REQUEST FOR QUALIFICATIONS FOR OWNER’S REPRESENTATIVE AND PROJECT MANAGEMENT SERVICESH. LEE MOFFITT CANCER CENTER AND RESEARCH INSTITUTE, INC.TAMPA, FLORIDAThe H. Lee Moffitt Cancer Center and Research Institute, Inc. and its subsidiaries (collectively “Moffitt Cancer Center”) seek to award up to three (3) or more Indefinite Delivery-Indefinite Quantity (“IDIQ”) contracts to qualified and responsible companies to provide owner’s representative and project management services on an as needed basis. The scope and price of each project shall be set forth in an Order for Work for each project (“Order for Work”), which will be governed by a master agreement. Moffitt Cancer Center is therefore requesting qualifications from interested owner’s representative and project management service firms (“Owner’s Representative”). The estimated cost of each project will be under One Million Dollars ($1,000,000.00). The Request for Qualifications (“RFQ”) is the first step in the process for selection of an Owner’s Representative to provide owner’s representative and project management services. A response must be made in accordance with the instructions outlined in this RFQ. Upon receipt of RFQ submissions, a short list of firms will be selected to interview with representatives of Moffitt Cancer Center. After the interview, the IDIQ Owner’s Representatives shall be selected. GENERAL INSTRUCTIONSSECTION 1 – General Information and Submittal Requirements:General Information. The Moffitt Cancer Center is soliciting qualifications for Owner’s Representatives to provide owner’s representative and project management services on an IDIQ (as needed) basis in accordance with the terms, conditions, and requirements set forth in this RFQ, including any attachments hereto. Public Information. All information, documentation, and other materials submitted in response to this RFQ will be treated as non-confidential and/or non-proprietary and may be subject to public disclosure under applicable law. Vendor Acknowledgment Form. Interested vendors must submit Moffitt Cancer Center’s Vendor Acknowledgment Form, attached hereto as Attachment “A” on or before August 5, 2016 at 2:00 p.m. EST to rfp@.Submission Qualifications. Firms desiring to apply for consideration for an IDIQ contract shall submit materials, including a letter of application, and the materials listed below (“Materials”). All Materials shall be submitted by email in Adobe Acrobat? PDF format in portrait orientation with a table of contents. Minimum font size shall be 10 pt. The Materials shall be limited to the equivalent of ten (10) 8 ? x 11 pages. The cover letter will not be counted in the page count but shall not exceed two (2) pages each. Properly submitted Materials will not be returned to the respondent. Any Materials submitted (including plans and/or specifications) will become the property of the Moffitt Cancer Center.Vendor Pre-Submission Conference. Moffitt Cancer Center will conduct a vendor Pre-Submission conference to further clarify and discuss the requirements of this RFQ on August, 8, 2016, at 1:30 p.m. EST at 800-206-6032 Conference ID: 7457113.Additional Qualifications. Owner’s Representatives must provide proof of current Florida state and local licensure from the appropriate licensing agency(ies), if a license is required. All Owner’s Representatives must be properly licensed and/or registered at the time of application to practice their profession in the State of Florida. If the Owner’s Representative is a corporation or other form of business entity, it must be authorized by the Florida Department of State to operate in Florida. The Owner’s Representative shall have a Florida office or an active affiliation with a company based in the State. A letter of intent between the two companies indicating that the companies will enter into a joint venture or other acceptable relationship if awarded an IDIQ contract is required. Evaluation of Materials. The evaluation of Materials shall be based on the requirements of the RFQ. All properly submitted Materials will be reviewed and evaluated by Moffitt Cancer Center. Reservation of Rights. Moffitt Cancer Center may evaluate the Materials based on present and anticipated future needs. Moffitt Cancer Center reserves the right to divide any project into multiple parts, to reject any and all Materials and re-solicit for additional RFQs, or to reject any and all Materials and temporarily or permanently abandon this RFQ. Moffitt Cancer Center makes no representations, written or oral, that it will enter into any form of agreement with any respondent to this RFQ for any project and no such representation is intended or should be construed from the issuance for this RFQ. The award of this IDIQ contract and/or any assignments thereunder are subject to the availability of funding. No Reimbursement for Costs. Owner’s Representative acknowledges and accepts that any costs incurred from the Owner’s Representative’s participation in the RFQ shall be at the sole risk and responsibility of the Owner’s Representative.Acceptance of Evaluation Methodology. By submitting its Materials in response to this RFQ, Owner’s Representative accepts the evaluation process and acknowledges and accepts that a determination of the “most qualified” Owner’s Representative(s) will require subjective judgment by Moffitt Cancer Center.Disqualification. At the sole discretion of Moffitt Cancer Center, submittals that do not comply with the instructions in this RFQ or that contain incomplete, inaccurate, or non-responsive information may be disqualified from consideration. Requests by Owner’s Representatives for individual meetings will not be granted. It shall be noted that no verbal communication shall take place between Owner’s Representatives and the Moffitt Cancer Center staff; written requests for any project information must be emailed to Jay Wright.SPECIFIC REQUIREMENTSSECTION 2 - BackgroundThe Moffitt Cancer Center is a research-oriented specialty cancer center with full service outpatient and inpatient facilities, as well as research facilities. The Moffitt Cancer Center