legal counsel cautioning the District from making political statements and the scrutiny they can bring. She feels the second resolution can be revised to include support staff and would be more legally compliant.Mr. Aldama commented on the importance of support staff in the operations of the school district. He believes it to be absurd to omit these staff members from the resolution. Mr. Aldama inquired what the legal risks were of adopting either resolution. Ms. MacLennan noted that the first version may invite increased scrutiny, specifically from the Goldwater Institute. Under 15-511, school employees are prohibited from using their position of power to influence the outcome an election. She recommended moving the language “in ways that are lawful and do not disrupt the educational mission of our District.”Mr. Aldama asked Mr. Quintana which resolution he supports. Mr. Quintana suggested support for a blend of the two resolutions as recommended by Ms. MacLennan.Ms. Wilson stated she does not believe any revisions are necessary to the first version of the resolution and she supports adoption of this resolution without revision. Mr. Aldama moved to approve the resolution recommended by Arizona Educators United without any changes in the language and Ms. Pimentel seconded the motion. Upon call to vote, the motion carried with three votes in favor from Mr. Aldama, Ms. Pimentel, and Ms. Wilson and two votes opposed from Ms. Smith and Ms. Bartels. Ms. Smith noted her vote reflects the responsibility of Board members to follow the advice from legal counsel. Ms. Bartels expressed her support for #RedforEd, but also felt cautious due to the warnings presented in a recent webinar presented by ASBA. She noted her fear that should a strike occur, it will negatively impact families in our community and support staff members. Her reason for voting no is out of consideration for the language recommended by legal counsel. CONSENT AGENDAMs. Smith moved to approve the agenda and Ms. Bartels seconded the motion. The following presentation was reviewed:Ms. Segotta-Jones noted the District recently awarded a contract for a new assessment system which will have better capabilities for teachers to view student data to inform teaching.Ms. Smith asked about Science scores. Ms. Segotta-Jones provided an additional slide containing data from the Science benchmark. Note: Mr. Aldama left the meeting at this time.National School Boards Association Annual ConferenceGoverning Board Members and Administrators reported on learning gained from attending the National School Boards Association Annual Conference in San Antonio, TX April 5-9, 2018.Ms. Smith spoke about a session she attended regarding legislative advocacy. The main point she took back was that teachers and parents need to be sure to be informed voters and to get out and vote for those who support public education.Ms. Bartels shared learning from a session regarding the Board’s role in conducting community outreach, and how they need to have a more active role in telling the District’s story and being ambassadors in the community at large. Ms. Pimentel spoke about a session related to promoting achievement for male students of color. She also shared information gained from a session related to Ethnic studies. Ms. Wilson reported on the preconference session she attended regarding social emotional learning. Mr. Quintana shared information about a positive climate and marketing campaign instituted by a school district to promote a positive image to the public. Ms. Segotta-Jones spoke about sessions she attended and learning related to equity in learning for all groups. She also shared about her preconference session regarding traits of an effective school board. She commented on how she attended sessions at the conference processing information through the lens of an incoming superintendent. Ms. Powell shared about a session regarding a campaign to promote public schools in the San Antonio area.ACTION ITEMSEmployment of DirectorMr. Quintana recommended the Governing Board approve the appointment of Ms. Norma Jauregui as Director of Curriculum and Instruction, salary and benefits commensurate with other Directors. Ms. Bartels moved to approve the recommendation as stated and Ms. Smith seconded the motion. Upon call to vote, the motion carried.FUTURE MEETINGSFuture Meetings and Agenda Item RequestA list of upcoming meetings was reviewed. Governing Board Members were given the opportunity to request items to be included on future meeting agendas for discussion, information and/or action. Ms. Segotta-Jones noted there are several school level vacancies administration hopes to fill and a telephonic special meeting may be necessary.The Board Retreat will take place April 26th beginning at 3:00 p.m. If needed, the retreat can continue at 3:00 p.m. on May 10th. Ms. Powell will ensure Mr. Aldama is available for these dates and times.Ms. Smith would like a meeting with the Food Services Director to include Ms. Bartels. Based on that discussion, an agenda item may be requested at a later date. SUMMARY OF BOARD AND SUPERINTENDENT CURRENT EVENTSMr. Quintana noted Alicia Ashby was named the new Assistant Principal at William C. Jack school, continuing from her current position as Interim. Mr. Quintana thanked staff members who attended the meeting this evening for their efforts to advocate for our schools and students.Ms. Smith thanked grounds staff for clearing away trees blown over this afternoon. She complimented the Honor Band performance. She commented on an organization she learned about yesterday “Duet”.Ms. Bartels commented on the Dual Language program parent meeting and encouraged the District to continue promoting enrollment in this program. She also complimented staff for the Honor Band the evening prior.Ms. Pimentel also complimented the Honor Band performance. She also commented on the sessions she attended at the NSBA conference with Henry Cisneros and Julian Castro.Ms. Wilson noted her daughter attended an informational meeting about the Dual Language program. She also shared her pastor recently told her he has heard a lot of great things about our school district from parish members with children in our schools.Mr. Quintana introduced the new Director of Transportation Mr. Christian Miranda, approved at the previous meeting.Ms. Smith shared a text she received from a Sunset Vista parent complimenting everyone for all the wonderful things happening in our schools. ADJOURNMENTMs. Smith moved to adjourn the meeting and Ms. Bartels seconded the motion.
