The regular meeting of the Glendive City Council was held Tuesday, May 2, 2017. Mayor Jerry Jimison called the meeting to order with the following Council members present: Avis Anderson, Doug Baker, Leon Baker, Rhett Coon, Betsey Hedrick, Clyde Mitchell and Gerald Reichert. Others present included: Treasurer Darci Saeman, Fire Chief George Lane, Director of Operations Kevin Dorwart, Police Chief Brad Mitchell, Public Works Director Jack Rice and Recreation Director Dean Svenvold. Jason Stuart from the Ranger-Review was also present; along with numerous members of the public. Council member Mike Dryden was absent.

Mayor Jimison opened the Council meeting at 7:00 pm with the reciting of the Pledge of Allegiance.

Reichert moved to approve the minutes of the April 18, 2017 regular Council meeting; second by Mitchell and the motion passed with Council members Avis Anderson and Gerald Reichert abstaining.

OLD BUSINESS

Ordinance Committee

April 24, 2017 --- 4 PM

Members present: Mayor, L Baker, D Baker, Hedrick, C. Mitchell

Others: Police Chief Mitchell, Jason Stewart (ranger review) Pete and Jack from public works

Agenda:

1. Junk Vehicles at 1005 South Pearson. Once again the property at 1005 South Pearson has become a public nuisance. A citation by the police might be pursued since this is a recurring violation of the Public Nuisance Abatement Order by District Sanitarian Dated Feb. 25, 2016 (see attached original order).

Action: Committee recommends notice be given to Shawn Billington to clean up property at 1005 South Pearson and after 10 days if not complied with a new Public Nuisance Abatement Order will be pursued in accordance with City Code 4-1-3(B)

2. Dangerous Weapons Discharged Waiver by Dan Thomason- Burlington Northern Railroad has contracted Dan Thomason to kill pigeons on railroad property and is asking council for a waiver to use a pellet gun in the city limits on railroad property. Dan is a well known professional predator hunter for the government.

Action: Committee recommends approval of waiver for Dan Thomason with conditions determined by city police and public works.

3. Adoption of flood plain regulations

Action: Committee recommends approval.

4. Adoption of development standards

Action: Committee recommends approval.

5. Adoption of Sub Division standards

Action: Committee recommends approval.

Agenda

1. Update on Dispatcher Position.

Chief Mitchell told the committee that nobody has applied for full-time Dispatch

Position. Job has only been open for one week.

Action: FYI.

2. Update on applications for Patrol Officer.

Chief Mitchell informed committee that he has four applications for Police Patrolman

Position but would like to keep it open for a couple more weeks.

Action: FYI.

Legislative Update – Dorwart gave an overview of numerous Senate and House bills and how each affects the City of Glendive. Dorwart thanked Betsey Hedrick a couple of times for all of her hard work on SB367; a TSEP funding bill. The bill eventually failed which will cost the City about $625,000 in funding. Dorwart also mentioned SB278 which originated out of Glendive and increases the minimum amount for hiring an Engineering firm from $20,000 to $50,000 without needing a RFP.

Mayor Jimison asked for public comment. No one came forward.

NEW BUSINESS

Approve waiver for Daniel Thomason for Ordinance 5-5-1 for shooting pigeons on BNSF property- L. Baker moved to approve waiver for Daniel Thomason for Ordinance 5-5-1 for shooting pigeons on BNSF property; second by Hedrick. Reichert stated the number of pigeons is determined by food supply and habitat. Killing the pigeons will help in a couple of areas, but that is it. They will come back and in larger numbers. Places like The Jordan and the elevator make great habitat for the pigeons and until the City addresses the building issue, the pigeons will come back. Hedrick added she thinks the City should let the guy shoot the pigeons, but identify the problem. Shooting the pigeons might not be a fix, but use it as a vehicle to fix the problem. The motion passed 5-2, with Council members Anderson and Reichert voting no.

Approve adoption of updated Flood Plain Regulations – L. Baker moved to approve adoption of updated Flood Plain Regulations; second by Hedrick. Rice explained the Flood Plain Regulations are state & federally mandated so there isn’t a lot of wiggle room. Rice and Sanderson both think this is the best way to go. The motion passed.

Approve adoption of updated Development Standards – Coon moved to approve adoption of updated Development Standards; second by Anderson. Rice explained that Development Standards are entirely city specific standards. Rice and Leath have looked at this numerous times in the past year. Rice & Coon both stated these Standards cover a lot of gray areas and give the City much needed control over things that are falling through the cracks. The motion carried.

Approve adoption of updated Sub-Division Standards – Hedrick moved to approve adoption of updated Sub-Division Standards; second by L. Baker. Rice added the Sub regulations the City is current under now are from 2010. The motion passed.

Accept proposal for Engineering & Surveying from Interstate Engineering for $26,750.00 – Coon moved to accept proposal for Engineering & Surveying from Interstate Engineering for $26,750.00 in the following steps: Task 1 at $3750 & then Tasks 2&3 once SB278 is ratified. The motion passed.

Ambulance Service Donation – MidRivers Coop. – Mayor Jimison mentioned the $350.00 donation the City received from MidRivers.

Accounts Payable Claims: $24,951.48 – Anderson moved to approve accounts payable claims in the amount of $24,951.48; second by Mitchell and the motion passed.

Payroll for April: $237,901.23 – L. Baker moved to approve payroll for April in the amount of $237,901.23; second by Coon and the motion passed.

DEPARTMENT HEAD COMMENTS

Police – Chief Mitchell reported that Assistant Chief Feist went through the Patrol Officer position applications (they received three more applications this week) and scheduled the written and physical testing for May 23rd. One of the vehicles has broken down so the PD is down one vehicle.

Operations: Director of Operations Dorwart stated he is busy with the Legislature and has started preliminary work on the budget. Dorwart will call Council member Dryden and try to schedule Government Day when Mayor Jimison will be in the office.

Public Works – Public Works Director Rice has been busy with the sidewalk, curb and gutter project and the crew has been busy working on the sidewalk in front of the Multi-Purpose building for the Wally Broeder Memorial bench.

Fire – Fire Chief Lane stated he was called to a small fire on Dodge Street and the building side has been quiet.

Recreation: Recreation Director Svenvold stated Jacquie Marquart, the Assistant Recreation Director, will be going to Billings to get certified as a Lifeguard Instructor. There are currently 9 lifeguards returning from last summer. May 30th is the date registration for summer activities will start and pool passes will go on sale. The pool is tentatively set to open June 7th.
