STATEWIDE CONTRACT HISTORY

The following summarizes actions related to this Notification of Statewide Contract since its initial issuance. Any and all revisions have been incorporated into the attached document.

1 Adaptive Technology Requirements:

1 The contractor shall provide the most current available version of adaptive technology products and related services as defined herein as part of a program administered by the State agency. All products provided under this contract shall be to the sole satisfaction of the state agency.

2 The contractor must provide adaptive products that include, but are not limited to, the items specified below. This list is not exhaustive of the types of adaptive technology products that clients may require under this program:

1 Category 1, High volume screen readers which include Software Maintenance Agreements (SMA):

1 JAWS Home;

2 Window-Eyes;

3) Texthelp Read & Write Gold; and

4) WYNN Wizard.

3 Category 1, Low volume screen readers and related products including but not limited to the following:

1) Braille Edge 40 which includes a three (3) year warranty;

2) Focus 40 which includes a three (3) year warranty;

3) J-Say; and

4) Software upgrades and migrations.

5 Category 2, High volume screen enlargement – including SMA:

1 ZoomText Magnifier with Speech (Level II);

2 MAGic with Speech;

3 Twenty-four (24)-inch flat panel monitor. The monitor must have at least a one (1) year warranty; and 

4) Zoomtext keyboard.

7 Category 2, Low volume screen enlargement programs and screen enlargement related products including but not limited to the following:

1 ZoomText Magnification (Level 1);

2 MAGic Standard with no speech; and

3 Software and hardware upgrades and migrations.

9 Category 3, High volume voice input (no SMA included):

1 Dragon Naturally Speaking Premium; and

2 Dragon Dictate for Mac.

10 Category 3, Low volume voice input programs and related products including but not limited to:

1) Dragon Pro;

2) Software and hardware upgrades and migrations; and

3 USB Desktop microphone, and other microphones.

12 Category 4, High volume adaptive software and keyboards and related products:

1 BigKeys LX;

15 Category 5, Low volume pointing devices and related products including but not limited to:

1) Trackman Marble Mouse;

2) Roller II Joystick;

3) And any other Pointing device not specified in the Category 5 High Volume pointing Devices and Related Products segment;

4) Mounting systems; and

5) Hardware upgrades.

2 General Performance Requirements:

1 The contractor shall provide product information to the State agency including product features, description and documentation related to installation, setup and usage in sufficient quantity, and alternative formats, necessary to meet program needs.

2 When demonstration software is available for a product, the contractor shall provide copies of demonstration software upon request to the State agency, at no additional cost to the state.

3 The contractor shall provide an account manager dedicated to working with the State agency to manage and monitor contractor performance and resolve any issues that may arise. The contactor’s account manager shall be available for conference call(s) to discuss the contract in detail within two (2) weeks of the contract being awarded.

4 The contractor must be able to receive purchase orders via fax and email.

5 The contractor must establish procedures to effectively track orders, invoices, returns and other program activity including tracking serial numbers of all software and product codes of devices shipped to program participants.

6 The contractor must be able to ship the ordered high volume products within fourteen (14) days after receipt of a purchase order for those products specifically identified on the pricing pages. All other products, low volume and related, must be shipped within thirty (30) days of the receiving a purchase order.

7 The contractor shall deliver the adaptive technology products to the participant’s address identified on the purchase order issued by the State agency and shall notify MoAT, via e-mail to an address specified by the program coordinator, within two (2) working days if a product cannot be delivered to the participant’s address specified on the purchase order due to the products being discontinued or backordered.

8 The contractor must deliver the adaptive technology products via a verifiable delivery service (e.g. United Parcel Service, Federal Express, etc.).

9 The contractor shall provide consumer support services for program participants in a manner similar to support services provided to all other consumers of the same or similar products. At a minimum, the contractor shall provide or otherwise arrange for a toll-free telephone number for receiving questions pertaining to the adaptive technology products provided in this contract.

10 The contractor shall accept, without any return or restocking charge, products returned within thirty (30) calendar days of participants’ receipt of products. The contractor may allow for returns after thirty (30) calendar days of receipt by the participant at the specified restocking fee stated herein.

