Membership Opportunity

The membership program offers one the opportunity to become a Premier Member of The Ritz-Carlton Spa, Naples. In addition to utilizing The Spa, members will also be able to take advantage of special amenities at The Ritz-Carlton Spa, Naples. The hotel is a magnificent Mediterranean-style resort located on the Gulf of Mexico. The Ritz-Carlton, Naples is set upon 26 acres of beautifully landscaped lawns, lush tropical gardens and a pristine white sandy beach. The interior is traditional Ritz-Carlton grandeur with antique art and furnishings, marble floors, Persian carpets and Austrian crystal chandeliers.

The facilities available at The Ritz-Carlton, Spa, Naples for members (the “Spa Facilities”) are located at the Ritz-Carlton, Naples the following resort amenities and activities including use of all Restaurants, The Nightclub/Bar, pools, spa services, water sports and the beach.

The Ritz-Carlton, Naples

The Ritz-Carlton, Naples overlooks the Gulf of Mexico and rests upon some of the most pristine white sand beachfront in Florida. A Mobile Five-Star, AAA Five-Diamond resort and Mobile Four-Star Spa, facilities offered to Premier Members include six restaurants, two outdoor swimming pools, beach and boardwalk, resort retail shops. Signing privileges will be offered to Premier Members in good standing at the following Ritz-Carlton restaurants, The Dinning Room, The Grill, The Poolside Café, Terrace Restaurant, Gumbo Limbo, H2O, & all restaurants located at the Ritz-Carlton Golf Resort.

Access to Spa Facilities

The Ritz-Carlton Spa, Naples facilities are available for use by resort guests at The Ritz-Carlton Resorts of Naples and members of The Spa and their guests.

Hours of Operation – Management reserves the right to alter the hours of operation without prior notice.

Winter Season 9am to 7pm

Summer Season 10am to 6pm

The Ritz-Carlton, Naples and The Ritz-Carlton Spa, Naples and its facilities are owned and operated by HMC OP BN LLC CCRC Buckhead/Naples LLC, Marriott International, Inc.

MEMBERSHIP ELIGIBILITY

Eligibility for Premier Membership

Persons who desire to acquire a Premier Membership to use The Ritz-Carlton Spa, Naples will be required to complete a Membership Application. Premier Memberships will be available to individuals and spouses approved for membership who pay a Membership Initiation Fee (The Initiation Fee) to the Ritz-Carlton Spa, Naples. The Initiation Fee will allow the individuals and spouses that are approved for membership to qualify for Premier Membership and maintain a good standing thereof. The Initiation Fee does not entitle such individuals and spouses to use the recreational facilities of The Spa. Membership does not automatically convey free use of the facilities since the member is charged dues and fees for use of specific facilities and activities. The number of Premier Memberships is limited and eligibility for membership is subject to availability.

All Membership Applications must be reviewed and approved by The Spa Membership Committee. The Committee will make the final determinations regarding approval or denial of an application.

Affirmation of Offering

If approved for Premier Membership in The Spa, the applicant agrees to be bound by the Terms and Conditions of this Membership Plan and irrevocably agrees to fully substitute the membership privileges pursuant to the Membership Plan and the Terms and Conditions as amended from time to time, for any present or prior rights in our use of The Spa facilities. All privileges and rights of Premier Membership and use of The Spa Facilities shall be limited as set forth in this Membership Plan and the Terms and Conditions as amended from time to time, and the Membership Application.

TERMS AND CONDITIONS

To ensure the comfort of all Members and guests, The Ritz-Carlton Spa, Naples (hereinafter referred to as “The Spa”) at the Ritz-Carlton, Naples (“the Hotel”) has issued the following Terms and Conditions. It is required that these Terms and Conditions are read and under-stood by each guest before his/her Membership application is submitted. It is the obligation of each Member and guest to adhere to these Terms and Conditions and to ensure that all accompanying follow the Terms and Conditions.

