SECTION 00700 - GENERAL CONDITIONS PART 1 - GENERAL

1. 1 GENERAL PROVISIONS

A. "Work" means all necessary and reasonably inferable construction and services required by the Contract Documents, whether completed or partially completed, and includes all other labor, materials, equipment and services provided or to be provided by the Contractor to fulfill the Contractor's obligations. The Work may constitute the whole or a part of the Project. The Contractor shall provide all work and materials, which any part of the Contract Documents requires him to provide.

1. The term Contractor shall mean in direct contract with the Owner. Subcontractors have an indirect relationship to the Owner by being in agreement directly with the Contractor. The terms may appear to be interchanged within the documents, with the use defined by the relationship of one with the Owner.

B. Execution of the Contract by the Contractor is a representation that the Contractor has visited the site, become familiar with local conditions under which the Work is to be performed and correlated personal observations with requirements of the Contract Documents. By executing the Contract, the Contractor acknowledges that he has satisfied himself as to the nature and location of the Work, the general and local conditions, including those bearing upon transportation, disposal, handling and storage of materials and waste, availability of labor, water, electric power, roads and uncertainties of weather, ground water table or similar physical conditions of ground, the character, quality and quantity of surface and sub-surface materials to be encountered, the character of equipment and facilities needed prior to and during the execution of the Work and all other matters which can in any way affect the work or the cost thereof under this Contract. Any failure by the Contractor to acquaint himself with all the available information concerning these conditions will not relieve him from any obligations with respect the Contract Documents.

C. The intent of the Contract Documents is to include all items necessary for the proper execution and completion of the Work by the Contractor. In the event of a conflict or inconsistency among the Contract Documents, or between the Contract Documents and applicable codes, the Contractor shall provide the greatest quantity, largest degree of safety, highest quality or most stringent material or work.

1. 2 DEFAULT

If the Contractor defaults or neglects to carry out the Work in accordance with the Contract Documents and fails within a seven-day period after written notice from the Owner to commence and continue correction of such default or neglect with diligence and promptness, the Owner may without prejudice to other remedies the Owner may have, correct such deficiencies. In such case the Owner may deduct from payments then or thereafter due the Contractor the entire cost of correcting such deficiencies, including compensation for additional services and expenses and heating, engineering, accounting, consulting services, attorneys' and legal assistants' fees and expenses made necessary by such default, neglect, or failure. If payments then or thereafter due the Contractor are not sufficient to cover such amounts, the Contractor shall pay the difference to the Owner. The Owner's actions pursuant to this Subparagraph shall not operate as a release of any obligation of a surety.
