| |In September 2016, the members of the NEB panel assigned to consider the Energy East project recused themselves following |
| |allegations of bias. The Chair and Vice-Chair of the NEB also recused themselves from some of their executive and administrative |
| |functions for reasonable apprehension of bias. In this session we will review the test for bias and reasonable apprehension of bias|
| |and look specifically at where allegations of bias arise in relation to staff conduct rather than the conduct of decision makers. |
| |We will briefly review case law on staff related bias and also discuss best practices. |
