MINUTES TO THE REGULAR MEETING OF

December 16, 2010

The regular monthly meeting of the Board was called to order by the Chairman at 9:30 a.m. in the Conference Room of the Board’s offices, Baton Rouge, Louisiana. Members of the Board present:

There being a quorum, the regular order of business began.

Attending the meeting were: Michael B. A MOTION was made by Mr. Clouatre and seconded by Mr. Stuart to accept the Minutes of the November 18, 2010 regular meeting, as prepared. The Motion passed.

NEW BUSINESS:

◙ Judgment Hearing(s):

Hubbs Construction, LLC (CL#48686 & RL #98970)

Administrative Hearing – Consider an alleged violation by Hubbs Construction, LLC of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the Justice of the Peace Court, Ward One, Number 083010-M1, Parish of Livingston, State of Louisiana, on the 28th day of September, 2010, in which Hubbs Construction, L.L.C., holder of commercial contractor’s license number 48686, and residential contractor’s license number 89870, were ordered to pay in the sum of SEVEN HUNDRED ELEVEN DOLLARS AND 75/100 ($711.75) with 18% per annum interest thereon from August 30, 2010 the date due, until paid, plus attorney’s fees pursuant to La. R.S. 9:2781 in the amount of $177.94, all costs of the proceedings, including but not limited to, all court costs, all with judicial interest thereon from the date of judicial demand until paid in favor of LA Aggregate Materials, Inc.

Ms. Kris Fitch read the allegations against HUBBS CONSTRUCTION, LLC and asked if a representative was present. There was no response.

Ms. Jill Zachary, representing LA Aggregate Materials was present. Ms. Zachary came to the stand was sworn in. She stated that LA Aggregate Materials and HUBBS CONSTRUCTION, LLC have come to an Agreement, and that the remaining balance of the outstanding judgment will be paid in full by January 31, 2011.

A MOTION was made by Mr. Meredith and seconded by Mr. Gallo to give HUBBS CONSTRUCTION, until January 31, 2011 to have the remaining balance of the outstanding judgment with LA Aggregate Materials paid in full. If the outstanding balance of the judgment is not paid in full by January 31, 2011, the Commercial and Residential licenses held by HUBBS CONSTRUCTION, LLC will be immediately revoked. The Motion passed.

Inman Construction Services, Inc. (CL#43459 & RL #87412)

Administrative Hearing – Consider an alleged violation by Inman Construction Services, Inc. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the First Parish Court for the Parish of Jefferson, Parish of Jefferson, State of Louisiana, on the 20th day of October, 2010, in which Kenneth L. Inman, III and Inman Construction Services, holder of commercial contractor’s license number 43459, and residential contractor’s license number 87412, jointly, severally, and in solido were ordered to pay in the principal amount of FIVE THOUSAND SIX HUNDRED FORTY-EIGHT DOLLARS AND 62/100 ($5,648.62) plus interest at the per annum rate of 18% on each unpaid invoice commencing from the twentieth day of the month following the month of the invoice until paid, attorney’s fees in the amount of $1,410.00, and all costs of the court in favor of The Sherwin-Williams Company.

Ms. Kris Fitch read the allegations against INMAN CONSTRUCTION SERVICES, INC. and asked if a representative was present. There was no response.

Attorney Frank White was present. Mr. White came to the stand and testified that he was representing Sherwin-Williams in this matter. There has been no contact from INMAN CONSTRUCTION SERVICES, INC. regarding this matter.

A MOTION was made by Mr. Meredith and seconded by Mr. Clouatre to give INMAN CONSTRUCTION SERVICES, INC. thirty (30) days to pay the outstanding Judgment. If the judgment is not paid with the thirty (30) days, Commercial License Number 43459 and Residential License Number 87412 held by INMAN CONSTRUCTION SERVICES, INC. will be immediately revoked. The Motion passed.

