The following people have been arrested and charged with a variety of crimes. As part of the Court process, they have been referred to the Probation Department, where you will be responsible to complete a Pre-Sentence Report recommending the appropriate consequences. Select one of the cases and use the information included to complete your report.

Case 1

Name: Marta Garcia Age: 26

Charge: Possession of crack cocaine

Residence: 619 30th Street, Calexico, CA 92231; lives alone; no family members or references

Employment: Unemployed

Education: 11th Grade

Criminal Record: As a juvenile, five arrests, mostly misdemeanors. As an adult, two arrests for petty theft and a conviction for possession of dangerous drugs. Probation was successfully completed.

Comment: Arrested while leaving a train station with a large quantity of crack cocaine. Urine test indicates the use of narcotics.

Case 2

Name: Stanley Wexler Age: 42

Charge: Possession and sale of crack cocaine

Residence: 3814 Sunset Drive, El Centro, CA 92243; lives with wife and two children

Employment: Self-employed owner of a drug store chain; annual salary $400,000

Education: Completed colleges, holds degrees in Pharmacology and Business Administration

Criminal Record: None

Comment: Arrested at his store by undercover police after attempting to sell a large quantity of heroin. Alleged to be a big time dealer. No indication of drug usage.

Case 3

Name: Gloria Hardy Age: 28

Charge: Physical Child Abuse

Residence: 120 Riverside Drive, Apt. 10, Imperial,

CA; lives with two sons, ages 5 and 7.

Employment: Works as a cashier at local retail store; earns $600 per week

Education: Completed high school

Criminal record: Was previously arrested for shop lifting and is currently on probation.

Comment: Was arrested after her younger son’s teacher noticed he had bruises on his legs and arms and reported the incident to the Department of Social Services. The two children indicated she hits them whenever she is upset.

Case 4

Name: Michael D. McKenna Age: 19

Charge: Assault

Residence: 412 Pine Street, Brawley, CA, 92243; lives alone; both parents are currently in prison

Employment: Waiter, earns $400 per week.

Education: Completed 10th Grade

Criminal Record: Six juvenile arrests (possession of marijuana, illegal possession of firearms, and four burglaries); convicted of firearms charge and two burglaries; spent two years in juvenile facility.

Comment: Arrested after being identified as the assailant in a street fight. Alleged leader of a street gang. Police consider him dangerous. There is no indication of drug use, but he has a history of fighting and assaulting other people.

Case 5

Name: Chow Yang Age: 34

Charge: Possession of stolen mail and forgery

Residence: 5361 Texas Street; lives with common law wife and two children by a prior marriage

Employment: Works 30 hours per week at a service station, earns minimum wage.

Education: Quit school after 8th grade.

Criminal record: Nine arrests, most vagrancy and drunk and disorderly conduct. Two convictions: (1) driving while intoxicated (fined and lost license), and (2) forgery (completed two years probation).

Comment: Arrested attempting to cash a stolen Social Security check. He has a serious drinking problem.
