COMES NOW Applicant and shows the Honorable Corporation Commission as follows :

l . Parties : Applicant is Special Energy Corporation , P . O . Drawer 369 , Stillwater , OK 74076 , (405) 377-1177 ; fax (405) 743-1617 . The Attorney for Applicant is Michael D . Stack, 3500 South Boulevard, Suite "D-5", Edmond, Oklahoma 73013, Telephone : (405) 216-8898 ; Fax : (405) 216-8321 . Applicant is the owner of the right to drill a well to the formations as shown in paragraph 2a of the "Allegation of Facts" listed below underlying Section 1, Township 14 North, Range 3 East, Lincoln County, Oklahoma, by virtue of valid and subsisting oil and gas leases owned by Applicant covering portions of said land . The names and addresses of each party being made a respondent to this application are as shown on the Exhibit "A" attached hereto and made a part hereof . Each of the entities listed on the Exhibit "A" that is an individual, partnership, corporation or other association is being made a respondent if such entity continues to have legal existence, and if any such entity is deceased or dissolved, then the unknown successors, trustees and assigns, both immediate and remote, of such deceased or dissolved entity are made respondents herein .

Allegation of Facts :

a . The land described in the caption hereof constitutes 640 acre "drilling and spacing units", as defined by Title 52, Section 87 .1, O .S ., and as heretofore established by the Commission by Order to be entered in Cause No . 200801479-T for the Misener-Hunton horizontal common source of supply ; within said "drilling and spacing unit", there are two or more separately owned tracts or there are undivided interests separately owned for which the owners have not agreed to pool their oil and gas interests and to drill and develop the "drilling and spacing unit" as a unit and common source of supply as a unit .

b . Applicant has conducted a diligent and meaningful search of the local county assessor's records, county treasurer's records, county deed records regarding the property involved for return addresses on recorded instruments, county probate records and city and county telephone directories and other sources of such information to locate each respondent and has made a bona fide effort to reach an agreement as to the development of the unit with each respondent located by such search .

c . Applicant or some other party recommended by Applicant as operator having drilled or proposes to drill a well or wells if hereinafter authorized to be drilled on the drilling and spacing unit to test the formations as listed in paragraph 2a above and the avoiding of the drilling of unnecessary wells, the prevention of waste, and the protection of correlative rights require that the Commission order all owners to pool their interests and to drill and develop the "drilling and spacing unit" and common source of supply as a unit .

d . Applicant could request that the Order to be entered in this cause include a provision allowing the operator one year from the date of the Order to commence drilling operations .

Applicant as operator requests that the Commission pool the interests and

adjudicate the rights and equities of oil and gas owners on a unit pooling in the " drilling and spacing unit " and common source of supply listed in paragraph 2a . of the " Allegation of Facts ", all to be upon such terms and conditions as are just and reasonable and which will afford all

of such owners the opportunity to recover or receive without unnecessa r y expense their just and fair share of all hydrocarbon substances produced therefrom , and that the Commission make definite provisions for the payment of all actual costs and expenses , not to exceed reasonable costs and expenses of drilling and development , including a reasonable charge for supervision .

WHEREFORE, Applicant prays that, after notice and hearing as required by law, all oil and gas interest be pooled and the rights and equities of all oil and gas owners be adjudicated .
