1 . PARTIES : Applicant is NEWF I ELD EXPLORATION MID-CONTINENT , INC, 110

W . 7th Street, Suite 1300, Tulsa, Oklahoma 74119, the owner of working interests in valid oil and

gas leases covering a portion of the mineral interest in the lands described in the caption hereof .

The name and address of each party entitled to notice of this Applic a tion is as shown on Exhibit

"A", attached hereto and made a part hereof .

ALLEGATION OF FACTS :

(A)That this Commission has heretofore , by Order No . 555439 dated June 16 , 2008 ,

established 640-acre drilling and spacing units forthe production of gas from the Caney , Woodford ,

Sylvan , Joins and Arbuckle common sources of supply underlying an area which is adjacent and

contiguous to Sections 27 , Township 2 No rth , Range 12 East , Atoka County , Oklahoma ; that

subsequent development indicates that said common sources of supply extend beyond the area

spaced therefor and underlie all or substantially all of the lands described above , and that said

order should be amended and extended to include said lands . That the depths at which Applicant

expects to encounter said common sources of supply in said area are as follows :

(B) Applicant alleges that the Mississippian , Woodford , Hunton and Sylvan are

prospective common sources of supply lying within the lands described in the caption he reof, that

i rregular 640-acres would be an appropriate sized horizontal well unit and that one or more wells

wi ll adequately and effectively drain and recoverthe producible hydrocarbons underlying such area

with the horizontal units configured as follows : Unit 1 : W/2 of Section 27 and W/2 of Section 34

and Unit 2 : E/2 of Section 27 and E /2 of Section 34. That the depths at which the Applicant

expects to encounter said sources of supply in said area shall be furnished at the time of hearing .

(C) That the permi tted well in the drilling and spacing units requested herein is

necessary to effectively and efficiently drain the po rt ion of the common sources of supply

(rese rvoir) covered by such drilling and spacing unit , there being no existing well within the drilling

and spacing unit which can effectively and efficiently drain the po rt ion of the common sources of

supply (reservoir) covered by such drilling and spacing unit .

Applicant has conducted a diligent and meaningful search of the local county

assessor's records , county treasurer's records , county deed records regarding the prope rt y

i nvolved for return addresses on recorded instruments , county probate records and city and county

telephone directories and other sources of such information to locate the whereabouts and mailing

address of each Respondent , or the identity , whereabouts and mailing address of Respondent 's

heirs, executors , administrators , trustees , successors, devisees or assigns , if any.

RELIEF SOUGHT : Applicant requests that the Commission enter an order : ( a) extending

the provisions of Order No . 555439, which order established 640 -acre drilling and spacing units for

the production of gas from the Caney , Woodford , Sylvan , Joins and Arbuckle common sources of

supply to cover and include said Section 27 , Township 2 No rth , Range 12 East , Atoka County,

Oklahoma ; and (b) establishing Unit 1 : the W/2 of Section 27 and W/2 of Section 34 and Unit 2 :

the E/2 of Section 27 and E/2 of Section 34 , all in Township 2 No rth , Range 12 East , Atoka County ,

Oklahoma , as two irregular 640 - acre horizontal well units for the production of gas from the

Miss issippian , Woodford , Hunton and Sylvan common sources of supply , with the permi tted well(s)

to be located not less than 660 feet from the horizontal unit bounda ry. Applicant fu rther requests

that the order to be entered in this cause be made effective on some date prior to the date of the

hearing.