McManus Electric, Inc. (CL#49536)

Administrative Hearing – Consider an alleged violation by McManus Electric, Inc. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the 22nd Judicial District Court, No. 2009-16675 “H”, Parish of St. Tammany, State of Louisiana, on the 2nd day of August, 2010, in which Flavius R. McManus and McManus Electric, Inc., holder of commercial contractor’s license number 49536, jointly, severally, and in solido were ordered to pay in the principal amount of FOUR THOUSAND SEVEN HUNDRED TWENTY-SEVEN DOLLARS AND 48/100, ($4,727.48) plus interest at the rate of 12% per annum commencing on October 1, 2009 until paid, attorney’s fees in the amount of $1,500.00, and all costs of court in favor of Southern Pipe & Supply Company, Inc.

Ms. Kris Fitch read the allegations against McManus Electric, Inc. and asked if a representative of McManus Electric, Inc. was present. Mr. Flavius McManus and Mrs. Sandra McManus were both present, came to the stand, and were sworn in.

Attorney Frank White came to the stand and testified that he was representing Southern Pipe and Supply Company in this matter.

Ms. Laborde questioned Mr. McManus regarding a letter received from Mr. McManus’ attorney relating to the Bankruptcy the McManus’ were in the process of finalizing. Ms. Laborde suggested this matter be suspended until after the Bankruptcy matter is over.

The Board decided not to take any action taken today relating to this contractor, until after their Bankruptcy matter is finalized.

R. E. Jenkins, Inc. (CL#13931)

Administrative Hearing – Consider an alleged violation by R. E. Jenkins, Inc. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the City Court, City of Baton Rouge, Parish of East Baton Rouge, State of Louisiana, on the 13th day of August, 2010, in which R.E. Jenkins, Inc., holder of commercial contractor’s license number 13931, was ordered to pay in the principal amount of THREE THOUSAND FOUR HUNDRED

THIRTY-THREE DOLLARS AND 78/100, ($3,433.78) plus attorney’s fees of 25% principal and interest, interest on each invoice at the per annum rate of 18% commencing from the thirtieth day of the month following the month of the invoice, and all costs of court in favor of Southern Pipe & Supply Company, Inc.

Ms. Kris Fitch read the allegations against R. E. JENKINS, INC. and asked if a representative was present. There was no response.

Attorney Frank White came to the stand and testified that he was representing Southern Pipe and Supply Company. He requested the Board give R. E. JENKINS, INC. thirty (30) days to resolve this matter with Southern Pipe & Supply Company.

A MOTION was made by Mr. Meredith and seconded by Mr. Clouatre to give R. E. JENKINS, INC. thirty (30) days to pay the outstanding Judgment. If the outstanding judgment with Southern Pipe and Supply Company is not paid with the thirty (30) days, Commercial License Number 13931 held by R. E. JENKINS, INC will be immediately revoked. The Motion passed.

Reliable Elevator Services, LLC (CL#39368)

Administrative Hearing – Consider an alleged violation by Reliable Elevator Services, LLC of the provisions of Louisiana R. S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the Justice of the Peace Court, 4th Ward, Docket No. C-10-173, Parish of St. Tammany, State of Louisiana, on the 31st day of August, 2010, in which Reliable Elevator Services, LLC, holder of commercial contractor’s license number 39368, was ordered to pay in the sum of FOUR THOUSAND TWO HUNDRED FIFTY-EIGHT DOLLARS AND 00/100 ($4,258.00), in recognition of the Plaintiff’s lien, and together with legal interest from date of judicial demand, plus all recoverable court costs of the proceedings, until paid in full ($4,178.00 plus $80.00 court costs) in favor of I.T.S. Fire Alarm Security, LLC.

Ms. Kris Fitch read the allegations against RELIABLE ELEVATOR SERVICES, LLC and asked if a representative was present. There was no response. There was also no one present from I.T.S. Fire Alarm Security, LLC.

A MOTION was made by Mr. Weston and seconded by Mr. Gallo to revoke Commercial License Number 39368 held by RELIABLE ELEVATOR SERVICES, LLC for non payment of the outstanding judgment with I.T.S. Fire Alarm Security, LLC. The Motion passed.