1. Spa Members and guests must be 18 years and older.

2. The Spa management must approve all Memberships for The Spa. Notification of acceptance will be within seven days of receipt of the application. Use of the facilities will only be available to Members of The Spa and their guests.

3. Membership in The Spa is subject to continued eligibility, payment of required fees and dues, compliance with terms of the Membership Agreement and continued compliance with the Terms and Conditions, as same are amended or modified from time to time.

4. The Spa will issue all Members a Membership card, which is not assignable or transferable. Any attempt to assign or transfer a Membership shall be void and unenforceable, and such may result in the immediate cancellation of Member’s Membership herein. Upon entering The Spa, Membership cards are to be left at the reception desk. Upon leaving The Spa, the card will be returned to the rightful Member.

5. Memberships that are not renewed within one month of expiring will be charged the then current Initiation Fee and treated as a new application if they are subsequently renewed.

6. Guest cards will be issued to nonresidential guests of a Member. Such guests may be invited to use The Spa no more than twice a month, except as otherwise provided herein. Collier and Lee County residents can be a guest-of-Member once a month or a total of twelve times in any calendar year. A charge for such cards may be made by The Spa.

7. Domestic employees of Members will not be permitted to use the Facilities of The Spa.

8. No food or beverages may be consumed at The Spa other than that purchased through the hotel restaurants or outlets/services.

9. Pets, other than animals assisting disabled Members or guests, are not allowed on The Spa premises.

10. Each Member and guest assumes complete responsibility for his or her actions and use of The Spa is at the sole risk of the Member and his or her guest(s). The Ritz-Carlton Spa, Naples and The Ritz-Carlton Hotel Company, L.L.C., any of its affiliates, subsidiaries, owners, shareholders, officers, employees and agents shall have no liability or responsibility for loss or damage to the property or valuables of Members and his or her guest(s), or for any injury or loss of life to any Member or guest while on Hotel or Spa premises, unless such is caused by the gross negligence or intentional conduct of The Spa.

11. The minimum attire that must be worn at all times shall consist of gym shorts, T-shirts, socks and tennis shoes. Any conventional exercise attire is permissible, including leotards, tights, sweat suits, warm-up suits, etc. Sneakers, tennis shoes or dance slippers must be worn at al times. Bareback or bare-midriff clothing, torn, ragged, dirty or otherwise inappropriate clothing shall not be allowed. Only conventional bona fide swimwear is permitted in the pool. Shorts and cut-off pants are not allowed in the pool. Members must be properly attired upon entering and leaving The Spa, and will not be admitted bare-chested, bare-footed, or in dirty workout clothes. Members will not be permitted to remain in the public areas of the Hotel while in workout clothes.

12. Failure and/or refusal to comply with the above Terms and Conditions, as well as other Terms and Conditions imposed and established by The Ritz-Carlton from time to time, or failure to result in loss of Membership privileges without refund, if, in the sole option of The Ritz-Carlton, the violation by a Member or a guest of a Member is detrimental to the general Membership and the guests of the Hotel.

13. No petition shall be originated, solicited, circulated or posted on any of the Hotel premises.

14. Each Member shall be responsible for informing and filing with The Spa Operations Officer, in writing and preferably on a form provided by The Spa, a mailing address to which the Member desires to have all notices and invoices sent. A Member shall be deemed to have received The Spa’s mailings seven days after the same have been mailed to the address on file with The Spa.

15. In the event of the divorce or separation of married Members, the Premier Membership, including all its rights, benefits and obligations, will vest in the spouse awarded the Membership by an agreement of separation or a decree of divorce. In the absence of an agreement of separation or decree of divorce awarding the Membership, the Membership will belong to the spouse named in agreement between the spouses.

16. The Terms and Conditions herein may be amended or modified, without prior notice, by The Spa if necessary or deemed desirable in The Spa’s absolute discretion.
