General Rule: First Sale Doctrine → someone who purchases trademarked goods and wants to resell them can UNLESS, for some reason, the consumer would be confused. Under this rule, sales of trademarked items on Ebay etc… should all be ok. However, if the court finds consumer confusion, then the First Sale Doctrine does not apply. ................