Weststar Construction (CL#26985)

Administrative Hearing – Consider an alleged violation by Weststar Construction Inc. of the provisions of Louisiana R. S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the Justice of the Peace Court, Ward One, No. 083010-M3, Parish of Livingston, State of Louisiana, on the 8th day of October, 2010, in which Weststar Construction, Inc., holder of commercial contractor’s license number 26985, was ordered to pay in the principal sum of THREE THOUSAND NINE HUNDRED FIFTY EIGHT DOLLARS AND 95/100 ($3,958.95) with 18% per annum interest thereon from September 30, 2008, the date due, until paid, plus attorney’s fees pursuant to La. R.S. 9:2781 in the amount of $989.73, all costs of the proceedings, including but not limited to, all court costs, all with judicial interest thereon from the date of judicial demand until paid in favor of LA Aggregate Materials, Inc.

Ms. Kris Fitch read the allegations against WESTSTAR CONSTRUCTION and asked if a representative was present. There was no response.

Ms. Jill Zachary, representing LA Aggregate Materials was present. Ms. Zachary came to the stand and testified that LA Aggregate Materials and WESTSTAR CONSTRUCTION have come to an agreement, and this matter should be resolved by May 31, 2011.

A MOTION was made by Mr. Gallo and seconded by Mr. Weston to give WESTAR CONSTRUCTION until May 31, 2011 to pay the outstanding judgment in full. If the judgment with LA Aggregate Materials is not paid in full by May 31, 2011, Commercial License Number 26985 held by WESTSTAR CONSTRUCTION will be immediately revoked. The Motion passed.

◙ Compliance Hearing(s):

E.R.S.C., INC. (Unlicensed)

Administrative Hearing – Consider an alleged violation by E.R.S.C., Inc., of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, E.R.S.C., Inc., acted as a contractor to perform work on the Dutchtown High School Stadium - Home Side Bleachers project in Geismar, Louisiana in the amount of $158,430.00 without possessing a Louisiana state contractor’s license.

Ms. Bobbie Hughes read the allegations against E.R.S.C., INC. and asked if a representative of E.R.S.C., INC. was present. Ms. Angelina Leichner and Mr. Mike Pacheco each came to the stand, and were sworn. Mr. Pacheco entered a plea of No Contest.

Mr. Pacheco was questioned regarding the dollar amount of this bleacher project and if they sell and install the bleachers.

A MOTION was made by Mr. Weston and seconded by Mr. Clouatre to accept the No Contest Plea of E.R.S.C., INC. The Motion passed.

A MOTION was made by Mr. Clouatre and seconded by Mr. Weston to assess E.R.S.C., INC. a fine of $1,000.00 plus Administrative Fees associated with these proceedings. The Motion passed.

ACA Mechanical/Industrial, L.L.C. (CL#432)

Administrative Hearing – Consider an alleged violation by ACA Mechanical/Industrial, L.L.C. of the provisions of Louisiana R.S. 37:2150 – 2192, the Contractors’ Licensing Law, and in particular Section 2158 (A)(5), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, ACA Mechanical/Industrial, L.L.C. allowed its Louisiana State contractor’s license number 432 to be used by an unlicensed general contractor to perform work in an amount in excess of $50,000 on the Taiko Japanese Restaurant project in Baton Rouge, Louisiana.

Ms. Bobbie Hughes read the allegations against ACA MECHANICAL/INDUSTRIAL, L.L.C. and asked if a representative was present. Attorney Eric Kracht representing ACA Mechanical/Industrial, L.L.C. was present. Attorney Kracht entered a Not Guilty plea to the allegations. Mr. Barry Brown, Ms. Sonja Brown and Ms. Donna Prestridge were present. Ms. Jessica Frederic, a Court Reporter from the Baton Rouge Court Reporter organization was also present. Mr. Brown, Ms. Sonja Brown, Ms. Prestridge and Ms. Frederic were all sworn in.

Ms. Laborde asked Attorney Kracht, Mr. Barry Brown, Ms. Sonja Brown and Ms. Prestridge if they objected to the related matters being consolidated. There were no objections. Ms. Bobbie Hughes gave a brief synopsis to the Board regarding the allegations.