seeks submission of qualifications from qualified Owner’s Representatives to provide owner’s representative and project management services. The anticipated scope of work is to be performed on an as needed basis during the course of the IDIQ contract period.Location of work: Owner’s representative and project management services may be requested at any of Moffitt Cancer Center’s current or future facilities. Term of Agreement: The term of an awarded IDIQ contract will be for three (3) years, but may be extended in the sole discretion of Moffitt Cancer Center.Services: All services shall be subject to the terms set forth in each Order for Work entered between Moffitt Cancer Center and Owner’s Representative.SECTION 3 – Owner’s Representative Qualification Requirements To be considered for award of an IDIQ contract, the Owner’s Representative submitting for consideration shall have been regularly engaged in owner’s representative and project management services for a minimum of three (3) years immediately prior to the submission date.This IDIQ contract will be awarded only to responsible Owner’s Representatives qualified by experience to provide the work specified. The Owner’s Representative must submit the following information in its Materials: Name and address of the entity, indicate type of business (i.e. individual, partnership, corporation, other). The Owner’s Representative shall have a Florida office or an active affiliation with a company based in the State. A letter of intent indicating that the companies will enter into a joint venture or other acceptable relationship if awarded an IDIQ contract is required. Owner’s Representatives submitting as associations will be required to show evidence of an affiliation or joint venture agreement within seven (7) days of notification of being identified on the short list.The length of time the Owner’s Representative and/or the principals have operated in the project management industry.The Owner’s Representative’s experience and performance related to hospital/clinical/research facilities projects. One project shall have project costs greater than $1,000,000.00, with a description of such project.Proof of current Florida State or local licensure from the appropriate licensing agencies, if a license is required. All Owner’s Representatives must be properly registered at the time of application to practice their profession in the State of Florida. If the Owner’s Representative is a corporation or other business entity, it must be authorized by the Florida Department of State to operate in Florida. Experience record depicting training and experience in similar work, and number of years in the industry. Owner’s Representative must demonstrate a minimum of three (3) years’ experience in the following key categories:Project management and construction administration in healthcare facilities;Project management and construction administration in research facilities; andEnforcement of Infection Control Procedures.Ability to understand and meet the job performance requirements as detailed by the following factors:The company’s stability and length of service as a company;Adherence to time lines; andOther similar projects in which team members have been involved.Furnish a list and brief description of healthcare projects completed within the last three (3) years. The list must be complete with company name, project names, location, contact names, addresses and telephone numbers of owner’s, year of project, type of energy conservation designed; construction/contractor firm; projected versus actual completion; size of health service center/ health system, Owner’s Representative’s role and role of team members, total costs, actual versus projected.List number of people regularly employed.Ability to provide fifteen percent (15%) of its services by a Minority, Women, Veteran and Service Disabled Veteran-owned Business Enterprise (“MBE/WBE/VBE/SDVBE”).? There is a limit of one page per résumé. Only similar project(s) shall be included. Identify the individual’s specific role and responsibilities. Résumés will not be considered in the overall page count.The Owner’s Representative’s ability to replace project personnel with others within the firm. LitigationIdentify any litigation, arbitration, and/or other method of dispute resolution, including a claims history under professional malpractice insurance, to which the company has been a party within the past five (5) years.IndemnificationThe selected Owner’s Representative shall be required to indemnify Moffitt Cancer Center for claims arising from the firm’s negligence or wrongful acts. Moffitt Cancer Center will not indemnify the firm. SECTION 4 – Ownership and Use of Drawings, Specifications, Other Documents and Electronic DataDocuments, and electronic data prepared by the Owner’s Representative under an IDIQ contract shall become Moffitt Cancer Center’s property. Moffitt Cancer Center shall retain all common law, statutory and other reserved rights, including any copyright. The Owner’s Representative, sub-consultants, sub-subconsultants, and material or equipment suppliers are authorized to use and reproduce the instruments of service solely for execution of an Order for Work.SECTION 5 - Compliance with Moffitt policies and proceduresThe Owner’s Representative must agree to follow all of Moffitt Cancer Center’s Policies and Procedures while on campus, including but not limited to the following:Moffitt Cancer Center is a Drug-free & Smoke-free workplace.The Owner’s Representative must understand and support the policy that Moffitt Cancer Center patients’ safety and well-being is the primary objective.Moffitt Cancer Center Safety Orientation must be attended by all Owner’s Representative staff working on-site.The Owner’s Representative shall be responsible for following the Moffitt Infection Control Risk Assessment Policy (“ICRA Policy”) and providing any and all necessary items to meet the specified level of protection for each project (see ICRA Policy attached as Attachment “C”).The Owner’s Representative shall comply with the use of Reptrax for all employees