11 The contractor shall submit a monthly invoice to the state agency for all items shipped from the first to last day of the previous month. The invoice must identify the participant’s name and a list of equipment shipped to the participant with the following information in the order listed: item number/code, item name/description, quantity shipped, unit price, the extended price for all equipment, and including serial numbers for all software programs. The State agency will submit the invoice for payment as soon as possible.

12 The contractor shall provide a one (1) year express warranty on all products in accordance with the Revised Statutes of Missouri (RSMo.) 407.953 at no charge to the state. The warranty shall commence upon acceptance of the provided adaptive technology products. Such warranty shall include repair or replacement for one (1)-year unless product malfunction is a result of consumer abuse, neglect, unauthorized modifications, or other consumer caused product damage that is not routine wear and tear. Such warranty shall also include the provision of a loaner device if the repair or replacement will extend over thirty (30) days.

13 The contractor shall repair adaptive technology products provided in contract free of charge for the duration of the warranty.

14 The contractor shall upon request, provide a list of program participants whose equipment currently has an upgrade version available and whose Software Maintenance Agreements are due for renewal. The contractor shall provide software and hardware serial numbers to State agency as requested.

15 The contractor shall not use personally-identifiable consumer information obtained through implementation of this contract to solicit the sale of products or services. Internet consumer’s contact with the contractor shall be limited to providing adaptive equipment as ordered and technical support services specifically authorized by the State agency such as support for installation of the adaptive equipment ordered and support for repair or return of adaptive equipment which is not performing to its specifications.

3 Support Requirements:

1 Training: The contractor must provide, if requested, product training at least two (2) times per year in Missouri during events arranged by the State agency at no additional cost to the state. The method of training may vary depending on the content of the training and could include on-site or off-site (i.e. webcast, conference call, etc.) training.

1 One training event to be scheduled in one of the major metropolitan areas within the State of Missouri (e.g. St. Louis, Kansas City, Columbia, Springfield, Lake of the Ozark) must be delivered on-site.

4 Technical Support:

1 The contractor must provide technical support, at no additional cost to the state, Monday through Friday, 8AM through 5PM central time, excluding state holidays. However, it is highly desirable that the contractor provide twenty-four (24) hours per day, seven (7) days per week technical support.

1 It is highly desirable that the contractor provide a toll free telephone number for this support.

2 Documentation: The contractor must supply the user documentation/operating manuals necessary to install, operate and maintain the products provided at no additional cost to the state.

5 Substitutions:

1 The contractor shall not substitute any item(s) that has been awarded to the contractor without the prior written approval of the Division of Purchasing.

2 The state reserves the right to allow the contractor to substitute any new product/system offered by the contractor on all unshipped and future orders if capabilities and quality are equal to or greater than the product/system under contract and if prices are equal to or less than contract prices. The Division of Purchasing shall be the final authority as to acceptability.

6 Replacement of Damaged Product Requirement:

1 The contractor shall be responsible for replacing any item received in damaged condition at no cost to the State of Missouri. This includes all shipping costs for returning non-functional items to the contractor for replacement.

7 Delivery Performance Requirement:

1 The contractor and/or the contractor's subcontractor(s) shall deliver products in accordance with the contracted delivery times stated herein to the state agency upon receipt of an authorized purchase order or P-card transaction notice. Delivery shall include unloading shipments at the state agency's dock or other designated unloading site as requested by the state agency. All orders must be shipped F.O.B. Destination, Freight Prepaid and Allowed. All orders received on the last day of the contract, must be shipped at the contract price. All deliveries must be coordinated with the state agency.

8 Reports Requirement:

1 The contractor shall prepare and submit a written report on an annual basis indicating purchases made by the state agency off the contract. This report must at minimum show items by contract item number, respective volumes purchased for each item, respective contract price and extended contract price; an annual total by item and for all purchases must be shown. This report must be submitted to the State agency.

COST

The adaptive equipment identified in this contract has been categorized into high and low-volume categories as follows: screen readers, screen enlargement, voice input, adaptive software and keyboards, and adaptive pointing devices. The state agency must order products based on the category awards identified below.

For each category, the contractors stated a percentage off the manufacturer’s suggested retail price (MSRP) for the current version of each High Volume item specified. The percentage off MSRP applies to the current MSRP price and the price for any future version of the software or hardware listed. The percentage off MSRP applies for the duration of the contract. The contractors must provide all items in each category awarded.