Based on testimony from the other parties involved in this consolidated matter, Attorney Kracht requested that the allegations against ACA MECHANICAL/INDUSTRIAL, L.L.C. be dismissed.

A MOTION was made by Mr. Weston and seconded by Mr. Fenet and Mr. Stuart to dismiss the allegations against ACA MECHANICAL/INDUSTRIAL, L.L.C. The Motion passed.

Acadian Commercial Construction, LLC (CL#52628)

Administrative Hearing – Consider an alleged violation by Acadian Commercial Construction, LLC of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Acadian Commercial Contractors, LLC, entered into a subcontract with an unlicensed general contractor to perform work on the Taiko Japanese Restaurant project in Baton Rouge, Louisiana.

Ms. Bobbie Hughes read the allegations against ACADIAN COMMERCIAL CONSTRUCTION, LLC and asked if a representative was present. Mr. Randy Gautreau was present. Mr. Gautreau was sworn in and entered a Not Guilty plea. Ms. Bobbie Hughes gave a brief synopsis to the Board regarding the allegations.

Ms. Laborde asked Mr. Gautreau if he objected to the matters being consolidated. Mr. Gautreau stated he had no objection.

Mr. Gautreau stated that ACADIAN COMMERCIAL CONSTRUCTION, LLC builds shelves that are then leased and that he performed approximately $8,000.00 worth of work.

A MOTION was made by Mr. Clouatre and seconded by Mr. Fenet to dismiss the allegations against ACADIAN COMMERCIAL CONSTRUCTION, LLC. The Motion passed.

Alberes Contractors, LLC (Unlicensed)

Administrative Hearing – Consider an alleged violation by Alberes Contractors, LLC of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Alberes Contractors, LLC, acted as a contractor to perform work on the Taiko Japanese Restaurant project in Baton Rouge, Louisiana in an amount in excess of $50,000 without possessing a Louisiana State contractor’s license.

Ms. Bobbie Hughes read the allegations against ALBERES CONTRACTORS, LLC and asked if a representative was present. Mr. Gary Alberes and Mr. Talbert Ortego were present, and both were sworn in. Mr. Alberes entered a plea of Guilty. Ms. Bobbie Hughes gave a brief synopsis to the Board regarding the allegations.

Ms. Laborde asked Mr. Alberes if he objected to the matters being consolidated. Mr. Alberes stated he had no objection.

Mr. Gary Alberes testified that he let Mr. Barry Brown of ACA Mechanical/Industrial know that he was not licensed, and asked Mr. Brown help him to perform work on the job. Mr. Alberes claimed that Mr. Brown agreed, and that all of the financial matters would be handled through ACA. Mr. Alberes obtained an insurance policy from ACA and pulled a permit in the name of ACA Mechanical/Industrial. Ms. Laborde questioned Mr. Alberes if there was an agreement with ACA to use ACA’s license for a fee. Mr. Alberes stated that there was not a fee charged and that all of the money for the project would be controlled by ACA. Mr. Alberes stated that he was supervising and acting as the general contractor. Ms. Laborde requested that the Board refer to the exhibit packets to see the evidence of the documents in the name of Alberes. Mr. Weston questioned Mr. Alberes regarding payment of the bills on the project. Mr. Alberes responded that he paid the bills and paid the subcontractors.

A MOTION was made by Mr. Clouatre and seconded by Mr. Stuart to accept the Guilty plea of ALBERES CONTRACTORS, LLC. The Motion passed.

A MOTION was made by Mr. Weston and seconded by Mr. Clouatre to assess ALBERES CONTRACTORS, LLC a fine of $10,000.00 plus Administrative Fees associated with these proceedings. The Motion passed.

Cayard’s Inc. (CL#10398)

Administrative Hearing – Consider an alleged violation by Cayard’s Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Cayard’s Inc. entered into a subcontract with an unlicensed general contractor to perform work on the Taiko Japanese Restaurant project in Baton Rouge, Louisiana.

Ms. Bobbie Hughes read the allegations against CAYARD’S, INC and reported that CAYARD’S, INC had submitted a Settlement Offer in the amount of $500.00 Administrative Fees associated with these proceedings.