that will perform work under the IDIQ contract. Accordingly, offers submitted in response to the RFQ shall provide clear, complete, concise, and straightforward responses.SECTION 7- NON-EXCLUSIVENotwithstanding the foregoing, the selection of IDIQ Owner’s Representatives shall not preclude Moffitt Cancer Center from engaging or contracting with non-IDIQ Owner’s Representatives for future projects, as Moffitt Cancer Center determines in its sole and absolute discretion. Award of an IDIQ contract does not guarantee the execution of future Orders for Work with the Owner’s Representative. All such insurance shall be provided by responsible companies with A.M. Best ratings of A-, authorized to transact business in the State of Florida, and which are satisfactory to the Moffitt Cancer Center. Promptly after Moffitt Cancer Center’s issuance of the Notice of Award of this Agreement, and prior to commencing work, Owner’s Representative shall provide evidence of insurance coverage of the types of in the amounts required by submitting executed Certificates of Insurance, in the form preferred by Moffitt Cancer Center. Each Certificate shall set forth the original manual signature of the authorized representative of the insurance company/companies identified therein and shall have attached thereto proof that said representative is authorized to execute the same. In addition, certified true and exact copies of all required policies shall be provided to the Moffitt Cancer Center upon request.2.All policies of insurance required shall require that the insurer give the Moffitt Cancer Center thirty (30) days written notice of any cancellation, intent not to renew, or reduction in coverage; and the ten (10) days written notice of any non-payment of premium. Should the Owner’s Representative have any questions concerning its exposures to loss under the Contract Documents or the insurance coverage needed therefore, it should seek professional assistance.7.If the insurance coverage initially provided by the Owner’s Representative is to expire prior to completion of the work, renewal Certificates of Insurance shall be furnished to the Moffitt Cancer Center thirty (30) days prior to expiration of current coverage.8.Should the Owner’s Representative fail to maintain the insurance coverage required by the Contract Documents, the Moffitt Cancer Center may, at its option, either terminate this Agreement for default or procure any pay for such coverage, charge the Owner’s Representative, and deduct the costs from payments due the Owner’s Representative. A decision by the Moffitt Cancer Center to procure and pay for such insurance coverage shall not operate as a waiver of any of its rights under the Contract Documents.9.All liability insurance policies obtained by the Owner’s Representative to meet the requirements of the Contract Documents, other than the Worker’s Compensation and Employer’s Liability Policy, shall provide that the H. Lee Moffitt Cancer Center and Research Institute Inc., its subsidiaries and their officers, employees, agents, volunteers, affiliates and assignees (and potentially others), shall be named as “additional insureds” under the Policy and shall also incorporate a Severability of Interest provision. All insurance coverage provided under this section shall apply to all of the Owner’s Representative’s activities under the Contract Documents without regard for the location of such activity.10.Coverage. Amounts and types of insurance shall conform to the following minimum requirements with the use of current Insurance Service Office forms and endorsements or their equivalent.a.Worker’s Compensation and Employer’s Liability Insurance. Coverage shall be maintained by the Owner’s Representative for all employees engaged in the Work, in accordance with the laws of the State of Florida.The amount of such insurance shall not be less than:Workers’ Compensation – Florida Statutory RequirementsEmployer’s Liability -$1,000,000.00 Limit Each Accident$1,000,000.00 Limit Disease Aggregate$1,000,000.00 Limit Disease Each mercial General Liability Insurance. Coverage shall include, but not be limited to, Personal and Advertising Injury, Contractual liability coverage under the IDIQ contract including any hold harmless and/or indemnification agreement, Independent Contractors, Broad Form Property Damage. Limits of coverage shall not be less than the following for Bodily Injury, Property Damage and Personal Injury, Combined Single Limits:Each occurrence$1,000,000.00General Aggregate$3,000,000.00Products – Completed Operations Aggregate$1,000,000.00Personal and Advertising Injury$1,000,000.00Damage to Premises$ 500,000.00Medical Expense Limit$ 10,000.00The Aggregate Limits shall be separately applicable under the IDIQ contract.If the General Liability Insurance required herein is issued or renewed on a “claims made” form, as opposed to the “occurrence” form, the retroactive date for coverage shall be no later than the Notice to Proceed date and shall provide that in the event of cancellation or non-renewal the discovery period for insurance claims (Tail Coverage) shall be unlimited.c.Business Automobile Liability Insurance. Coverage shall be maintained by the Owner’s Representative as to the Ownership, maintenance, and use of all of its owned, non-owned, leased or hired vehicles (“Any Auto”) with limits of not less than One Million Dollars ($1,000,000.00). d.Excess Liability/Umbrella coverage of $5,000,000.00.11.The limits outlined above may be increased as each individual Order for Work requires.Certificates of Insurance. Certificates of Insurance evidencing the insurance coverage specified in paragraphs 10.a through 10.d inclusive, shall be filed with the Purchasing Department within ten (10) days after issuance of Notice of Award and before start of any work. The required Certificates of Insurance not only shall name the types of policies provided, but also shall refer specifically to the IDIQ contract.Failure of the Owner’s Representative to submit Certificates of Insurance within the times required may result in a delay in issuing the Notice to Proceed.
