BIDDER / CONTRACTOR RESPONSIBILITY

AS A CONDITION OF PERFORMING THE WORK, THE CONTRACTOR CERTIFIES THAT:

1. It will comply with the current King County prevailing wages pursuant to RCW 39.12. See Washington State Prevailing Wage Rates and Benefit Code Key. LINK: WA L&I Wages

2. It is a registered contractor with RCW 18.27. LINK: WA L&I Verify

3. It will comply with RCW 70.92, Aged and Physically Handicapped.

4. It will comply with RCW 28A.400.330, Crimes Against Children, and SHALL NOT have employees in areas where students are unsupervised at any time. Request to obtain written approval after appropriate background check.

6. It has industrial insurance coverage for its employees working in Washington as required in Title 51 RCW.

7. It has an employment security department number as required in Title 50 RCW.

8. It has a state excise tax registration number as required in Title 82 RCW. LINK: DOR Business Lookup

9. It is not disqualified from bidding on any public works contract under RCW 39.06.010 (unregistered or unlicensed contractors) or RCW 39.12.065(3) (prevailing wage violations). LINK: L&I Debarred Contractors

10. For all federally funded work, it will comply with Federal Executive order 12549 “Debarment and Suspension” and the origination certifies it and all subcontractors and their principals are not debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded by any Federal department or agency from doing business with the Federal Government.

11. Pursuant to RCW 39.04.350, within the three-year period immediately preceding the Bid Date, the Bidder has not been determined by a final and binding citation and notice of assessment issued by the Department of Labor and Industries or through a civil judgment entered by a court of limited or general jurisdiction to have willfully violated, as defined in RCW 49.48.082, any provisions in RCW 49.46, 49.48 or 49.52.

12. For public works projects subject to the apprenticeship utilization requirements in RCW 39.04.320, have not have been found out of compliance by the Washington state apprenticeship and training council for working apprentices out of ratio, without appropriate supervision, or outside their approved work processes as outlined in their standards of apprenticeship under chapter RCW 49.04for the one-year period immediately preceding the date of the bid solicitation. If this project is over $1,000,000, the Contractor will comply with RCW 39.04.320.