A MOTION was made by Mr. Weston and seconded by Mr. Gallo to accept the Settlement Offer. The Motion passed.

Commercial Electric Company of Alexandria, LLC (CL#18798)

Administrative Hearing – Consider an alleged violation by Commercial Electric Company of Alexandria, LLC of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Commercial Electric Company of Alexandria, LLC, entered into a subcontract with an unlicensed general contractor to perform work on the Taiko Japanese Restaurant project in Baton Rouge, Louisiana in an amount in excess of $50,000.00.

Ms. Bobbie Hughes read the allegations against COMMERCIAL ELECTRIC COMPANY OF ALEXANDRIA, LLC and asked if a representative was present. Mr. John Rino was present. Mr. Rino was sworn in and entered a plea of No Contest. Ms. Bobbie Hughes gave a brief synopsis to the Board regarding the allegations.

Ms. Laborde asked Mr. Rino if he objected to the matters being consolidated. Mr. Rino stated he had no objection.

Mr. Rino testified that he was contacted by Mr. Barry Brown representing ACA Mechanical/Industrial, L.L.C., he was issued a permit, and began working on the project. Upon completion of the project, Mr. Rino contacted Ms. Donna Prestridge with ACA Mechanical/Industrial, L.L.C., and was instructed to mail his invoice(s) to Barry Brown for payment. Mr. Rino mailed the invoice to Mr. Brown, but Mr. Brown only paid him a portion of the money. Mr. Rino also testified that because he did not have a written contract, he was not sure who he was working for on this project.

A MOTION was made by Mr. Clouatre and seconded by Mr. Crain to accept the No Contest plea of COMMERCIAL ELECTRIC COMPANY OF ALEXANDRIA, LLC. The Motion passed.

A MOTION was made by Mr. Weston and seconded by Mr. Fenet to dismiss the matter against COMMERCIAL ELECTRIC COMPANY OF ALEXANDRIA, LLC. The Motion passed.

Construction Specialties, L.L.C. (CL#42860)

Administrative Hearing – Consider an alleged violation by Construction Specialties, L.L.C. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Construction Specialties, L.L.C. bid to perform work for an unlicensed general contractor on the Taiko Japanese Restaurant project in Baton Rouge, Louisiana.

Ms. Bobbie Hughes read the allegations against CONSTRUCTION SPECIALTIES, L.L.C. and stated that CONSTRUCTION SPECIALTIES, L.L.C. had submitted a Settlement Offer in the amount of $500.00 plus Administrative Fees associated with these proceedings.

A MOTION was made by Mr. Weston and seconded by Mr. Stuart to accept the Settlement Offer. The Motion passed.

S&S Sprinkler Co., L.L.C. (CL#30673)

Administrative Hearing – Consider an alleged violation by S&S Sprinkler Co., L.L.C. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, S&S Sprinkler Co., L.L.C. entered into a subcontract with an unlicensed general contractor to perform work on the Taiko Japanese Restaurant project in Baton Rouge, Louisiana.

Ms. Bobbie Hughes read the allegations against of S&S SPRINKLER CO., L.L.C and asked if a representative was present. Mr. Parks Moore, Mr. Richard Booth and Mr. Leland Moore, Sr., were present, and all were sworn in. Mr. Booth entered a plea of No Contest. Ms. Bobbie Hughes gave a brief synopsis to the Board regarding the allegations.

Ms. Laborde asked Mr. Booth if they objected to the matters being consolidated. Mr. Booth stated they did not object to the consolidation.

Mr. Richard Booth testified that the S&S SPRINKLER CO. bid the job to Acadian Commercial Construction, LLC, but learned that Acadian Construction was not awarded the project. S&S SPRINKLER CO was later contacted by Alberes Contractor about bidding on the Taiko Japanese Restaurant project, so S&S SPRINKLER CO. pulled the original bid and submitted it to Alberes Contractor.

A MOTION was made by Mr. Clouatre and seconded by Mr. Stuart to accept the No Contest plea of S&S SPRINKLER CO., L.L.C. The Motion passed.

A MOTION was made by Mr. Stuart and seconded by Mr. Weston to dismiss the matter against S&S SPRINKLER CO., L.L.C. The Motion passed.

Associated Builders, THE (Unlicensed)

Administrative Hearing – Consider an alleged violation by The Associated Builders of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, The Associates Builders, acted as a contractor to perform work on the Beacon Light Baptist Church project in Houma, Louisiana in an amount in excess of $50,000 without possessing a Louisiana State contractor’s license.

Ms. Bobbie Hughes gave a brief synopsis to the Board regarding documents that were subpoenaed from B & T Construction, LLC, she reported that as of today, staff has not received the subpoenaed documents.

Ms. Laborde asked Mr. Porche if he had submitted the documents that were subpoenaed. Mr. Porche responded his ex-wife received and signed for the letter, but never opened it.

Administrative Hearing – Consider an alleged violation by CR Trahan Contractors, Inc. of the provisions of Louisiana R. This hearing is being called for reason that on information and belief, CR Trahan Contractors, Inc, failed to provide the requested documents during the time afforded on the Mt. Olive Renovation project in New Iberia, Louisiana.

Ms. Bobbie Hughes read the allegations against of CR Trahan Contractors, Inc. and asked if a representative was present. Mr. Ceasar Trahan was present, was sworn in and entered a plea of Not Guilty. Mr. Trahan stated that he received the Notice of Hearing which was left on his Office door. He has the documents which were subpoenaed.

Ellender’s Industrial Properties, Inc. (Unlicensed)

Administrative Hearing – Consider an alleged violation by Ellender’s Industrial Properties, Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Ellender’s Industrial Properties, Inc., acted as a contractor to perform work on the Ellender’s Warehouse project in Sulphur, Louisiana in an amount in excess of $50,000 without possessing a Louisiana State contractor’s license.

Ms. Bobbie Hughes read the allegations against of Ellender’s Industrial Properties, Inc. and asked if a representative was present. Mr. Dwaine Ellender and Ms. Lisa Fawror were present and were sworn in. Mr. Ellender entered a plea of No Contest. Ms. Bobbie Hughes gave a brief synopsis to the Board regarding the allegations. Mr. Ellender stated he was not aware that he needed to be licensed, that once he was notified, he hired a licensed general contractor to finish this project.

A MOTION was made by Mr. Clouatre and seconded by Mr. Fenet to accept the No Contest plea of Ellender’s Industrial Properties, Inc. The Motion passed.

Administrative Hearing – Consider an alleged violation by KA Construction LLC of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Rules and Regulation Section 101, and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, KA Construction LLC, failed to provide the requested documentation during the time afforded on the Oishi Japanese Sushi & Grill project in Zachary, Louisiana.

Ms. Bobbie Hughes read the allegations against of KA CONSTRUCTION LLC and asked if a representative was present. Mr. Adrian Ard was present, sworn in, and entered a plea of No Contest. Mr. Ard stated he had faxed in some of the documents, but was not sure what other documents were needed.

Ms. Laborde reviewed the exhibit packet with Mr. Ard. Mr. Art responded he wrote up the contract with the Owner of the Oishi Japanese Sushi & Grill, but does not have payroll records.

Ms. Laborde called Compliance Investigator, Todd Brady to the stand and he was sworn in. Ms. Laborde reviewed the exhibit packet with Mr. Brady and requested that the exhibit packet be received into the record. Judge White accepted the exhibit packet into the record.

Ms. Dupuy reported to the Board that two (2) documents were provided to them a current listing of Louisiana State Board of Contractors employees and Compliance statistics. Ms. Dupuy then recognized Mr. Rhett Jeansonne with the Louisiana Department of Insurance.

Ms. Kris Fitch then gave a presentation to the Board Member regarding two (2) advertisements the Louisiana State Licensing Board for Contractors will be running.

Ms. Emma Payne, Supervisor of the Application Section presented a Plaque to Ms. Rosemary McCullough in recognition of her upcoming retirement. Ms. Payne then introduced her staff from the Applications Section.
